1717 SECTION 1. SHORT TITLE. 3
1818 This Act may be cited as the ‘‘Stopping Harmful In-4
1919 cidents to Enforce Lawful Drone Use Act’’ or the 5
2020 ‘‘SHIELD U Act’’. 6

3939 OUNTER-UAS ACTIVITIES.—The term 9
4040 ‘‘Counter-UAS activities’’ means the following: 10
4141 (A) Detecting, identifying, monitoring, and 11
4242 tracking an unmanned aircraft or unmanned 12
4343 aircraft system, without prior consent, including 13
4444 by means of intercept or other access of a wire 14
4545 communication, an oral communication, or an 15
4646 electronic communication used to control the 16
4747 unmanned aircraft or unmanned aircraft sys-17
4848 tem. 18
4949 (B) Warning an operator of an unmanned 19
5050 aircraft or unmanned aircraft system, including 20
5151 by passive or active, and direct or indirect phys-21
5252 ical, electronic, radio, and electromagnetic 22

8080 ‘‘non-kinetic equipment’’ means equipment that is 20

8282 (A) intercept or otherwise access a wire 22
8383 communication, an oral communication, an elec-23
8484 tronic communication, or a radio communica-24

9999 HREATS POSED BY AN UNMANNED AIR -11
100100 CRAFT OR UNMANNED AIRCRAFT SYSTEM .—The 12
101101 term ‘‘threats posed by an unmanned aircraft or un-13
102102 manned aircraft system’’ means an unauthorized ac-14
103103 tivity of an unmanned aircraft or unmanned aircraft 15
104104 system that is reasonably believed to— 16
105105 (A) create the potential for bodily harm to, 17
106106 or loss of human life of, a person within prop-18
107107 erty under the jurisdiction of— 19
108108 (i) a commercial service airport; or 20
109109 (ii) a State or locality; or 21
110110 (B) have the potential to cause severe eco-22
111111 nomic damage to— 23
112112 (i) property of a commercial service 24
113113 airport; or 25

125125 SEC. 3. COUNTER-UAS ACTIVITIES ON COMMERCIAL SERV-8

128128 OUNTER-UAS ACTIVITIES.— 10

130130 N GENERAL.—Notwithstanding any other 11
131131 provision of law and subject to paragraph (3), with 12
132132 respect to a commercial service airport, the following 13
133133 departments and agencies may, in a manner con-14
134134 sistent with the Fourth Amendment to the Constitu-15
135135 tion of the United States, carry out Counter-UAS 16
136136 activities for purposes of detecting, identifying, and 17
137137 mitigating the threats posed by an unmanned air-18
138138 craft or unmanned aircraft system to the safety or 19
139139 security of the airport: 20
140140 (A) The Department of Homeland Secu-21
141141 rity. 22
142142 (B) The State and local law enforcement 23
143143 agencies in the State in which the airport is lo-24
144144 cated. 25

151151 ESTING AUTHORITY .—Subject to para-3
152152 graphs (3) and (4), the Secretary of Homeland Se-4
153153 curity, the heads of the State or local law enforce-5
154154 ment agencies of the State in which a commercial 6
155155 service airport is located, or the law enforcement 7
156156 agency of the commercial service airport, may re-8
157157 search, test, provide training on, and evaluate any 9
158158 equipment, including any electronic equipment, to 10
159159 determine the capability and utility of the equipment 11
160160 to carry out Counter-UAS activities to detect, iden-12
161161 tify, and mitigate the threats posed by an unmanned 13
162162 aircraft or unmanned aircraft system to the safety 14
163163 or security of the airport. 15

165165 IRPORT OPERATOR CONSENT REQUIRED .— 16
166166 Activities permitted under paragraph (1) or (2) shall 17
167167 only be carried out with the consent of, in consulta-18
168168 tion with, and with the participation of, the airport 19
169169 operator. 20

171171 ONSULTATION REQUIREMENT FOR TEST -21
172172 ING OF NON-KINETIC EQUIPMENT .—Any testing of 22
173173 non-kinetic equipment carried out under the author-23
174174 ity of this subsection shall be done in consultation 24
175175 with the Federal Communications Commission and 25

