2323 SECTION 1. SHORT TITLE. 3
2424 This Act may be cited as the ‘‘Preventing Illegal 4
2525 Weapons Trafficking Act of 2025’’. 5
2626 SEC. 2. DEFINITIONS. 6

3131 (1) the term ‘‘machinegun’’ has the meaning 1
3232 given the term in section 5845 of the Internal Rev-2
3333 enue Code of 1986; and 3
3434 (2) the term ‘‘machinegun conversion device’’ 4
3535 means any part designed and intended solely and ex-5
3636 clusively, or combination of parts designed and in-6
3737 tended, for use in converting a weapon into a ma-7
3838 chinegun. 8
3939 SEC. 3. PREVENTION AND INTERCEPTION STRATEGY. 9

4141 TRATEGY.— 10
4242 (1) I
4343 N GENERAL.—Not later than 120 days 11
4444 after the date of enactment of this Act, the Attorney 12
4545 General, the Secretary of Homeland Security, and 13
4646 the Secretary of the Treasury shall develop and im-14
4747 plement a strategy to prevent or intercept the impor-15
4848 tation or trafficking of machinegun conversion de-16
4949 vices. 17
5050 (2) C
5151 ONTENTS.—The strategy described in 18
5252 paragraph (1) shall include plans to optimize— 19
5353 (A) the capacity of Federal law enforce-20
5454 ment agencies to detect, intercept, and seize 21
5555 machinegun conversion devices; 22
5656 (B) the coordination between State and 23
5757 local law enforcement agencies and Federal law 24
5858 enforcement agencies, including the Bureau of 25

6363 Federal Bureau of Investigation, Homeland Se-2
6464 curity Investigations, and U.S. Customs and 3
6565 Border Protection, when machinegun conversion 4
6666 devices are seized at ports of entry; 5
6767 (C) efforts by the Bureau of Alcohol, To-6
6868 bacco, Firearms, and Explosives to collaborate 7
6969 with State and local law enforcement agencies 8
7070 to identify and trace machinegun conversion de-9
7171 vices used in crimes, including identifying the 10
7272 source of the device, whether from a foreign 11
7373 country or the United States; 12
7474 (D) training programs provided by Federal 13
7575 law enforcement agencies to aid State and local 14
7676 law enforcement agencies in identifying ma-15
7777 chinegun conversion devices; 16
7878 (E) the investigation and collection of data 17
7979 regarding the origins of machinegun conversion 18
8080 devices that are seized at ports of entry or re-19
8181 covered by law enforcement agencies in the 20
8282 United States in order to identify patterns and 21
8383 detect vulnerabilities; and 22
8484 (F) the capacity of Federal law enforce-23
8585 ment agencies, including the Bureau of Alcohol, 24
8686 Tobacco, Firearms, and Explosives, the Federal 25

9696 EPORTS.— 6
9797 (1) I
9898 NITIAL REPORT.—Not later than 120 days 7
9999 after the date of enactment of this Act, the Attorney 8
100100 General, the Secretary of Homeland Security, and 9
101101 the Secretary of the Treasury shall submit a report 10
102102 on the strategy developed and implemented under 11
103103 subsection (a), which shall include relevant statis-12
104104 tical information, to— 13
105105 (A) the Committee on the Judiciary of the 14
106106 Senate; 15
107107 (B) the Committee on Homeland Security 16
108108 and Governmental Affairs of the Senate; 17
109109 (C) the Committee on the Judiciary of the 18
110110 House of Representatives; and 19
111111 (D) the Committee on Homeland Security 20
112112 of the House of Representatives. 21

114114 ERIODIC UPDATES.—Not less frequently 22
115115 than once every 2 years, the Attorney General, the 23
116116 Secretary of Homeland Security, and the Secretary 24
117117 of the Treasury shall submit to the congressional 25

122122 the report submitted under that paragraph that de-2
123123 scribes progress made on the implementation of the 3
124124 strategy developed under subsection (a). 4
125125 SEC. 4. FORFEITURE OF PROCEEDS FROM MACHINEGUN 5
126126 VIOLATIONS. 6
127127 Section 5872 of the Internal Revenue Code of 1986 7
128128 is amended— 8
129129 (1) in subsection (a), by inserting ‘‘, and any 9
130130 proceeds derived from the illegal trafficking of a ma-10
131131 chinegun,’’ after ‘‘provisions of this chapter’’; and 11
132132 (2) by adding at the end the following: 12
133133 ‘‘(c) I
134134 LLEGALTRAFFICKING OF A MACHINEGUN.— 13
135135 For purposes of subsection (a), the term ‘illegal trafficking 14
136136 of a machinegun’ means the making, manufacture, impor-15
137137 tation, exportation, or transfer of a machinegun in viola-16
138138 tion of the provisions of this chapter or any regulations 17
139139 prescribed under this chapter.’’. 18
140140 SEC. 5. GUN TRAFFICKING REPORT. 19
141141 The Attorney General shall include information about 20
142142 machinegun conversion devices in the annual firearms 21
143143 trafficking report announced by the President on April 7, 22
144144 2021, including— 23
145145 (1) the number of crimes in which machinegun 24
146146 conversion devices are used; and 25
