To amend the Elementary and Secondary Education Act 
of 1965 to authorize a grant program to support stu-
dents who have epilepsy or a seizure disorder. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Seizure Awareness and 4
Preparedness Act’’. 5
SEC. 2. GRANT PROGRAM TO SUPPORT STUDENTS WHO 6
HAVE EPILEPSY OR A SEIZURE DISORDER. 7
(a) I
NGENERAL.—Title IV of the Elementary and 8
Secondary Education Act of 1965 (20 U.S.C. 7101 et 9
seq.) is amended by adding at the end the following: 10

‘‘SEC. 4701. GRANT PROGRAM TO SUPPORT STUDENTS WHO 4
HAVE EPILEPSY OR A SEIZURE DISORDER. 5
‘‘(a) D
EFINITIONS.—In this section: 6
‘‘(1) I
NDIVIDUALIZED EMERGENCY HEALTH 7
CARE PLAN.—The term ‘individualized emergency 8
health care plan’ means a document developed by a 9
student’s health care provider, in consultation with 10
the parent of a student with epilepsy or a seizure 11
disorder, other appropriate medical professionals 12
who may be providing epilepsy or seizure disorder 13
care to the student, and the school nurse, which out-14
lines a set of procedural guidelines that provide spe-15
cific directions about what to do in a particular 16
emergency situation and is signed by the health care 17
provider, the parent, and the school nurse. 18
‘‘(2) I
NDIVIDUALIZED HEALTH CARE PLAN .— 19
The term ‘individualized health care plan’ means a 20
document developed by a student’s health care pro-21
vider, in consultation with the parent of a student 22
with epilepsy or a seizure disorder, other appropriate 23
medical professionals who may be providing epilepsy 24
or seizure disorder care to the student, and the 25
school nurse, which is consistent with the rec-26

ommendations of the student’s health care provider 1
and which sets out the health services needed by the 2
student at school and is signed by the health care 3
provider, the parent, and the school nurse. 4
‘‘(b) A
UTHORIZATION OF GRANTPROGRAM.—The 5
Secretary shall award grants to States, on a competitive 6
basis, to enable the States to award subgrants to local 7
educational agencies to carry out a program that supports 8
students with epilepsy and seizure disorders in schools. 9
‘‘(c) A
PPLICATIONS FORGRANTS.—A State that de-10
sires to receive a grant under this section shall submit an 11
application to the Secretary at such time, in such manner, 12
and accompanied by such information as the Secretary 13
may require. 14
‘‘(d) S
UBGRANTSAUTHORIZED.— 15
‘‘(1) I
N GENERAL.—A State that receives a 16
grant under this section shall use the grant funds to 17
award subgrants to local educational agencies to en-18
able the local educational agencies to carry out a 19
program that funds training of school personnel on 20
seizure awareness and preparedness that covers indi-21
vidualized health care plans and individualized emer-22
gency health care plans for students who have epi-23
lepsy or a seizure disorder. 24

‘‘(2) APPLICATIONS FOR SUBGRANTS .—A local 1
educational agency that desires to receive a subgrant 2
under this subsection shall submit an application to 3
the State at such time, in such manner, and accom-4
panied by such information as the State may re-5
quire. 6
‘‘(3) U
SE OF SUBGRANT FUNDS .— 7
‘‘(A) I
N GENERAL.— 8
‘‘(i) R
EQUIRED USE.—A local edu-9
cational agency that receives a subgrant 10
under this subsection shall use the 11
subgrant funds to carry out a program in 12
the elementary schools and secondary 13
schools served by such agency to fund 14
training of school personnel on seizure 15
awareness and preparedness that covers in-16
dividualized health care plans and individ-17
ualized emergency health care plans for 18
students who have epilepsy or a seizure 19
disorder. 20
‘‘(ii) P
ERMISSIVE USES.—A local edu-21
cational agency that receives a subgrant 22
under this subsection may use the 23
subgrant funds for— 24

‘‘(I) training of school personnel 1
to administer or assist with the ad-2
ministration of seizure medications; 3
‘‘(II) training and education of 4
students on seizure awareness and 5
preparedness; 6
‘‘(III) recruiting, hiring, and re-7
taining dedicated compliance staff 8
who are responsible for ensuring that 9
all training and program requirements 10
related to seizure awareness, pre-11
paredness, and management are con-12
sistently met; and 13
‘‘(IV) other activities or pro-14
grams determined appropriate by the 15
Secretary. 16
‘‘(B) I
NFORMATION INCLUDED .—It is rec-17
ommended that each individualized health care 18
plan and each individualized emergency health 19
care plan include the following information: 20
‘‘(i) Written orders from the student’s 21
physician or advanced practice nurse out-22
lining the epilepsy or seizure disorder care. 23

