A BILL
To amend title 18, United States Code, to establish a crimi-
nal penalty for unauthorized access to Department of
Defense facilities.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Guarding and Admin-4
istering Trespass Enforcement, Controlling Restricted 5
Areas, and Stopping High-risk Encroachment Recidivism 6
and Sabotage Act’’ or the ‘‘GATE CRASHERS Act’’. 7

SEC. 2. UNAUTHORIZED ACCESS TO DEPARTMENT OF DE-1
FENSE FACILITIES. 2
(a) I
NGENERAL.—Chapter 67 of title 18, United 3
States Code, is amended by adding at the end the fol-4
lowing: 5
‘‘§ 1390. Unauthorized access to Department of De-6
fense facilities 7
‘‘(a) I
NGENERAL.—It shall be unlawful, within the 8
jurisdiction of the United States, without authorization to 9
go upon any property that— 10
‘‘(1) is under the jurisdiction of the Depart-11
ment of Defense; and 12
‘‘(2) has been clearly marked as closed or re-13
stricted. 14
‘‘(b) P
ENALTIES.—Any person who violates sub-15
section (a) shall— 16
‘‘(1) in the case of the first offense, be fined 17
under this title, imprisoned not more than 180 days, 18
or both; 19
‘‘(2) in the case of the second offense, be fined 20
under this title, imprisoned not more than 3 years, 21
or both; and 22
‘‘(3) in the case of the third or subsequent of-23
fense, be fined under this title, imprisoned not more 24
than 10 years, or both.’’. 25

(b) TABLE OFSECTIONSAMENDMENT.—The table of 1
sections for chapter 67 of title 18, United States Code, 2
is amended by adding at the end the following: 3
‘‘1390. Unauthorized access to Department of Defense facilities.’’.
