150150 (1) be administered as a single unit of the Na-20
151151 tional Park System in accordance with— 21

171171 N GENERAL.—Not later than 3 years after 12
172172 the date of enactment of this Act, the Secretary, in 13
173173 consultation with the Advisory Council, shall develop 14
174174 a general management plan for the preservation and 15
175175 use of the Ocmulgee Mounds National Park and 16
176176 Preserve in accordance with section 100502 of title 17
177177 54, United States Code. 18
178178 (2) C
179179 ULTURAL RESOURCES AND LAND -19
180180 SCAPES.—The general management plan developed 20
181181 under paragraph (1) shall provide for— 21
182182 (A) the interpretation and preservation of 22
183183 cultural resources of the Ocmulgee Mounds Na-23
184184 tional Park and Preserve, including burial 24

192192 served, managed, developed, and maintained be-5
193193 cause of the cultural, natural, and public use 6
194194 significance of the cultural landscapes, includ-7
195195 ing to the Tribe. 8

197197 UNTING ANDFISHING.— 9

199199 UNTING.—The Secretary shall allow hunt-10
200200 ing on land under the jurisdiction of the Secretary 11
201201 within the boundaries of the Ocmulgee Mounds Na-12
202202 tional Preserve in accordance with applicable Fed-13
203203 eral and State laws. 14

205205 ISHING.—The Secretary shall allow fishing 15
206206 on waters under the jurisdiction of the Secretary 16
207207 within the boundaries of the Ocmulgee Mounds Na-17
208208 tional Park and Preserve in accordance with applica-18
209209 ble Federal and State laws. 19

211211 IMITATION.—The Secretary may designate 20
212212 zones in which, and establish periods during which, 21
213213 no hunting, fishing, or both, shall be allowed for rea-22
214214 sons of public safety, administration, fish or wildlife 23
215215 management, or emergencies. 24

219219 (4) CONSULTATION.—The Secretary shall en-1
220220 sure any regulations prescribing such restrictions 2
221221 under this subsection shall be put into effect only 3
222222 after consultation with the State. 4

224224 RIVATE LAND.—Nothing in this subsection 5
225225 prohibits hunting, fishing, or trapping on private 6
226226 land in accordance with applicable State and Federal 7
227227 laws. 8

229229 ONGRESSIONAL INTENT .—Nothing in this 9
230230 Act is intended to affect the jurisdiction or respon-10
231231 sibilities of the State with respect to fish and wild-11
232232 life. 12
233233 (d) H
234234 IRINGPREFERENCE.—The Secretary shall es-13
235235 tablish policies to provide a preference for hiring members 14
236236 of the Tribe for positions at the Ocmulgee Mounds Na-15
237237 tional Park and Preserve, consistent with the Indian pref-16
238238 erence policy established by the Secretary of the Interior 17
239239 under section 12 of the Act of June 18, 1934 (commonly 18
240240 known as the ‘‘Indian Reorganization Act’’) (48 Stat. 986, 19
241241 chapter 576; 25 U.S.C. 5116). 20

262262 rector of the United States Fish and Wildlife Serv-9

266266 prevents continued consultation with federally recognized 12
267267 Indian Tribes pursuant to Executive Order 13175 (25 13
268268 U.S.C. 5301 note; relating to consultation and coordina-14
269269 tion with Indian Tribal governments). 15

271271 ILITARYOVERFLIGHTS.—Nothing in this Act 16
272272 precludes— 17
273273 (1) low-level overflights of military aircraft over 18
274274 the Ocmulgee Mounds National Park and Preserve; 19
275275 (2) the designation of new units of special use 20
276276 airspace over the Ocmulgee Mounds National Park 21
277277 and Preserve; or 22
278278 (3) the use or establishment of military flight 23
279279 training routes over the Ocmulgee Mounds National 24
280280 Park and Preserve. 25

