15	15	Be it enacted by the Senate and House of Representa-1
16	16	tives of the United States of America in Congress assembled, 2
17	17	SECTION 1. SHORT TITLE. 3
18	18	This Act may be cited as the ‘‘School Guardian Act 4
19	19	of 2025’’. 5
20	20	SEC. 2. SCHOOL GUARDIAN GRANTS. 6
21	21	Title I of the Omnibus Crime Control and Safe 7
22	22	Streets Act of 1968 (34 U.S.C. 10101 et seq.) is amended 8
23	23	by adding at the end the following: 9

28	28	‘‘SEC. 3061. GRANTS FOR LAW ENFORCEMENT OFFICERS AT 2

31	31	EFINITIONS.—In this section— 4
32	32	‘‘(1) the term ‘K–12 school’ means an elemen-5
33	33	tary school or secondary school, as such terms are 6
34	34	defined under section 8101 of the Elementary and 7
35	35	Secondary Education Act of 1965 (20 U.S.C. 7801); 8
36	36	and 9
37	37	‘‘(2) the term ‘local educational agency’ has the 10
38	38	meaning given such term under section 8101 of the 11
39	39	Elementary and Secondary Education Act of 1965 12
40	40	(20 U.S.C. 7801). 13
41	41	‘‘(b) G
42	42	RANTAUTHORIZATION.—Subject to the avail-14
43	43	ability of appropriations, the Attorney General shall make 15
44	44	a grant to each State that elects to receive a grant under 16
45	45	this section for the cost of assigning armed law enforce-17
46	46	ment officers to provide security at K–12 schools, which 18
47	47	may be used for the cost of pay, training, and equipment 19
48	48	for the law enforcement officers. 20
49	49	‘‘(c) A
50	50	MOUNT.—A grant under this section to a State 21
51	51	for a fiscal year shall be in an amount that bears the same 22
52	52	ratio to the total amount awarded under this section for 23
53	53	the fiscal year as the total number of individuals attending 24
54	54	a K–12 school in the State bears to the total number of 25
55	55	individuals attending a K–12 school in the United States. 26

59	59	‘‘(d) ADMINISTRATION OFGRANTS.—The use of, and 1
60	60	award of subgrants using, amounts received under this 2
61	61	section shall be administered by the head of the chief law 3
62	62	enforcement agency of a State. 4
63	63	‘‘(e) S
64	64	UBGRANTS.— 5
65	65	‘‘(1) I
66	66	N GENERAL.—The head of the chief law 6
67	67	enforcement agency of a State may award a 7
68	68	subgrant to a law enforcement agency of a unit of 8
69	69	local government in the State for the cost of hiring 9
70	70	1 or more full-time law enforcement officers who will 10
71	71	be assigned to provide full-time security at K–12 11
72	72	schools. 12
73	73	‘‘(2) A
74	74	GREEMENTS.— 13
75	75	‘‘(A) I
76	76	N GENERAL.—A law enforcement 14
77	77	agency of a unit of local government desiring a 15
78	78	subgrant under this subsection shall enter into 16
79	79	a written agreement with each K–12 school in 17
80	80	the jurisdiction of the agency, or with the local 18
81	81	educational agency that serves such K–12 19
82	82	school, which shall indicate the number of law 20
83	83	enforcement officers the law enforcement agen-21
84	84	cy will hire and assign to each such K–12 22
85	85	school if awarded a subgrant. 23
86	86	‘‘(B) O
87	87	FFICERS AT EACH SCHOOL .—The 24
88	88	written agreements entered into by a law en-25

92	92	forcement agency under subparagraph (A) shall 1
93	93	provide for the hiring of not less than 1 full- 2
94	94	time law enforcement officer who will be as-3
95	95	signed to provide full-time security at each K– 4
96	96	12 school in the jurisdiction of the law enforce-5
97	97	ment agency. 6
98	98	‘‘(3) A
99	99	MOUNT.—The amount of a subgrant 7
100	100	under this subsection to a law enforcement agency 8
101	101	of a unit of local government shall be based on the 9
102	102	number of law enforcement officers the law enforce-10
103	103	ment agency will hire, as indicated in the written 11
104	104	agreements described in paragraph (2). 12
105	105	‘‘(f) R
106	106	EPORTING.—Each State that receives a grant 13
107	107	under this section for a fiscal year shall submit to the At-14
108	108	torney General a report regarding the use of the grant 15
109	109	for that fiscal year, which shall include— 16
110	110	‘‘(1) the number of subgrants awarded; 17
111	111	‘‘(2) the amount of each subgrant awarded; 18
112	112	‘‘(3) the number of law enforcement officers 19
113	113	hired to provide security at a K–12 school using 20
114	114	amounts received under the grant; and 21
115	115	‘‘(4) the number of K–12 schools in the State 22
116	116	with 1 or more full-time law enforcement officers for 23
117	117	whom the cost of the pay, training, or equipment for 24

124	124	AILURETOUSEAMOUNTS.— 3
125	125	‘‘(1) R
126	126	ETURN.—A State shall return to the At-4
127	127	torney General any amounts received under a grant 5
128	128	under this section for a fiscal year which are unobli-6
129	129	gated as of the day after the last day of the fiscal 7
130	130	year. 8
131	131	‘‘(2) U
132	132	SE.—Amounts returned to the Attorney 9
133	133	General under paragraph (1) shall be merged with 10
134	134	other amounts available to carry out this section and 11
135	135	remain available until expended to the Attorney 12
136	136	General to make grants under this section, without 13
137	137	further appropriation. 14
138	138	‘‘(3) R
139	139	EPORTING.—The Attorney General shall 15
140	140	submit to Congress a report that provides, for each 16
141	141	fiscal year, the total amount of funds provided for 17
142	142	that fiscal year that are returned under paragraph 18
143	143	(1) and the amount of funds provided for that fiscal 19
144	144	year that are returned under paragraph (1) by each 20
145	145	State. 21

149	149	N GENERAL.—Effective on the date of en-23
150	150	actment of this Act, of the unobligated balances of 24
151	151	amounts made available to the Internal Revenue 25

155	155	Service under Public Law 117–169 (136 Stat. 1
156	156	1818), $80,000,000,000 shall be transferred, on a 2
157	157	pro rata basis, to the Attorney General to carry out 3
158	158	this section. 4
159	159	‘‘(2) A
160	160	VAILABILITY AND USE.—Amounts trans-5
161	161	ferred under paragraph (1) shall be merged with, 6
162	162	and subject to the same terms and conditions as, 7
163	163	other amounts available to carry out this section, 8
164	164	and shall remain available until expended. 9
165	165	‘‘(3) A
166	166	NNUAL AVAILABILITY OF AMOUNTS .— 10
167	167	From amounts transferred under paragraph (1), the 11
168	168	Attorney General may make not more than 12
169	169	$8,000,000,000 in grants under this section for each 13
170	170	of fiscal years 2025 through 2034.’’. 14