184184 N GENERAL.—Before adopting any stand-4
185185 ard operating procedures within a tactical response 5
186186 plan for use of non-kinetic equipment to carry out 6
187187 a Counter-UAS activity under the authority of this 7
188188 section, the Secretary of Homeland Security and the 8
189189 heads of the State, local, or airport law enforcement 9
190190 agencies of the State in which a commercial service 10
191191 airport is located, shall do the following: 11
192192 (A) Consult with the Federal Communica-12
193193 tions Commission and the National Tele-13
194194 communications and Information Administra-14
195195 tion about the use of non-kinetic equipment to 15
196196 carry out a Counter-UAS activity consistent 16
197197 with the tactical response plan updates required 17
198198 under subsection (c). 18
199199 (B) Jointly, with the Federal Communica-19
200200 tions Commission and the National Tele-20
201201 communications and Information Administra-21
202202 tion, create a process for an authorized des-22
203203 ignee of the commercial service airport to, con-23
204204 sistent with procedures outlined in the tactical 24
205205 response plan (as updated under subsection 25

213213 AND NTIA DUTIES .—The Federal 4
214214 Communications Commission and the National Tele-5
215215 communications and Information Administration 6
216216 shall— 7
217217 (A) not later than 30 days after the date 8
218218 of enactment of this Act, assign to an office of 9
219219 the Commission and to an office of the Admin-10
220220 istration, respectively, responsibility for car-11
221221 rying out the consultation regarding the use of 12
222222 non-kinetic equipment to carry out Counter- 13
223223 UAS activities required by paragraph (1)(A) 14
224224 and the consultation regarding the testing of 15
225225 non-kinetic equipment required by subsection 16
226226 (a)(4); and 17
227227 (B) not later than 180 days after the re-18
228228 sponsibility described in subparagraph (A) is 19
229229 assigned to each such office— 20
230230 (i) publicly designate an office of the 21
231231 Commission and an office of the Adminis-22
232232 tration, respectively, to receive the notifica-23
233233 tions from commercial service airports re-24
234234 quired under paragraph (1)(B); and 25

243243 ONDUPLICATION.—To the greatest extent 5
244244 practicable, the Federal Communications Commis-6
245245 sion and the National Telecommunications and In-7
246246 formation Administration shall coordinate with re-8
247247 spect to the consultations, process creation, follow- 9
248248 up consultations, and other requirements of this sub-10
249249 section and subsection (a)(4) so as to minimize du-11
250250 plication of requirements, efforts, and expenditures. 12

252252 ACTICALRESPONSEPLANUPDATES.— 13

254254 ASK FORCE.—Not later than 2 years after 14
255255 the date of enactment of this Act, the airport direc-15
256256 tor of each commercial service airport shall convene 16
257257 a task force for purposes of establishing or modi-17
258258 fying the emergency action preparedness plan for 18
259259 the airport to include a tactical response plan for the 19
260260 detection, identification, and mitigation of threats 20
261261 posed by an unmanned aircraft or unmanned air-21
262262 craft system. 22

264264 EQUIRED COORDINATION .—Each task 23
265265 force convened under paragraph (1) shall coordinate 24
266266 the establishing or modifying of the airport’s emer-25

287287 service area that covers the airport property or 18
288288 the navigable airspace necessary to ensure safe-19
289289 ty in the takeoff and landing of aircraft at such 20

292292 UTIES.—As part of the inclusion of a tac-22
293293 tical response plan in the emergency action pre-23
294294 paredness plan for a commercial service airport, 24

301301 levels posed by an unmanned aircraft or un-4
302302 manned aircraft system to the airport. 5
303303 (B) Create the standard operating proce-6
304304 dures for responding to each threat level de-7
305305 fined under subparagraph (A) that include a re-8
306306 quirement to minimize collateral damage. 9
307307 (C) Define and assign to each entity speci-10
308308 fied in paragraph (2), the role and responsibil-11
309309 ities of the entity in carrying out the standard 12
310310 operating procedures for responding to a speci-13
311311 fied threat posed by an unmanned aircraft or 14
312312 unmanned aircraft system to the airport. 15
313313 (D) Designate the applicable State and 16
314314 local law enforcement agencies, or the law en-17
315315 forcement agency of the airport, in coordination 18
316316 with the Department of Homeland Security, as 19
317317 the first responders to any specified threat 20
318318 posed by an unmanned aircraft or unmanned 21
319319 aircraft system to the airport. 22
320320 (E) Narrowly tailor the use of non-kinetic 23
321321 Counter-UAS equipment (if applicable under 24
322322 the standard operating procedures) to only tem-25

331331 responding to unauthorized unmanned aircraft 6
332332 system operations into 1 tactical response plan 7
333333 for addressing threats posed by an unmanned 8
334334 aircraft or unmanned aircraft system. 9

336336 ULE OF CONSTRUCTION .—Nothing in this 10
337337 subsection shall be construed to require multiple tac-11
338338 tical response plans or emergency action prepared-12
339339 ness plans for addressing the threats posed by an 13
340340 unmanned aircraft, an unmanned aircraft system, or 14
341341 unauthorized unmanned aircraft system operations. 15

