16	16	Act of 1968 to enhance the Comprehensive Opioid Abuse
17	17	Grant Program, and for other purposes.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Opioid Overdose Data 4
22	22	Collection Enhancement Act’’. 5
23	23	SEC. 2. PURPOSE. 6
24	24	The purpose of this Act is to expand the adoption 7
25	25	and implementation of, and provide interoperability of, 8
26	26	data collection tools used to track fatal and nonfatal 9

31	31	istration in near real-time through a web-based, mobile- 2
32	32	friendly software platform. 3
33	33	SEC. 3. COMPREHENSIVE OPIOID ABUSE GRANT PROGRAM. 4
34	34	Section 3021 of title I of the Omnibus Crime Control 5
35	35	and Safe Streets Act of 1968 (34 U.S.C. 10701) is amend-6
36	36	ed— 7
37	37	(1) in subsection (a)(1)— 8
38	38	(A) in subparagraph (G), by striking ‘‘; 9
39	39	and’’ at the end; 10
40	40	(B) in subparagraph (H), by striking the 11
41	41	period at the end and inserting ‘‘; and’’; and 12
42	42	(C) by adding at the end the following: 13
43	43	‘‘(I) an overdose data collection program 14
44	44	described in subsection (g)(1).’’; and 15
45	45	(2) by adding at the end the following: 16

47	47	VERDOSEDATACOLLECTIONPROGRAM.— 17
48	48	‘‘(1) I
49	49	N GENERAL.—An overdose data collection 18
50	50	program described in this paragraph is a program 19
51	51	under which a State, unit of local government, coali-20
52	52	tion of law enforcement agencies, or Indian tribe de-21
53	53	velops and implements a data collection tool, includ-22
54	54	ing mobile data mapping applications, with which 23
55	55	the State, unit of local government, coalition of law 24

59	59	enforcement agencies, or Indian tribe can easily and 1
60	60	quickly track the locations of— 2
61	61	‘‘(A) suspected fatal and nonfatal 3
62	62	overdoses; and 4
63	63	‘‘(B) the administration of opioid overdose 5
64	64	reversal medication by first responders, includ-6
65	65	ing law enforcement officers, firefighters, and 7
66	66	emergency medical service technicians. 8
67	67	‘‘(2) E
68	68	LIGIBILITY OF COALITIONS.— 9
69	69	‘‘(A) I
70	70	N GENERAL.—Notwithstanding sub-10
71	71	section (a)(1), a coalition of law enforcement 11
72	72	agencies shall be eligible to receive a grant 12
73	73	under subsection (a) only for the purpose of im-13
74	74	plementing an overdose data collection program 14
75	75	described in paragraph (1) of this subsection. 15
76	76	‘‘(B) R
77	77	EQUIREMENTS.—A coalition of law 16
78	78	enforcement agencies seeking a grant under 17
79	79	subsection (a) to implement an overdose data 18
80	80	collection program described in paragraph (1) 19
81	81	of this subsection shall be subject to the same 20
82	82	requirements and authorizations to which a 21
83	83	States, units of local government, and Indian 22
84	84	tribes are subject under this section, including 23
85	85	the requirement to submit an application under 24
86	86	section 3022. 25

90	90	‘‘(3) REQUIREMENTS.—A State, unit of local 1
91	91	government, coalition of law enforcement agencies, 2
92	92	or Indian tribe implementing an overdose data col-3
93	93	lection program described in paragraph (1) shall— 4
94	94	‘‘(A) support the development of coordi-5
95	95	nated public safety, behavioral health, and pub-6
96	96	lic health responses to the data collected by the 7
97	97	tool described in paragraph (1); 8
98	98	‘‘(B) focus on areas in which fatal and 9
99	99	nonfatal overdoses occur and trends of concern; 10
100	100	‘‘(C) provide for interoperability with exist-11
101	101	ing Federal, State, local, and Tribal overdose 12
102	102	data collection tools and overdose data collec-13
103	103	tion tools of coalitions of law enforcement agen-14
104	104	cies; and 15
105	105	‘‘(D) make data collected through the pro-16
106	106	gram available to Federal, State, Tribal, and 17
107	107	territorial governments and coalitions of law en-18
108	108	forcement agencies. 19
109	109	‘‘(4) A
110	110	UDIT; APPLICATION.—A State, unit of 20
111	111	local government, coalition of law enforcement agen-21
112	112	cies, or Indian tribe seeking to use a grant received 22
113	113	under subsection (a) for a program described in 23
114	114	paragraph (1) of this subsection shall— 24

118	118	‘‘(A) conduct an audit of available data 1
119	119	and resources; and 2
120	120	‘‘(B) in order to avoid duplication, submit 3
121	121	the audit conducted under subparagraph (A) as 4
122	122	a part of the application for the grant of the 5
123	123	State, unit of local government, coalition of law 6
124	124	enforcement agencies, or Indian tribe. 7
125	125	‘‘(5) C
126	126	ONSULTATION.—In carrying out this sub-8
127	127	section, the Attorney General shall consult with the 9
128	128	heads of agencies that maintain overdose data collec-10
129	129	tion tools, including the Director of the Office of Na-11
130	130	tional Drug Control Policy.’’. 12
