79	79	Manual of Mental Disorders, 5th Edition’’ (or 12
80	80	a successor edition); 13
81	81	(B) pathological gambling; 14
82	82	(C) gambling addiction; and 15
83	83	(D) compulsive gambling. 16

85	85	OVERNMENTAL ENTITY .—The term ‘‘gov-17

91	91	within the territorial boundaries of the United 23

106	106	FORM.—The term ‘‘interactive sports wagering plat-9
107	107	form’’ means a person or entity that offers licensed 10
108	108	sports wagering over the internet, including through 11
109	109	an internet website and mobile devices, on behalf of 12
110	110	a licensed gaming facility. 13

113	113	PACT.—The term ‘‘interstate sports wagering com-15
114	114	pact’’ means a compact to offer sports wagering in 16
115	115	accordance with this Act between— 17
116	116	(A) 2 or more States with a State sports 18
117	117	wagering program; 19
118	118	(B) 1 or more States with a State sports 20
119	119	wagering program and 1 or more Indian Tribes; 21

121	121	(C) 2 or more Indian Tribes. 23

171	171	(i) sponsors, organizes, schedules, or 9
172	172	conducts a sporting event; and 10
173	173	(ii) with respect to the sporting event 11
174	174	and the participants in the sporting 12
175	175	event— 13
176	176	(I) prescribes final rules; and 14
177	177	(II) enforces a code of conduct; 15

179	179	(B) a league or association of 1 or more 17
180	180	persons or governmental entities described in 18

201	201	(i) a straight bet; 8
202	202	(ii) a teaser; 9
203	203	(iii) a variation of a teaser; 10
204	204	(iv) a parlay; 11
205	205	(v) a total or over-under; 12
206	206	(vi) a moneyline; 13
207	207	(vii) a betting pool; 14
208	208	(viii) exchange wagering; 15
209	209	(ix) in-game wagering, including in- 16
210	210	game wagering on— 17
211	211	(I) a final or interim game score; 18
212	212	(II) statistics; or 19
213	213	(III) a discrete in-game event; 20
214	214	(x) a sports lottery; and 21

231	231	wagering’’ means the acceptance of a sports wager 9
232	232	by a sports wagering operator. 10

235	235	‘‘sports wagering operator’’ means— 12
236	236	(A) a licensed gaming facility that offers 13
237	237	sports wagering; and 14
238	238	(B) an interactive sports wagering plat-15

242	242	term ‘‘sports wagering opt-in State’’ means a State 18

247	247	(B) the District of Columbia; and 22

254	254	‘‘State regulatory entity’’ means the governmental 2
255	255	entity— 3
256	256	(A) established or designated by a sports 4
257	257	wagering opt-in State under section 5
258	258	102(a)(2)(A)(ii); and 6
259	259	(B) responsible, solely or in coordination 7
260	260	with 1 or more other governmental entities, for 8
261	261	the regulation of sports wagering in the applica-9
262	262	ble sports wagering opt-in State. 10

264	264	TATE SOCIAL GAMBLING LAW .—The term 11
265	265	‘‘State social gambling law’’ means a State law that 12
266	266	allows sports wagering that— 13
267	267	(A) is not conducted as a business; 14
268	268	(B) involves 2 or more players who com-15
269	269	pete on equal terms; and 16
270	270	(C) does not provide a benefit to— 17
271	271	(i) a player, other than the winnings 18
272	272	of the player; or 19
273	273	(ii) a person who is not involved in a 20
274	274	sports wager. 21

276	276	TATE SPORTS WAGERING PROGRAM .— 22
277	277	The term ‘‘State sports wagering program’’ means a 23
278	278	program administered and overseen by a State pur-24

287	287	arrangement that a sports wagering operator knows 5
288	288	or has reason to know, as determined by a director, 6
289	289	officer, employee, or agent of the sports wagering 7
290	290	operator is or would be if completed— 8
291	291	(A) a violation of, or part of a plan to vio-9
292	292	late or evade, any Federal, State, or local law 10
293	293	(including regulations); or 11
294	294	(B) sports wagering by or on behalf of an 12
295	295	individual described in subparagraph (C), (D), 13
296	296	or (E) of section 103(b)(4). 14

298	298	USPICIOUS TRANSACTION REPORT .—The 15
299	299	term ‘‘suspicious transaction report’’ means a report 16
300	300	submitted to a State regulatory entity or a sports 17
301	301	organization under section 103(b)(13). 18

303	303	RIBAL-STATE COMPACT .—The term 19
304	304	‘‘Tribal-State compact’’ means a compact entered 20
305	305	into between a State and an Indian Tribe pursuant 21

317	317	(b), it shall be unlawful for any person to knowingly accept 6
318	318	a sports wager. 7

320	320	XCEPTIONS.—It shall not be a violation of sub-8
321	321	section (a) for— 9
322	322	(1) a sports wagering operator located in a 10
323	323	sports wagering opt-in State to accept a sports 11
324	324	wager in accordance with State law; or 12
325	325	(2) a person to accept a sports wager in accord-13
326	326	ance with an applicable State social gambling law. 14

