A BILL
To amend the Infrastructure Investment and Jobs Act to
authorize the use of funds for certain additional Carey
Act projects, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. ELIGIBILITY UNDER THE INFRASTRUCTURE IN-3
VESTMENT AND JOBS ACT OF ADDITIONAL 4
CAREY ACT PROJECTS FOR CERTAIN FUNDS. 5
Section 40904(b) of the Infrastructure Investment 6
and Jobs Act (43 U.S.C. 3204(b)) is amended— 7

(1) in paragraph (3), by redesignating subpara-1
graphs (A) through (C) as clauses (i) through (iii), 2
respectively, and indenting appropriately; 3
(2) by redesignating paragraphs (1) through 4
(4) as subparagraphs (A) through (D), respectively, 5
and indenting appropriately; 6
(3) in the matter preceding subparagraph (A) 7
(as so redesignated), by striking ‘‘The Secretary’’ 8
and inserting the following: 9

N GENERAL.—On making the af-13
firmative determinations described in subpara-14
graph (B), the Secretary shall use amounts 15
made available under section 40901(2)(B) to 16
fund the rehabilitation, reconstruction, or re-17
placement of any dams that were developed 18
pursuant to, and continue to operate as dams 19
under, section 4 of the Act of August 18, 1894 20
(commonly known as the ‘Carey Act’) (43 21
U.S.C. 641; 28 Stat. 422, chapter 301). 22
‘‘(B) D
ETERMINATIONS DESCRIBED .—The 23
determinations referred to in subparagraph (A) 24
are— 25

‘‘(i) a determination by the Secretary 1
that any dams that meet the criteria de-2
scribed in paragraph (1) have received the 3
necessary funding to complete rehabilita-4
tion, reconstruction, or replacement activi-5
ties under this subsection; and 6
‘‘(ii) a determination by the Secretary 7
that amounts made available under section 8
40901(2)(B) remain available.’’. 9
