15	15	foreign markets for goods using common names, and

17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘Safeguarding Amer-4
21	21	ican Food and Export Trade Yields Act of 2025’’ or the 5
22	22	‘‘SAFETY Act of 2025’’. 6

29	29	EFINITIONS.—Section 102 of the Agricultural 3
30	30	Trade Act of 1978 (7 U.S.C. 5602) is amended— 4
31	31	(1) in the matter preceding paragraph (1), by 5
32	32	striking ‘‘As used in this Act—’’ and inserting ‘‘In 6
33	33	this Act:’’; 7
34	34	(2) by redesignating paragraphs (2) through 8
35	35	(8) as paragraphs (3), (5), (6), (7), (8), (9), and 9
36	36	(4), respectively, and reordering accordingly; 10
37	37	(3) by inserting after paragraph (1) the fol-11
38	38	lowing: 12

44	44	‘‘(i) is ordinarily or customarily used 16

48	48	aging and product label of the agricultural 20
49	49	commodity or food product; 21
50	50	‘‘(iii) with respect to wine— 22
51	51	‘‘(I) is— 23
52	52	‘‘(aa) ordinarily or custom-24
53	53	arily used for a wine grape vari-25
54	54	etal name; or 26

194	194	‘‘(iii) the ordinary and customary use 23
195	195	of the common name in the production or 24
196	196	marketing of the agricultural commodity or 25

223	223	efforts with the United States Trade Representative to se-21
224	224	cure the right of United States agricultural producers, 22
225	225	processors, and exporters to use common names for agri-23
226	226	cultural commodities or food products in foreign markets 24
227	227	through the negotiation of bilateral, plurilateral, or multi-25

236	236	RIEFING.—The Secretary and the United 5
237	237	States Trade Representative shall jointly provide to the 6
238	238	Committee on Agriculture, Nutrition, and Forestry of the 7
239	239	Senate, the Committee on Finance of the Senate, the 8
240	240	Committee on Agriculture of the House of Representa-9
241	241	tives, and the Committee on Ways and Means of the 10
242	242	House of Representatives a semi-annual briefing on their 11
243	243	efforts and success in carrying out subsection (a).’’. 12
