17	17	tives of the United States of America in Congress assembled, 2
18	18	SECTION 1. SHORT TITLE. 3
19	19	This Act may be cited as the ‘‘Southwestern Power 4
20	20	Administration Fund Establishment Act’’. 5
21	21	SEC. 2. DEFINITIONS. 6
22	22	In this Act: 7
23	23	(1) A
24	24	DMINISTRATOR.—The term ‘‘Adminis-8
25	25	trator’’ means the Administrator of the South-9
26	26	western Power Administration. 10

31	31	Southwestern Power Administration Fund estab-2
32	32	lished by section 3(a). 3

34	34	ECRETARY.—The term ‘‘Secretary’’ means 4
35	35	the Secretary of Energy. 5
36	36	SEC. 3. SOUTHWESTERN POWER ADMINISTRATION FUND. 6

38	38	STABLISHMENT OF FUND.—There is estab-7
39	39	lished in the Treasury of the United States a fund, to be 8
40	40	known as the ‘‘Southwestern Power Administration 9
41	41	Fund’’, consisting of— 10
42	42	(1) all receipts, collections, and recoveries of the 11
43	43	Southwestern Power Administration, including trust 12
44	44	funds; 13
45	45	(2) appropriations to the Fund; 14
46	46	(3) amounts transferred to the Fund under 15
47	47	subsection (b); and 16
48	48	(4) amounts deposited in the Fund under the 17
49	49	first proviso in the matter under the heading ‘‘O

65	65	pursuant to the 11th paragraph under the heading 4

67	67	Act of October 12, 1949 (16 U.S.C. 825s–1); 6
68	68	(2) unexpended balances in the advanced pay-7
69	69	ment fund pursuant to the first proviso in the mat-8
70	70	ter under the heading ‘‘O
71	71	PERATION AND MAINTE-9
72	72	NANCE, SOUTHWESTERN POWERADMINISTRATION’’ 10

95	95	VAILABILITY.—Amounts in the Fund shall re-3
96	96	main available until expended. 4
97	97	(d) U
98	98	SE.—Amounts in the Fund shall be used by the 5
99	99	Secretary, acting through the Administrator, for expenses 6
100	100	necessary for— 7
101	101	(1) operation and maintenance of power trans-8
102	102	mission facilities; 9
103	103	(2) marketing electric power and energy; 10
104	104	(3) construction and acquisition of transmission 11
105	105	lines, substations, and appurtenant facilities; and 12
106	106	(4) administrative expenses in carrying out the 13
107	107	duties of the Secretary under— 14
108	108	(A) section 5 of the Act of December 22, 15
109	109	1944 (commonly known as the ‘‘Flood Control 16
110	110	Act of 1944’’) (16 U.S.C. 825s); and 17
111	111	(B) section 1232 of the Energy Policy Act 18
112	112	of 2005 (42 U.S.C. 16431). 19

114	114	BLIGATIONS.—The Secretary, acting through 20
115	115	the Administrator, may incur obligations for authorized 21
116	116	purposes in advance of appropriations to be liquidated by 22
117	117	the Fund. 23

119	119	XCESSFUNDS.—Annually, the Secretary, acting 24
120	120	through the Administrator, shall transfer excess amounts 25

127	127	PPLICABLELAW.—The provisions of chapter 91 3
128	128	of title 31, United States Code, shall apply to the Adminis-4
129	129	trator in carrying out this section in the same manner as 5
130	130	the provisions apply to a wholly owned Government cor-6
131	131	poration (as defined in section 9101 of that title). 7