328	328	NJUNCTIONS.— 15

330	330	N GENERAL.—If the Attorney General be-16
331	331	lieves a person has violated, is violating, or will vio-17
332	332	late subsection (a), the Attorney General may bring 18
333	333	a civil action in the appropriate district court of the 19
334	334	United States or the appropriate United States 20
335	335	court of a territory or possession of the United 21
336	336	States, which shall have jurisdiction in proceedings 22
337	337	in accordance with the Federal Rules of Civil Proce-23
338	338	dure to enjoin a violation of subsection (a). 24

343	343	lation of an injunction or restraining order issued 2
344	344	under paragraph (1), trial shall be, on demand of 3
345	345	the accused, by a jury in accordance with the Fed-4
346	346	eral Rules of Civil Procedure. 5

350	350	N GENERAL.—Any person who violates 7
351	351	subsection (a) shall be, with respect to any such vio-8
352	352	lation, subject to a civil penalty of not more than the 9
353	353	greater of $10,000 or 3 times the amount of the ap-10
354	354	plicable sports wager. 11

356	356	EPARATE VIOLATIONS.—A separate viola-12
357	357	tion occurs for each sports wager accepted in viola-13
358	358	tion of subsection (a). 14

360	360	URISDICTION.—The district courts of the 15
361	361	United States and appropriate United States courts 16
362	362	of the territories and possessions of the United 17
363	363	States shall have jurisdiction to enforce this sub-18
364	364	section in accordance with section 1355 of title 28, 19
365	365	United States Code. 20

367	367	FFECT OF LAW.—A violation of subsection 21
368	368	(a) shall not constitute a crime, and a judgment for 22
369	369	the United States and imposition of a civil penalty 23
370	370	pursuant to paragraph (1) shall not give rise to any 24

379	379	ENALTY.—A civil penalty, injunction, or temporary re-4
380	380	straining order imposed under this section shall be inde-5
381	381	pendent of, and not in lieu of, criminal prosecutions or 6
382	382	any other proceedings under any other law of the United 7
383	383	States, including sections 1084 and 1955 of title 18, 8
384	384	United States Code. 9

386	386	FFECTIVEDATE.—Subsection (a) shall take ef-10
387	387	fect on the date that is 18 months after the date of enact-11
388	388	ment of this Act. 12
389	389	SEC. 102. STATE SPORTS WAGERING PROGRAM. 13
390	390	(a) I
391	391	NITIALAPPLICATION.— 14
392	392	(1) I
393	393	N GENERAL.—To request approval to ad-15
394	394	minister a State sports wagering program, a State 16
395	395	shall submit an application to the Attorney General 17
396	396	at such time, in such manner, and accompanied by 18
397	397	such information as the Attorney General may re-19
398	398	quire. 20
399	399	(2) C
400	400	ONTENTS.—An application under para-21
401	401	graph (1) shall include— 22
402	402	(A) a full and complete description of the 23
403	403	State sports wagering program the State pro-24

410	410	to sports wagering; and 4
411	411	(ii) an identification of the State regu-5
412	412	latory entity; and 6
413	413	(B) an assurance from the attorney gen-7
414	414	eral or chief legal officer of the State that the 8
415	415	laws of the State provide adequate authority to 9
416	416	carry out the proposed State sports wagering 10
417	417	program. 11
418	418	(b) A
419	419	PPROVAL BYATTORNEYGENERAL.— 12
420	420	(1) I
421	421	N GENERAL.—Not later than 180 days 13
422	422	after the date on which the Attorney General re-14
423	423	ceives a complete application under this section, the 15
424	424	Attorney General shall approve the application un-16
425	425	less the Attorney General determines that the pro-17
426	426	posed State sports wagering program does not meet 18
427	427	the standards set forth in section 103. 19

429	429	ENIAL OF APPLICATION .—A decision of 20
430	430	the Attorney General to deny an application sub-21
431	431	mitted under this section shall— 22
432	432	(A) be made in writing; and 23

440	440	OTICE OFMATERIALCHANGES.—In the case of 4
441	441	a material change to a State law relating to sports wager-5
442	442	ing, the State regulatory entity, or other information in-6
443	443	cluded in an application submitted pursuant to subsection 7
444	444	(a) or (e), not later than 30 days after the date on which 8
445	445	the change is made, the State shall submit to the Attorney 9
446	446	General a notice of such change. 10
447	447	(d) D
448	448	URATION.—A State sports wagering program 11
449	449	shall be valid for a fixed 3-year period beginning on the 12
450	450	date on which the Attorney General approves the applica-13
451	451	tion of the applicable State under subsection (a) or (e). 14

453	453	ENEWALAPPLICATION AND APPROVAL.—Not 15
454	454	later than the date on which the 3-year period referred 16
455	455	to in subsection (d) ends, a State seeking to renew the 17
456	456	approval of the State sports wagering program may sub-18
457	457	mit to the Attorney General a renewal application that— 19
458	458	(1) includes the information described in sub-20
459	459	section (a); and 21
460	460	(2) shall be subject to the approval process 22
461	461	under subsection (b). 23

463	463	EVOCATION ANDREVIEW.— 24
