18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Aviation Funding Sta-4
22	22	bility Act of 2025’’. 5

26	26	SEC. 2. FUNDING FOR THE FEDERAL AVIATION ADMINIS-1
27	27	TRATION IN THE EVENT OF A LAPSE IN AP-2
28	28	PROPRIATION. 3
29	29	(a) I
30	30	NGENERAL.—If, with respect to the Federal 4
31	31	Aviation Administration, an appropriation measure for a 5
32	32	fiscal year is not enacted before the beginning of such fis-6
33	33	cal year or a joint resolution making continuing appropria-7
34	34	tions is not in effect, amounts in the Airport and Airway 8
35	35	Trust Fund not otherwise appropriated shall be available 9
36	36	to the Administrator of the Federal Aviation Administra-10
37	37	tion for continuing programs, projects, or activities (in-11
38	38	cluding the costs of direct loans and loan guarantees) that 12
39	39	were conducted with amounts made available for the Fed-13
40	40	eral Aviation Administration, including for the accounts 14
41	41	‘‘Federal Aviation Administration—Operations’’, ‘‘Federal 15
42	42	Aviation Administration—Facilities and Equipment’’, 16
43	43	‘‘Federal Aviation Administration—Research, Engineer-17
44	44	ing, and Development’’, and ‘‘Federal Aviation Adminis-18
45	45	tration—Grants-in-Aid for Airports’’ in the preceding fis-19
46	46	cal year— 20
47	47	(1) in the corresponding appropriation Act for 21
48	48	such preceding fiscal year; or 22
49	49	(2) if the corresponding appropriation bill for 23
50	50	such preceding fiscal year did not become law, then 24
51	51	in a joint resolution making continuing appropria-25
52	52	tions for such preceding fiscal year. 26

56	56	(b) RATE FOROPERATIONS.—Appropriations and 1
57	57	funds made available, and authority granted, for a pro-2
58	58	gram, project, or activity for any fiscal year pursuant to 3
59	59	this section shall be at a rate for operations not greater 4
60	60	than— 5
61	61	(1) the rate for operations provided for in the 6
62	62	regular appropriation Act providing for such pro-7
63	63	gram, project, or activity for the preceding fiscal 8
64	64	year; or 9
65	65	(2) in the absence of such an Act, the rate for 10
66	66	operations provided for such program, project, or ac-11
67	67	tivity pursuant to a joint resolution making con-12
68	68	tinuing appropriations for such preceding fiscal year. 13
69	69	(c) A
70	70	VAILABILITY.—Appropriations and funds made 14
71	71	available, and authority granted, for any fiscal year pursu-15
72	72	ant to this section for a program, project, or activity shall 16
73	73	be available for the period beginning with the first day 17
74	74	of a lapse in appropriations and ending with the date on 18
75	75	which the applicable regular appropriation bill for such fis-19
76	76	cal year becomes law (whether or not such law provides 20
77	77	for such program, project, or activity) or a joint resolution 21
78	78	making continuing appropriations becomes law, as the 22
79	79	case may be. 23

81	81	ERMS ANDCONDITIONS.—An appropriation or 24
82	82	funds made available, or authority granted, for a program, 25

86	86	project, or activity for any fiscal year pursuant to this sec-1
87	87	tion shall be subject to the terms and conditions imposed 2
88	88	with respect to the appropriation made or funds made 3
89	89	available for the preceding fiscal year, or authority grant-4
90	90	ed for such program, project, or activity under current 5
91	91	law. 6
92	92	(e) E
93	93	ND OFFISCALYEAR.—If this section is in effect 7
94	94	at the end of a fiscal year, funding levels shall continue 8
95	95	as provided in this section for the next fiscal year. 9
96	96	(f) E
97	97	XPENDITURES AND OBLIGATIONS.—Expendi-10
98	98	tures and obligations made for a program, project, or ac-11
99	99	tivity for any fiscal year pursuant to this section shall be 12
100	100	charged to the applicable appropriation, fund, or author-13
101	101	ization whenever a regular appropriation bill or a joint res-14
102	102	olution making continuing appropriations until the end of 15
103	103	a fiscal year providing for such program, project, or activ-16
104	104	ity for such period becomes law. 17
105	105	(g) E
106	106	XPENDITURE AUTHORITY.—Section 18
107	107	9502(d)(1)(A) of the Internal Revenue Code of 1986 is 19
108	108	amended by striking the semicolon at the end and insert-20
109	109	ing ‘‘or the Aviation Funding Stability Act of 2025;’’. 21
110	110	(h) T
111	111	ERMINATION.—This section shall not apply to 22
112	112	a program, project, or activity during any portion of a fis-23
113	113	cal year if any other provision of law (other than an au-24
114	114	thorization of appropriations)— 25

119	119	able, or grants authority for such program, project, 2
120	120	or activity to continue for such period; or 3
121	121	(2) specifically provides that no appropriation 4
122	122	shall be made, no funds shall be made available, or 5
123	123	no authority shall be granted for such program, 6
124	124	project, or activity to continue for such period. 7
