16	16	of certain licenses.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘States Handling Ac-4
21	21	cess to Reciprocity for Employment Act of 2025’’ or the 5
22	22	‘‘SHARE Act of 2025’’. 6

28	28	Subtitle E of title VI of the Intelligence Reform and 3
29	29	Terrorism Prevention Act of 2004 (34 U.S.C. 41106 et 4
30	30	seq.) is amended by adding at the end the following: 5
31	31	‘‘SEC. 6404. SHARING AND USE OF CRIMINAL HISTORY 6
32	32	RECORD INFORMATION. 7
33	33	‘‘(a) D
34	34	EFINITIONS.—In this section: 8
35	35	‘‘(1) C
36	36	OMMISSION.—The term ‘Commission’ 9
37	37	means a joint governmental entity, including an 10
38	38	interstate compact commission, established by legis-11
39	39	lative enactment of an interstate compact. 12
40	40	‘‘(2) C
41	41	RIMINAL HISTORY RECORD INFORMA -13
42	42	TION.—The term ‘criminal history record informa-14
43	43	tion’— 15
44	44	‘‘(A) means information collected by crimi-16
45	45	nal justice agencies on individuals consisting of 17
46	46	identifiable descriptions and notations of ar-18
47	47	rests, detentions, indictments, information, or 19
48	48	other formal criminal charges, and any disposi-20
49	49	tion arising therefrom, including acquittal, sen-21
50	50	tencing, correctional supervision, and release; 22
51	51	and 23
52	52	‘‘(B) does not include identification infor-24
53	53	mation, such as fingerprint records, if such in-25

58	58	volvement with the criminal justice system. 2
59	59	‘‘(3) L
60	60	ICENSE.—The term ‘license’ means a li-3
61	61	cense, multistate license, certification, or other au-4
62	62	thorization by which a State licensing authority au-5
63	63	thorizes an individual to practice an occupation or 6
64	64	profession in that State. 7
65	65	‘‘(4) P
66	66	RIVILEGE.—The term ‘privilege’ means a 8
67	67	grant of authority issued pursuant to an interstate 9
68	68	compact to a license holder that permits the license 10
69	69	holder to practice in a compact member State. 11
70	70	‘‘(5) S
71	71	TATE.—The term ‘State’ means any 12
72	72	State, territory, or possession of the United States, 13
73	73	and the District of Columbia. 14
74	74	‘‘(6) S
75	75	TATE IDENTIFICATION BUREAU .—The 15
76	76	term ‘State identification bureau’ has the meaning 16
77	77	given such term in section 6402(c). 17
78	78	‘‘(7) S
79	79	TATE LICENSING AUTHORITY .—The term 18
80	80	‘State licensing authority’ means a State licensing 19
81	81	board, agency, department, or other entity that is 20
82	82	empowered under the law of that State to grant a 21
83	83	license to practice an occupation or profession. 22

88	88	ECORDINFORMATION.—Subject to the restrictions in 25

93	93	vestigation shall furnish or otherwise make available to a 2
94	94	State licensing authority, through an agreement with a 3
95	95	State law enforcement agency or State identification bu-4
96	96	reau, criminal history record information to the extent re-5
97	97	quired by an interstate compact, or the regulations duly 6
98	98	promulgated thereunder, for the purpose of conducting a 7
99	99	criminal history background check of any individual seek-8
100	100	ing a license or privilege to practice an occupation or pro-9
101	101	fession in a compact member State. 10

106	106	ROHIBITION.—A State licensing author-13
107	107	ity that is a member of an interstate compact that 14
108	108	requires completion of a criminal history background 15
109	109	check for an individual for the purpose of acting 16
110	110	upon a license or privilege of that individual to prac-17
111	111	tice an occupation or profession in a State shall use 18
112	112	such information solely for that purpose and may 19
113	113	not share criminal history record information or any 20
114	114	part thereof with the compact’s Commission, any 21
115	115	other State entity or State Licensing Authority, or 22
116	116	the public. 23

124	124	compact Commission of the completion of the crimi-2
125	125	nal history background check, including a binary de-3
126	126	termination of whether or not the criminal history 4
127	127	background check of an applicant was satisfactory, 5
128	128	is expressly permitted under this section and shall 6
129	129	not constitute the sharing of criminal history record 7
130	130	information under paragraph (1).’’. 8
