5959 States military record of service showing that the 22

7373 ‘‘(A) A certified birth certificate issued by 8
7474 a State, a unit of local government in a State, 9

104104 applicant’s name and that the applicant’s place 12
105105 of birth was in the United States. 13
106106 ‘‘(D) A Consular Report of Birth Abroad 14
107107 of a citizen of the United States or a certifi-15
108108 cation of the applicant’s Report of Birth of a 16
109109 United States citizen issued by the Secretary of 17
110110 State. 18
111111 ‘‘(E) A Naturalization Certificate or Cer-19
112112 tificate of Citizenship issued by the Secretary of 20
113113 Homeland Security or any other document or 21
114114 method of proof of United States citizenship 22

227227 form prescribed by the Election Assistance Commis-15
228228 sion pursuant to section 9(a)(2) or a form described 16
229229 in paragraph (1) or (2) of subsection (a) shall not 17
230230 be registered to vote in an election for Federal office 18
231231 unless— 19
232232 ‘‘(A) the applicant presents documentary 20
233233 proof of United States citizenship in person to 21
234234 the office of the appropriate election official not 22
235235 later than the deadline provided by State law 23
236236 for the receipt of a completed voter registration 24
237237 application for the election; or 25

245245 cluding early voting, is permitted for the elec-5
246246 tion, the applicant presents documentary proof 6
247247 of United States citizenship to the appropriate 7
248248 election official at the polling place not later 8
249249 than the date of the election. 9

251251 OTIFICATION OF REQUIREMENT .—Upon 10
252252 receiving an otherwise completed mail voter registra-11
253253 tion application form prescribed by the Election As-12
254254 sistance Commission pursuant to section 9(a)(2) or 13
255255 a form described in paragraph (1) or (2) of sub-14
256256 section (a), the appropriate election official shall 15
257257 transmit a notice to the applicant of the requirement 16
258258 to present documentary proof of United States citi-17
259259 zenship under this subsection, and shall include in 18
260260 the notice instructions to enable the applicant to 19
261261 meet the requirement. 20

263263 CCESSIBILITY.—Each State shall, in con-21
264264 sultation with the Election Assistance Commission, 22
265265 ensure that reasonable accommodations are made to 23
266266 allow an individual with a disability who submits the 24
267267 mail voter registration application form prescribed 25

367367 office, submit such other evidence to the 7
368368 appropriate State or local official dem-8
369369 onstrating that the applicant is a citizen of 9
370370 the United States and such official shall 10
371371 make a determination as to whether the 11
372372 applicant has sufficiently established 12
373373 United States citizenship for purposes of 13
374374 registering to vote in elections for Federal 14
375375 office in the State. 15

377377 FFIDAVIT REQUIREMENT .—If a 16
378378 State or local official makes a determina-17
379379 tion under clause (i) that an applicant has 18
380380 sufficiently established United States citi-19
381381 zenship for purposes of registering to vote 20
382382 in elections for Federal office in the State, 21
383383 such determination shall be accompanied 22
384384 by an affidavit developed under clause (iii) 23
385385 signed by the official swearing or affirming 24
386386 the applicant sufficiently established 25

394394 BY THE ELECTION ASSISTANCE COMMIS -4
395395 SION.—The Election Assistance Commis-5
396396 sion shall develop a uniform affidavit for 6
397397 use by State and local officials under 7
398398 clause (ii), which shall— 8
399399 ‘‘(I) include an explanation of the 9
400400 minimum standards required for a 10
401401 State or local official to register an 11
402402 applicant who cannot provide docu-12
403403 mentary proof of United States citi-13
404404 zenship to vote in elections for Fed-14
405405 eral office in the State; and 15
406406 ‘‘(II) require the official to ex-16
407407 plain the basis for registering such 17
408408 applicant to vote in such elections. 18
409409 ‘‘(B) P
410410 ROCESS IN CASE OF CERTAIN DIS -19
411411 CREPANCIES IN DOCUMENTATION .—Subject to 20
412412 any relevant guidance adopted by the Election 21
413413 Assistance Commission, each State shall estab-22
414414 lish a process under which an applicant can 23
415415 provide such additional documentation to the 24
416416 appropriate election official of the State as may 25

421421 a citizen of the United States in the event of a 2
422422 discrepancy with respect to the applicant’s doc-3
423423 umentary proof of United States citizenship. 4

425425 TATE REQUIREMENTS .—Each State shall 5
426426 take affirmative steps on an ongoing basis to ensure 6
427427 that only United States citizens are registered to 7
428428 vote under the provisions of this Act, which shall in-8
429429 clude the establishment of a program described in 9
430430 paragraph (4) not later than 30 days after the date 10
431431 of the enactment of this subsection. 11
432432 ‘‘(4) P
433433 ROGRAM DESCRIBED .—A State may meet 12
434434 the requirements of paragraph (3) by establishing a 13
435435 program under which the State identifies individuals 14
436436 who are not United States citizens using information 15
437437 supplied by one or more of the following sources: 16
438438 ‘‘(A) The Department of Homeland Secu-17
439439 rity through the Systematic Alien Verification 18
440440 for Entitlements (‘SAVE’) or otherwise. 19
441441 ‘‘(B) The Social Security Administration 20
442442 through the Social Security Number 21
443443 Verification Service, or otherwise. 22
444444 ‘‘(C) State agencies that supply State iden-23
445445 tification cards or driver’s licenses where the 24

457457 N GENERAL.—At the request of a 7
458458 State election official (including a request re-8
459459 lated to a process established by a State under 9
460460 paragraph (2)(A) or (2)(B)), any head of a 10
461461 Federal department or agency possessing infor-11
462462 mation relevant to determining the eligibility of 12
463463 an individual to vote in elections for Federal of-13
464464 fice shall, not later than 24 hours after receipt 14
465465 of such request, provide the official with such 15
