15	15	mental Protection Agency have the force and effect of
16	16	law, and for other purposes.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘Maintaining Coopera-4
21	21	tive Permitting Act of 2025’’. 5
22	22	SEC. 2. STATE DISCHARGE OF DREDGED OR FILL MATE-6
23	23	RIAL PROGRAMS. 7
24	24	(a) W
25	25	ITHDRAWAL OF APPROVALWITHOUTCON-8
26	26	GRESSIONALAUTHORIZATIONPROHIBITED.— 9

30	30	(1) IN GENERAL.—The permit programs de-1
31	31	scribed in paragraph (2) are ratified, approved, and 2
32	32	of full force and effect, and the Administrator of the 3
33	33	Environmental Protection Agency (referred to in 4
34	34	this section as the ‘‘Administrator’’) may not with-5
35	35	draw the approval of those permit programs, includ-6
36	36	ing through the process described in section 404(i) 7
37	37	of the Federal Water Pollution Control Act (33 8
38	38	U.S.C. 1344(i)), unless the withdrawal is expressly 9
39	39	authorized by an Act of Congress enacted after the 10
40	40	date of enactment of this Act. 11
41	41	(2) P
42	42	ERMIT PROGRAMS DESCRIBED .—The per-12
43	43	mit programs referred to in paragraph (1) are the 13
44	44	following State permit programs for the discharge of 14
45	45	dredged or fill material approved under section 404 15
46	46	of the Federal Water Pollution Control Act (33 16
47	47	U.S.C. 1344): 17
48	48	(A) The program of the State of Michigan, 18
49	49	approved in the notice of the Environmental 19
50	50	Protection Agency entitled ‘‘Michigan Depart-20
51	51	ment of Natural Resources Section 404 Permit 21
52	52	Program Approval’’ (49 Fed. Reg. 38947 (Oc-22
53	53	tober 2, 1984)) and as described in section 23
54	54	233.70 of title 40, Code of Federal Regulations 24

59	59	scribed in a successor Federal Register notice). 2
60	60	(B) The program of the State of New Jer-3
61	61	sey, approved in the final rule and notice of the 4
62	62	Environmental Protection Agency entitled 5
63	63	‘‘New Jersey Department of Environmental 6
64	64	Protection and Energy Section 404 Permit Pro-7
65	65	gram Approval’’ (59 Fed. Reg. 9933 (March 2, 8
66	66	1994)) and as described in section 233.71 of 9
67	67	title 40, Code of Federal Regulations (including 10
68	68	any updates to the program described in a suc-11
69	69	cessor Federal Register notice). 12
70	70	(C) The program of the State of Florida, 13
71	71	as described in the notice of the Environmental 14
72	72	Protection Agency entitled ‘‘EPA’s Approval of 15
73	73	Florida’s Clean Water Act Section 404 As-16
74	74	sumption Request’’ (85 Fed. Reg. 83553 (De-17
75	75	cember 22, 2020)) (including any updates to 18
76	76	the program described in a successor Federal 19
77	77	Register notice), including the Programmatic 20
78	78	Biological Opinion with Incidental Take State-21
79	79	ment associated with the program. 22

81	81	ROGRAM TRANSITION PERIOD .—During 23
82	82	the 90-day period beginning on the date of enact-24
83	83	ment of this Act, the Secretary of the Army, acting 25

87	87	through the Chief of Engineers (referred to in this 1
88	88	section as the ‘‘Secretary’’), and the State of Florida 2
89	89	may both issue permits authorized under the pro-3
90	90	gram described in paragraph (2)(C) into navigable 4
91	91	waters (as described in subsection 404(g)(1) of the 5
92	92	Federal Water Pollution Control Act (33 U.S.C. 6
93	93	1344(g)(1))) within the jurisdiction of the State of 7
94	94	Florida. 8
95	95	(4) A
96	96	PPROVAL OF COMPARABLE STATE PRO -9
97	97	GRAMS.— 10
98	98	(A) I
99	99	N GENERAL.—If the Administrator 11
100	100	determines that a State program submitted 12
101	101	under subsection (g)(1) of section 404 of the 13
102	102	Federal Water Pollution Control Act (33 U.S.C. 14
103	103	1344) is comparable to a State program de-15
104	104	scribed in any of subparagraphs (A) through 16
105	105	(C) of paragraph (2), the Administrator shall 17
106	106	make the determination described in subsection 18
107	107	(h)(2)(A) of that section with respect to that 19
108	108	program. 20
109	109	(B) N
110	110	OTIFICATION.—On making the deter-21
111	111	mination required under subparagraph (A), the 22
112	112	Administrator shall notify the Secretary and the 23
113	113	applicable State of that determination. 24

117	117	(C) SUSPENSION.—On notification from 1
118	118	the Administrator under subparagraph (B) and 2
119	119	from a State that the State has begun to ad-3
120	120	minister a program approved pursuant to sub-4
121	121	paragraph (A), the Secretary shall suspend the 5
122	122	issuance of permits under subsections (a) and 6
123	123	(e) of section 404 of the Federal Water Pollu-7
124	124	tion Control Act (33 U.S.C. 1344) for activities 8
125	125	with respect to which a permit may be issued 9
126	126	by the State under that program. 10

128	128	LARIFICATION OFPROCESS.—Section 404(h) of 11
129	129	the Federal Water Pollution Control Act (33 U.S.C. 12
130	130	1344(h)) is amended by adding at the end the following: 13
131	131	‘‘(6) N
132	132	OT A RULE OR REGULATION .—The ap-14
133	133	proval of a State permit program under this section 15
134	134	shall not be considered to be a rule or regulation.’’. 16
