| 18 | 18 | | SECTION 1. SHORT TITLE. 3 |
|---|
| 19 | 19 | | This Act may be cited as the ‘‘Aid Accountability Act 4 |
|---|
| 20 | 20 | | of 2025’’. 5 |

| 21 | 21 | | SEC. 2. PENALTIES FOR VIOLATING SECTION 104(F) OF THE 6 |

| 22 | 22 | | FOREIGN ASSISTANCE ACT OF 1961. 7 |

| 23 | 23 | | Section 104(f) of the Foreign Assistance Act of 1961 8 |
|---|
| 24 | 24 | | (22 U.S.C. 2151b(f)) is amended by adding at the end 9 |
|---|
| 25 | 25 | | the following: 10 |

| 29 | 29 | | ‘‘(4)(A) A Federal employee who knowingly violates 1 |
|---|
| 30 | 30 | | any requirement under this subsection— 2 |
|---|
| 31 | 31 | | ‘‘(i) shall be terminated from Federal employ-3 |
|---|
| 32 | 32 | | ment; 4 |
|---|
| 33 | 33 | | ‘‘(ii) may not be employed by the Federal Gov-5 |
|---|
| 34 | 34 | | ernment after such violation; and 6 |
|---|
| 35 | 35 | | ‘‘(iii) shall be fiscally liable for, and shall pay 7 |
|---|
| 36 | 36 | | to the Federal Government, an amount equal to the 8 |
|---|
| 37 | 37 | | amount of funds illegally allocated to the activity 9 |
|---|
| 38 | 38 | | that was in violation of such requirement in order to 10 |
|---|
| 39 | 39 | | provide restitution for such violation. 11 |
|---|
| 40 | 40 | | ‘‘(B) A grantee, subgrantee, contractor or other re-12 |
|---|
| 41 | 41 | | cipient of Federal funds who violates any of the require-13 |
|---|
| 42 | 42 | | ments under this subsection may not receive any Federal 14 |
|---|
| 43 | 43 | | funds after such violation. 15 |
|---|
| 44 | 44 | | ‘‘(C) The Secretary of State— 16 |
|---|
| 45 | 45 | | ‘‘(i) shall make a final determination with re-17 |
|---|
| 46 | 46 | | spect to any violation of a requirement under this 18 |
|---|
| 47 | 47 | | subsection and the penalties to be imposed pursuant 19 |
|---|
| 48 | 48 | | to subparagraph (A) or (B), and such final deter-20 |
|---|
| 49 | 49 | | mination shall not be subject to review or reversal 21 |
|---|
| 50 | 50 | | except by a Federal court of competent jurisdiction; 22 |
|---|
| 51 | 51 | | and 23 |
|---|

|---|

|---|
| 60 | 60 | | ‘‘(II) who carried out or was involved in 6 |
|---|
| 61 | 61 | | the violation; and 7 |
|---|
| 62 | 62 | | ‘‘(III) what will be done to ensure such 8 |
|---|
| 63 | 63 | | violation is not repeated. 9 |
|---|
| 64 | 64 | | ‘‘(D) Each final determination by the Secretary of 10 |
|---|
| 65 | 65 | | State pursuant to subparagraph (C)(i) shall be subject to 11 |
|---|
| 66 | 66 | | the procedures set forth in chapter 8 of title 5, United 12 |
|---|
| 67 | 67 | | States Code (commonly referred to as the ‘Congressional 13 |
|---|