284284 (h) SACRED ANDCULTURALSITES.—The Secretary 1
285285 shall ensure the protection of sacred sites and cultural 2
286286 sites within the Ocmulgee Mounds National Park and Pre-3
287287 serve and provide access to the sites by members of Indian 4
288288 Tribes who have ancestral connections to the Ocmulgee 5
289289 River Corridor, in accordance with Public Law 95–341 6
290290 (commonly known as the ‘‘American Indian Religious 7
291291 Freedom Act’’) (42 U.S.C. 1996 et seq.) and Executive 8
292292 Order 13007 (42 U.S.C. 1996 note; relating to Indian sa-9
293293 cred sites). 10
294294 SEC. 5. ADVISORY COUNCIL. 11
295295 (a) E
296296 STABLISHMENT.—The Secretary shall establish 12
297297 an advisory council, to be known as the ‘‘Ocmulgee 13
298298 Mounds National Park and Preserve Advisory Council’’. 14
299299 (b) D
300300 UTIES.—The Advisory Council shall— 15
301301 (1) advise the Secretary with respect to the de-16
302302 velopment and implementation of the management 17
303303 plan for the Ocmulgee Mounds National Park and 18
304304 Preserve; and 19
305305 (2) not later than 3 years after the date of en-20
306306 actment of this Act, submit to the Secretary rec-21
307307 ommendations regarding how the Secretary would 22
308308 consider and accommodate Tribal interests in the 23
309309 management of the Ocmulgee Mounds National 24
310310 Park and Preserve, including recommendations re-25

320320 EMBERS.—The Advisory Council shall consist of 6
321321 7 members, to be appointed by the Secretary, as follows: 7
322322 (1) 1 member, who shall be a representative of 8
323323 the applicable National Park Service office. 9
324324 (2) 1 member, who shall be a representative of 10
325325 the applicable United States Fish and Wildlife Serv-11
326326 ice office. 12
327327 (3) 3 members, who shall be representatives of 13
328328 the Tribe. 14
329329 (4) 1 member, who shall be a representative of 15
330330 the State Department of Natural Resources. 16
331331 (5) 1 member, who shall be appointed after con-17
332332 sidering recommendations from the Middle Georgia 18
333333 Regional Commission. 19
334334 (d) A
335335 PPLICABLELAW.—The Advisory Council shall 20
336336 be subject to chapter 10 of title 5, United States Code 21
337337 (commonly referred to as the ‘‘Federal Advisory Com-22
338338 mittee Act’’) (other than section 1013 of that title), and 23
339339 other applicable laws. 24

343343 (e) VACANCY.—A vacancy on the Advisory Council 1
344344 shall be filled in the same manner as the original appoint-2
345345 ment. 3

347347 UORUM.—A majority of the members of the Ad-4
348348 visory Council (including not fewer than 1 member who 5
349349 is a designated representative of the Tribe) shall con-6
350350 stitute a quorum. 7
351351 (g) F
352352 REQUENCY OF MEETINGS.—The Advisory 8
353353 Council shall meet 2 times per year, or more often as the 9
354354 Chairperson of the Advisory Council determines to be ap-10
355355 propriate. 11
356356 (h) C
357357 HAIRPERSON.—The Advisory Council shall— 12
358358 (1) elect a chairperson of the Advisory Council 13
359359 from among the members of the Advisory Council; 14
360360 and 15
361361 (2) establish any rules and procedures for the 16
362362 Advisory Council that the Advisory Council deter-17
363363 mines to be appropriate. 18
364364 (i) N
365365 OCOMPENSATION.—Members of the Advisory 19
366366 Council shall serve without compensation. 20
367367 SEC. 6. LAND TO BE HELD IN TRUST. 21
368368 All right, title, and interest of the United States in 22
369369 and to the approximately 126 acres of land owned in fee 23
370370 by the Tribe are hereby taken into trust for the benefit 24
371371 of the Tribe. Such land— 25

382382 SEC. 7. AUTHORIZATION OF APPROPRIATIONS. 8
383383 There are authorized to be appropriated such sums 9
384384 as are necessary to carry out this Act. 10