‘‘(ii) The symptoms of the epilepsy or 1
seizure disorder for that particular student 2
and recommended care. 3
‘‘(iii) Full participation in exercise 4
and sports, and any contraindications to 5
exercise, or accommodations that shall be 6
made for that particular student. 7
‘‘(iv) Accommodations for school trips, 8
after-school activities, class parties, and 9
other school-related activities. 10
‘‘(v) Education of all school personnel 11
about epilepsy and seizure disorders, how 12
to recognize and provide care for epilepsy 13
and seizure disorders, and when to call for 14
assistance. 15
‘‘(vi) Medical and treatment issues 16
that may affect the educational process of 17
the student with epilepsy or the seizure 18
disorder. 19
‘‘(vii) The student’s ability to manage, 20
and the student’s level of understanding of, 21
the student’s epilepsy or seizure disorder. 22
‘‘(viii) How to maintain communica-23
tion with the student, the student’s parent 24

and health care team, the educational 1
staff, and the school nurse. 2
‘‘(C) T
RAINING REQUIRED.— 3
‘‘(i) I
N GENERAL.—Each local edu-4
cational agency carrying out a program 5
supported with subgrant funds shall ensure 6
that the school nurse assigned to a par-7
ticular elementary school or secondary 8
school supported by the program— 9
‘‘(I) coordinates the provision of 10
epilepsy and seizure disorder care at 11
such school; and 12
‘‘(II) ensures that all staff are 13
trained not less often than every 2 14
years in the care of students with epi-15
lepsy and seizure disorders, including 16
staff working with school-sponsored 17
programs outside of the regular school 18
day, as provided in individualized 19
health care plans and individualized 20
emergency health care plans. 21
‘‘(ii) I
NSTRUCTION.—The training re-22
quired under clause (i) shall include a De-23
partment of Education-approved on-line or 24
in-person course of instruction provided by 25

1 or more nonprofit national organizations 1
that support the welfare of individuals with 2
epilepsy and seizure disorders. 3
‘‘(D) S
CHOOL BUS DRIVERS .—Each local 4
educational agency carrying out a program sup-5
ported with subgrant funds shall ensure that 6
each school bus driver who transports a student 7
with epilepsy or a seizure disorder receives no-8
tice of the student’s condition, information on 9
how to provide care for epilepsy or the seizure 10
disorder, emergency contact information, epi-11
lepsy and seizure disorder recognition and first 12
aid training, and parent contact information. 13
‘‘(E) R
ELEASE.—Each local educational 14
agency carrying out a program supported with 15
subgrant funds shall ensure that the school 16
nurse assigned to a particular elementary 17
school or secondary school supported by the 18
program obtains a release from each parent of 19
a student with epilepsy or a seizure disorder 20
who requests an individualized health care plan 21
or an individualized emergency health care plan, 22
to authorize the sharing of medical information 23
between the student’s physician or advanced 24
practice nurse and other health care providers. 25

‘‘(F) NO LIABILITY.—No school employee, 1
including a school nurse, a school bus driver, a 2
school bus aide, or any other officer or agent of 3
a local educational agency, shall be held liable 4
for any good faith act or omission consistent 5
with the provisions of this section. Good faith 6
shall not include willful misconduct, gross neg-7
ligence, or recklessness. 8
‘‘(e) S
UPPLEMENT; NOTSUPPLANT.—Grant and 9
subgrant funds provided under this section shall be used 10
to supplement, not supplant, other Federal or State funds 11
available to carry out activities described in this section. 12
‘‘(f) A
UTHORIZATION OF APPROPRIATIONS.—There 13
is authorized to be appropriated to carry out this section 14
$34,500,000 for the period of fiscal years 2026 through 15
2030.’’. 16
(b) T
ABLE OFCONTENTS.—The table of contents in 17
section 2 of the Elementary and Secondary Education Act 18
of 1965 is amended by inserting after the item relating 19
to section 4644 the following new items: 20
