118118 (B) 1 or more States with a State sports 20
119119 wagering program and 1 or more Indian Tribes; 21

231231 wagering’’ means the acceptance of a sports wager 9
232232 by a sports wagering operator. 10

235235 ‘‘sports wagering operator’’ means— 12
236236 (A) a licensed gaming facility that offers 13
237237 sports wagering; and 14
238238 (B) an interactive sports wagering plat-15

241241 PORTS WAGERING OPT -IN STATE.—The 17
242242 term ‘‘sports wagering opt-in State’’ means a State 18
243243 that administers a State sports wagering program. 19

247247 (B) the District of Columbia; and 22
248248 (C) any commonwealth, territory, or pos-23

254254 ‘‘State regulatory entity’’ means the governmental 2
255255 entity— 3
256256 (A) established or designated by a sports 4
257257 wagering opt-in State under section 5
258258 102(a)(2)(A)(ii); and 6
259259 (B) responsible, solely or in coordination 7
260260 with 1 or more other governmental entities, for 8
261261 the regulation of sports wagering in the applica-9
262262 ble sports wagering opt-in State. 10

264264 TATE SOCIAL GAMBLING LAW .—The term 11
265265 ‘‘State social gambling law’’ means a State law that 12
266266 allows sports wagering that— 13
267267 (A) is not conducted as a business; 14
268268 (B) involves 2 or more players who com-15
269269 pete on equal terms; and 16
270270 (C) does not provide a benefit to— 17
271271 (i) a player, other than the winnings 18
272272 of the player; or 19
273273 (ii) a person who is not involved in a 20
274274 sports wager. 21

276276 TATE SPORTS WAGERING PROGRAM .— 22
277277 The term ‘‘State sports wagering program’’ means a 23
278278 program administered and overseen by a State pur-24

288288 or has reason to know, as determined by a director, 6
289289 officer, employee, or agent of the sports wagering 7
290290 operator is or would be if completed— 8
291291 (A) a violation of, or part of a plan to vio-9
292292 late or evade, any Federal, State, or local law 10
293293 (including regulations); or 11
294294 (B) sports wagering by or on behalf of an 12
295295 individual described in subparagraph (C), (D), 13
296296 or (E) of section 103(b)(4). 14

298298 USPICIOUS TRANSACTION REPORT .—The 15
299299 term ‘‘suspicious transaction report’’ means a report 16
300300 submitted to a State regulatory entity or a sports 17
301301 organization under section 103(b)(13). 18

303303 RIBAL-STATE COMPACT .—The term 19
304304 ‘‘Tribal-State compact’’ means a compact entered 20
305305 into between a State and an Indian Tribe pursuant 21
306306 to section 11(d)(3) of the Indian Gaming Regulatory 22

316316 NGENERAL.—Except as provided in subsection 5
317317 (b), it shall be unlawful for any person to knowingly accept 6
318318 a sports wager. 7

320320 XCEPTIONS.—It shall not be a violation of sub-8
321321 section (a) for— 9
322322 (1) a sports wagering operator located in a 10
323323 sports wagering opt-in State to accept a sports 11
324324 wager in accordance with State law; or 12
325325 (2) a person to accept a sports wager in accord-13
326326 ance with an applicable State social gambling law. 14

330330 N GENERAL.—If the Attorney General be-16
331331 lieves a person has violated, is violating, or will vio-17
332332 late subsection (a), the Attorney General may bring 18
333333 a civil action in the appropriate district court of the 19
334334 United States or the appropriate United States 20
335335 court of a territory or possession of the United 21
336336 States, which shall have jurisdiction in proceedings 22
337337 in accordance with the Federal Rules of Civil Proce-23
338338 dure to enjoin a violation of subsection (a). 24

342342 (2) JURY TRIAL.—In the case of an alleged vio-1
343343 lation of an injunction or restraining order issued 2
344344 under paragraph (1), trial shall be, on demand of 3
345345 the accused, by a jury in accordance with the Fed-4
346346 eral Rules of Civil Procedure. 5

350350 N GENERAL.—Any person who violates 7
351351 subsection (a) shall be, with respect to any such vio-8
352352 lation, subject to a civil penalty of not more than the 9
353353 greater of $10,000 or 3 times the amount of the ap-10
354354 plicable sports wager. 11

356356 EPARATE VIOLATIONS.—A separate viola-12
357357 tion occurs for each sports wager accepted in viola-13
358358 tion of subsection (a). 14