343343 IRPORTIMPROVEMENT PROGRAM ELIGI-16
344344 BILITY.—Notwithstanding section 47102 of title 49, 17
345345 United States Code, the definition of the term ‘‘airport 18
346346 development’’ under that section shall include the pur-19
347347 chase of equipment necessary to carry out Counter-UAS 20
348348 activities at commercial service airports. 21
349349 (e) B
350350 ESTPRACTICES.— 22
351351 (1) I
352352 N GENERAL.—Not later than 1 year after 23
353353 the date of enactment of this Act, the Administrator 24
354354 of the Federal Aviation Administration and the Ad-25

362362 tices for use of Counter-UAS Activities at com-5
363363 mercial service airports; and 6
364364 (B) make such guidance available to the 7
365365 airport director for each commercial service air-8
366366 port in the United States. 9

368368 NNUAL UPDATES .—The guidance issued 10
369369 under this subsection shall be annually updated to 11
370370 incorporate the most recent results and conclusions 12
371371 regarding best practices for the use of Counter-UAS 13
372372 activities at commercial service airports. 14
373373 SEC. 4. COUNTER-UAS ACTIVITIES OFF COMMERCIAL SERV-15
374374 ICE AIRPORT PROPERTY. 16

376376 NGENERAL.—Notwithstanding any other provi-17
377377 sion of law, with respect to a State, the State and local 18
378378 law enforcement agencies in the State may, in a manner 19
379379 consistent with the Fourth Amendment to the Constitu-20
380380 tion of the United States, carry out Counter-UAS activi-21
381381 ties for purposes of detecting, identifying, and mitigating 22
382382 the threats posed by an unmanned aircraft or unmanned 23
383383 aircraft system within the jurisdiction of the State or lo-24
384384 cality. 25

399399 Counter-UAS activities to detect, identify, and 10
400400 mitigate the threats posed by an unmanned air-11
401401 craft or unmanned aircraft system within the 12
402402 jurisdiction of the State or locality. 13

404404 RIVATE SECTOR ENTITIES .—Subject 14
405405 to paragraphs (2) and (3), any private sector 15
406406 entity may establish testing areas for purposes 16
407407 of researching, testing, providing training on, 17
408408 and evaluating of any equipment, including any 18
409409 electronic equipment, to determine the capa-19
410410 bility and utility of the equipment to carry out 20
411411 Counter-UAS activities to detect, identify, and 21
412412 mitigate the threats posed by an unmanned air-22
413413 craft or unmanned aircraft system, so long as 23
414414 such activities are carried out in accordance 24
415415 with applicable State and local laws. 25

419419 (2) FAA COOPERATION.—The Federal Aviation 1
420420 Administration shall cooperate with any action by a 2
421421 State, a locality of a State, or a private sector entity 3
422422 to designate airspace to be used for testing under 4
423423 paragraph (1) unless the State, locality, or entity 5
424424 designates an area of airspace that would create a 6
425425 significant safety hazard to airport operations, air 7
426426 navigation facilities, air traffic control systems, or 8
427427 other components of the national airspace system 9
428428 that facilitate the safe and efficient operation of 10
429429 manned civil, commercial, or military aircraft within 11
430430 the United States. 12

432432 ONSULTATION REQUIREMENT FOR TEST -13
433433 ING OF NON-KINETIC EQUIPMENT .—Any testing of 14
434434 non-kinetic equipment carried out under the author-15
435435 ity of this subsection shall be done in consultation 16
436436 with the Federal Communications Commission and 17
437437 the National Telecommunications and Information 18
438438 Administration. 19

456456 local law enforcement agency will follow for use 7
457457 of such equipment. 8
458458 (B) Jointly, with the Federal Communica-9
459459 tions Commission and the National Tele-10
460460 communications and Information Administra-11
461461 tion create a process for an authorized designee 12
462462 of the State or local law enforcement agency to 13
463463 notify the Commission when non-kinetic equip-14
464464 ment has been used to carry out a Counter- 15
465465 UAS activity. 16
466466 (2) FCC
467467 AND NTIA DUTIES .—The Federal 17
468468 Communications Commission shall— 18
469469 (A) not later than 30 days after the date 19
470470 of enactment of this Act, assign to an office of 20
471471 the Commission and to an office of the Admin-21
472472 istration, respectively, responsibility for car-22
473473 rying out the consultation regarding the use of 23
474474 non-kinetic equipment to carry out Counter- 24

555555 local law enforcement agency notify UAS opera-20
556556 tors and manned operators in the area that an 21
557557 area of airspace is clear once the State and 22
558558 local law enforcement have concluded the 23
559559 Counter-UAS activities to mitigate the threat. 24
