2323 SECTION 1. SHORT TITLE. 3
2424 This Act may be cited as the ‘‘Fallen Servicemembers 4
2525 Religious Heritage Restoration Act’’. 5
2626 SEC. 2. FINDINGS. 6
2727 Congress finds the following: 7

3131 (1) An estimated 900 American-Jewish 1
3232 servicemembers of the Armed Forces killed in World 2
3333 War I and World War II and buried overseas in 3
3434 United States military cemeteries were, for various 4
3535 reasons, mistakenly buried under Latin Crosses. In 5
3636 most instances, those mistakes were made inadvert-6
3737 ently. 7
3838 (2) In 2022, more than 2,000,000 people vis-8
3939 ited the United States World War I and World War 9
4040 II cemeteries in foreign countries. 10
4141 (3) American-Jewish servicemembers played a 11
4242 vital role in the Allied victories in World War I and 12
4343 World War II. 13
4444 (4) American-Jewish servicemembers who 14
4545 fought and died for the United States must have 15
4646 their heritage properly recognized and honored. 16
4747 (5) The United States Government has a sol-17
4848 emn responsibility to ensure that every American 18
4949 servicemember killed in action and buried overseas is 19
5050 properly honored. 20
5151 (6) The work of properly identifying American- 21
5252 Jewish servicemembers buried overseas is vital and 22
5353 integral to the responsibility of the American Battle 23
5454 Monuments Commission to ensure that past mis-24

6060 SEC. 3. FALLEN SERVICEMEMBERS RELIGIOUS HERITAGE 3
6161 RESTORATION PROGRAM. 4

6363 STABLISHMENT.—The American Battle Monu-5
6464 ments Commission shall establish a program to identify 6
6565 covered members and to contact survivors and descend-7
6666 ants of such covered members. Such program shall be 8
6767 known as the ‘‘Fallen Servicemembers Religious Heritage 9
6868 Restoration Program’’. 10

7070 URATION.—The Commission shall carry out the 11
7171 Fallen Servicemembers Religious Heritage Restoration 12
7272 Program during the first 10 fiscal years that begin after 13
7373 the date of the enactment of this Act. 14

7575 ONTRACTS.— 15
7676 (1) A
7777 UTHORITY.—During each fiscal year de-16
7878 scribed in subsection (b), the Commission shall seek 17
7979 to enter into a contract with a nonprofit organiza-18
8080 tion under which such nonprofit organization shall 19
8181 carry out the purpose described in subsection (a). 20
8282 (2) T
8383 ERM; AMOUNT.—Each contract under this 21
8484 subsection shall be for one year and in the amount 22
8585 of $500,000 to the nonprofit organization. 23

8787 RIORITY.—In awarding a contract under 24
8888 this subsection, the Commission shall give priority to 25

9292 a nonprofit organization that has demonstrated ca-1
9393 pability and expertise in carrying out the purpose 2
9494 described in subsection (a). 3

9696 UTHORIZATION OFAPPROPRIATIONS.—To carry 4
9797 out this section, there is authorized to be appropriated to 5
9898 the Commission $500,000 for each fiscal year described 6
9999 in subsection (b). 7

101101 EFINITIONS.—In this section: 8
102102 (1) The term ‘‘covered member’’ means a de-9
103103 ceased member of the Armed Forces who was Jew-10
104104 ish and buried— 11
105105 (A) in a United States military cemetery 12
106106 located outside the United States; and 13
107107 (B) under a marker that indicates such 14
108108 member was not Jewish. 15
109109 (2) The term ‘‘nonprofit organization’’ means 16
110110 an organization described in section 501(c)(3) of the 17
111111 Internal Revenue Code of 1986 and exempt from 18
112112 taxation under section 501(a) of such Code. 19