360360 URISDICTION.—The district courts of the 15
361361 United States and appropriate United States courts 16
362362 of the territories and possessions of the United 17
363363 States shall have jurisdiction to enforce this sub-18
364364 section in accordance with section 1355 of title 28, 19
365365 United States Code. 20

367367 FFECT OF LAW.—A violation of subsection 21
368368 (a) shall not constitute a crime, and a judgment for 22
369369 the United States and imposition of a civil penalty 23
370370 pursuant to paragraph (1) shall not give rise to any 24

379379 ENALTY.—A civil penalty, injunction, or temporary re-4
380380 straining order imposed under this section shall be inde-5
381381 pendent of, and not in lieu of, criminal prosecutions or 6
382382 any other proceedings under any other law of the United 7
383383 States, including sections 1084 and 1955 of title 18, 8
384384 United States Code. 9

386386 FFECTIVEDATE.—Subsection (a) shall take ef-10
387387 fect on the date that is 18 months after the date of enact-11
388388 ment of this Act. 12
389389 SEC. 102. STATE SPORTS WAGERING PROGRAM. 13
390390 (a) I
391391 NITIALAPPLICATION.— 14
392392 (1) I
393393 N GENERAL.—To request approval to ad-15
394394 minister a State sports wagering program, a State 16
395395 shall submit an application to the Attorney General 17
396396 at such time, in such manner, and accompanied by 18
397397 such information as the Attorney General may re-19
398398 quire. 20
399399 (2) C
400400 ONTENTS.—An application under para-21
401401 graph (1) shall include— 22
402402 (A) a full and complete description of the 23
403403 State sports wagering program the State pro-24

409409 (i) each applicable State law relating 3
410410 to sports wagering; and 4
411411 (ii) an identification of the State regu-5
412412 latory entity; and 6
413413 (B) an assurance from the attorney gen-7
414414 eral or chief legal officer of the State that the 8
415415 laws of the State provide adequate authority to 9
416416 carry out the proposed State sports wagering 10
417417 program. 11
418418 (b) A
419419 PPROVAL BYATTORNEYGENERAL.— 12
420420 (1) I
421421 N GENERAL.—Not later than 180 days 13
422422 after the date on which the Attorney General re-14
423423 ceives a complete application under this section, the 15
424424 Attorney General shall approve the application un-16
425425 less the Attorney General determines that the pro-17
426426 posed State sports wagering program does not meet 18
427427 the standards set forth in section 103. 19
428428 (2) D
429429 ENIAL OF APPLICATION .—A decision of 20
430430 the Attorney General to deny an application sub-21
431431 mitted under this section shall— 22
432432 (A) be made in writing; and 23

440440 OTICE OFMATERIALCHANGES.—In the case of 4
441441 a material change to a State law relating to sports wager-5
442442 ing, the State regulatory entity, or other information in-6
443443 cluded in an application submitted pursuant to subsection 7
444444 (a) or (e), not later than 30 days after the date on which 8
445445 the change is made, the State shall submit to the Attorney 9
446446 General a notice of such change. 10
447447 (d) D
448448 URATION.—A State sports wagering program 11
449449 shall be valid for a fixed 3-year period beginning on the 12
450450 date on which the Attorney General approves the applica-13
451451 tion of the applicable State under subsection (a) or (e). 14
452452 (e) R
453453 ENEWALAPPLICATION AND APPROVAL.—Not 15
454454 later than the date on which the 3-year period referred 16
455455 to in subsection (d) ends, a State seeking to renew the 17
456456 approval of the State sports wagering program may sub-18
457457 mit to the Attorney General a renewal application that— 19
458458 (1) includes the information described in sub-20
459459 section (a); and 21
460460 (2) shall be subject to the approval process 22
461461 under subsection (b). 23

468468 The Attorney General shall promulgate regulations 2
469469 that provide procedures by which the Attorney Gen-3
470470 eral may revoke the approval of a State to admin-4
471471 ister a State sports wagering program before the 5
472472 date on which the 3-year term described in sub-6
473473 section (d) expires if the Attorney General finds that 7
474474 the sports wagering program does not meet 1 or 8
475475 more standards set forth in section 103. 9

477477 DMINISTRATIVE REVIEW .—The Attorney 10
478478 General shall promulgate regulations that provide 11
479479 procedures by which a State may seek administra-12
480480 tive review of any decision by the Attorney Gen-13
481481 eral— 14
482482 (A) to deny an application under sub-15
483483 section (b); 16
484484 (B) to deny a renewal application under 17
485485 subsection (e); or 18
