21	21	To amend the Clean Air Act to eliminate a waiver under
22	22	that Act, to eliminate an authorization for States to
23	23	use new motor vehicle emission and new motor vehicle
24	24	engine emissions standards identical to standards adopt-
25	25	ed in California, and for other purposes.
26	26	Be it enacted by the Senate and House of Representa-1
27	27	tives of the United States of America in Congress assembled, 2
28	28	SECTION 1. SHORT TITLE. 3
29	29	This Act may be cited as the ‘‘Stop California from 4
30	30	Advancing Regulatory Burden Act of 2025’’ or the ‘‘Stop 5
31	31	CARB Act of 2025’’. 6

35	35	SEC. 2. REPEAL OF WAIVERS OF STATE STANDARDS. 1
36	36	(a) I
37	37	NGENERAL.—Section 209 of the Clean Air Act 2
38	38	(42 U.S.C. 7543) is amended— 3
39	39	(1) by striking subsection (b); 4
40	40	(2) in subsection (c), by striking the last sen-5
41	41	tence; 6
42	42	(3) by redesignating subsections (c) and (d) as 7
43	43	subsections (b) and (c), respectively; and 8
44	44	(4) by striking subsection (e) and inserting the 9
45	45	following: 10
46	46	‘‘(d) P
47	47	ROHIBITION ON STATESTANDARDS FOR 11
48	48	N
49	49	ONROADENGINES ORVEHICLES.—No State or any po-12
50	50	litical subdivision thereof shall adopt or attempt to enforce 13
51	51	any standard or other requirement that directly or indi-14
52	52	rectly relates to the control of emissions from nonroad en-15
53	53	gines or nonroad vehicles, including the following new 16
54	54	nonroad engines or nonroad vehicles subject to regulation 17
55	55	under this Act: 18
56	56	‘‘(1) New engines that are used in construction 19
57	57	equipment, construction vehicles, farm equipment, or 20
58	58	farm vehicles. 21
59	59	‘‘(2) New locomotives or new engines used in lo-22
60	60	comotives.’’. 23
61	61	(b) E
62	62	FFECT.—Notwithstanding any other provision 24
63	63	of law, as of the date of enactment of this Act— 25

67	67	(1) no waiver issued under subsection (b) of 1
68	68	section 209 of the Clean Air Act (42 U.S.C. 7543) 2
69	69	(as in effect on the day before the date of enactment 3
70	70	of this Act) before the date of enactment of this Act 4
71	71	shall have any force or effect; and 5
72	72	(2) any application for a waiver under that sub-6
73	73	section (as in effect on the day before the date of 7
74	74	enactment of this Act) pending before the Adminis-8
75	75	trator of the Environmental Protection Agency on 9
76	76	the date of enactment of this Act shall be considered 10
77	77	denied. 11
78	78	(c) C
79	79	ONFORMINGAMENDMENTS.— 12
80	80	(1) Section 202(i)(2)(A) of the Clean Air Act 13
81	81	(42 U.S.C. 7521(i)(2)(A)) is amended, in the matter 14
82	82	preceding clause (i), in the first sentence, by striking 15
83	83	‘‘, taking into consideration the waiver provisions of 16
84	84	section 209(b)’’. 17
85	85	(2) Section 211 of the Clean Air Act (42 U.S.C. 18
86	86	7545) is amended— 19
87	87	(A) in subsection (c)(4)— 20
88	88	(i) in subparagraph (A), in the matter 21
89	89	preceding clause (i), by striking ‘‘or (C)’’; 22
90	90	(ii) by striking subparagraph (B); and 23
91	91	(iii) by redesignating subparagraph 24
92	92	(C) as subparagraph (B); 25

106	106	(iii) by redesignating subparagraph 11

108	108	(3) Section 241(2) of the Clean Air Act (42 13
109	109	U.S.C. 7581(2)) is amended, in the second sentence, 14
110	110	by striking ‘‘(or any CARB’’ and all that follows 15
111	111	through ‘‘section 243(e))’’. 16
112	112	(4) Section 242(b) of the Clean Air Act (42 17
113	113	U.S.C. 7582(b)) is amended by striking ‘‘except as 18
114	114	provided in section 244 with respect to administra-19
115	115	tion and enforcement, and’’ each place it appears. 20
116	116	(5) Section 243 of the Clean Air Act (42 U.S.C. 21
117	117	7583) is amended by striking subsections (e), (f), 22
118	118	and (g). 23
119	119	(6) Section 244 of the Clean Air Act (42 U.S.C. 24
120	120	7584) is repealed. 25
