To amend the Indian Health Care Improvement Act to mod-
ify the notification requirement for emergency contract 
health services for certain beneficiaries, and for other 
purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Indian Health Service 4
Emergency Claims Parity Act’’. 5

SEC. 2. AUTHORIZATION FOR EMERGENCY CONTRACT 1
HEALTH SERVICES. 2
Section 406 of the Indian Health Care Improvement 3
Act (25 U.S.C. 1646) is amended— 4
(1) by striking ‘‘With respect to’’ and inserting 5
the following: 6
‘‘(b) E
LDERLY ORDISABLEDINDIANS.—With re-7
spect to’’; and 8
(2) by inserting before subsection (b) (as so 9
designated) the following: 10
‘‘(a) I
NGENERAL.—Except as provided in subsection 11
(b), with respect to an Indian receiving emergency medical 12
care or services from a non-Service provider or in a non- 13
Service facility under the authority of this Act, the time 14
limitation (as a condition of payment) for notifying the 15
Service of such treatment or admission shall be 15 days.’’. 16
