3232 NGENERAL.—Section 418(a)(3) of the Social 3
3333 Security Act (42 U.S.C. 618(a)(3)) is amended to read 4

4040 ‘‘(i) for fiscal year 2026, 9

192192 NDIAN TRIBE.—The term ‘Indian tribe’ 8
193193 means entities included on the list published pursu-9
194194 ant to section 104(a) of the Federally Recognized 10
195195 Indian Tribe List Act of 1994 (25 U.S.C. 5131(a)). 11

197197 TATE.—The term ‘State’ means each of 12
198198 the 50 States and the District of Columbia. 13

200200 ERRITORY.—The term ‘territory’ means 14

206206 RIBAL ORGANIZATION.—The term ‘tribal 19
207207 organization’ means— 20
208208 ‘‘(A) the recognized governing body of any 21
209209 Indian tribe, and any legally established organi-22
210210 zation of Indians which is controlled, sanc-23
211211 tioned, or chartered by such governing body or 24
212212 which is democratically elected by the adult 25

218218 maximum participation of Indians in all phases 3
219219 of its activities, except that in any case where 4
220220 a contract is let or grant made to an organiza-5
221221 tion to perform services benefitting more than 6
222222 one Indian tribe, the approval of each such In-7
223223 dian tribe shall be a prerequisite to the letting 8
224224 or making of such contract or grant; and 9
225225 ‘‘(B) includes a Native Hawaiian organiza-10
226226 tion, as defined in section 6207 of the Elemen-11
227227 tary and Secondary Education Act of 1965 (20 12
228228 U.S.C. 7517) and a private nonprofit organiza-13
229229 tion established for the purpose of serving 14
230230 youth who are Indians or Native Hawaiians.’’. 15

232232 FFECTIVEDATE.—The amendments made by 16
233233 this section take effect on October 1, 2025. 17
234234 SEC. 3. GRANTS TO IMPROVE CHILD CARE WORKFORCE, 18
235235 SUPPLY, QUALITY, AND ACCESS IN AREAS OF 19
236236 PARTICULAR NEED. 20

239239 Act (42 U.S.C. 618), as amended by section 2, is further 22

300300 nizations in amounts that shall be allotted 18
301301 among Indian tribes and tribal organizations in 19
302302 proportion to their respective needs. 20

319319 that paragraph, to make grants for the fiscal 7
320320 year under this subsection to each State in 8
321321 amounts that bear the same proportion to the 9
322322 amount so remaining as the sum of the amount 10
323323 granted under paragraph (1) of subsection (a) 11
324324 and the amount allotted and paid under para-12
325325 graph (2) of subsection (a) to each such State 13
326326 for the fiscal year (without regard to amounts 14
327327 redistributed under subparagraph (D) of sub-15
328328 section (a)(2) for the fiscal year) bears to the 16
329329 total amounts granted and allotted to all of the 17
330330 States under paragraphs (1) and (2) of that 18
331331 subsection for such fiscal year. 19

346346 scription of the planned use of grant funds 4

348348 ‘‘(i) describes the demographic and 6
349349 economic data and other criteria the lead 7
350350 agency proposes to use to determine 8
351351 whether an area is in particular need of 9
352352 child care; 10
353353 ‘‘(ii) describes how community mem-11
354354 bers were engaged to identify community- 12
355355 specific needs such as diverse types of care 13
356356 delivery, care for infant and toddlers, mul-14
357357 tilingual care, and nontraditional oper-15
358358 ational hours; 16
359359 ‘‘(iii) identifies specific areas deter-17
360360 mined to be in particular need of child 18
361361 care, where such areas are located, the size 19
362362 and scope of such areas, and the age 20
363363 groups of children in need of child care in 21
364364 such areas; 22
365365 ‘‘(iv) outlines how the lead agency 23
366366 proposes to use the grant funds to increase 24
367367 child care workforce, supply, quality, and 25

378378 grants to child care providers to pay 8
379379 for specified numbers of child care 9
380380 slots (including slots in family child 10
381381 care homes) and to build supply and 11
382382 stability by including expectations for 12
383383 compensation in the contracts and 13
384384 grants; 14
385385 ‘‘(II) establishing or expanding 15
386386 the operation of community or neigh-16
387387 borhood-based family child care net-17
388388 works by providing grants and con-18
389389 tracts for training and other activities 19
390390 that increase the supply and quality of 20
391391 family child care; 21
392392 ‘‘(III) furnishing child care pro-22
393393 viders with start-up funding, technical 23
394394 assistance, support for improving 24
395395 business practices, and support navi-25

409409 out the child care licensing process; 11
410410 ‘‘(VI) recruiting child care pro-12
411411 viders and staff; 13
412412 ‘‘(VII) supporting the training 14
413413 and professional development of the 15
414414 child care workforce including through 16
415415 apprenticeships, partnerships with 17
416416 labor unions or labor-management 18
417417 partnerships, and partnerships with 19
418418 public and nonprofit institutions of 20
419419 higher education to provide com-21
420420 prehensive scholarships that support 22
421421 equitable access to, and completion of, 23
422422 credentials and degrees in early child-24
423423 hood education; 25

429429 workforce by increasing total com-3
430430 pensation, providing wage supple-4
431431 ments or bonuses, or offering wage 5
432432 and retention rewards and ensuring 6
433433 adequate wages for staff of child care 7
434434 providers, including sole proprietors 8
435435 and independent contractors, that, at 9
436436 a minimum— 10
437437 ‘‘(aa) provide a living wage 11
438438 for all staff of such child care 12
439439 providers; and 13
440440 ‘‘(bb) are adjusted on an an-14
441441 nual basis for cost of living in-15
442442 creases to ensure payment rates 16
443443 remain sufficient to meet the re-17
444444 quirements of this subsection; 18
445445 ‘‘(IX) subject to subparagraph 19
446446 (C), providing financial support (with-20
447447 out regard to limitations on expendi-21
448448 tures imposed under section 658F(b) 22
449449 of the Child Care and Development 23
450450 Block Grant Act of 1990) for projects 24
451451 involving the purchase or improve-25

464464 predevelopment or soft costs, and for 10
465465 projects to upgrade child care facili-11
466466 ties to assure that providers meet 12
467467 State and local child care standards, 13
468468 including applicable health, safety, 14
469469 and quality requirements; or 15
470470 ‘‘(X) subject to subparagraph 16
471471 (C), contracting with an intermediary 17
472472 with experience securing private 18
473473 sources of capital financing for child 19
474474 care facilities or other low-income 20
475475 community development projects to 21
476476 provide financial or managerial assist-22
477477 ance, technical support through the 23
478478 real estate process, including success-24
479479 ful execution of Federal interest docu-25
