1616 Be it enacted by the Senate and House of Representa-1
1717 tives of the United States of America in Congress assembled, 2
1818 SECTION 1. SHORT TITLE. 3
1919 This Act may be cited as the ‘‘Aid Accountability Act 4
2020 of 2025’’. 5
2121 SEC. 2. PENALTIES FOR VIOLATING SECTION 104(F) OF THE 6
2222 FOREIGN ASSISTANCE ACT OF 1961. 7
2323 Section 104(f) of the Foreign Assistance Act of 1961 8
2424 (22 U.S.C. 2151b(f)) is amended by adding at the end 9
2525 the following: 10

2929 ‘‘(4)(A) A Federal employee who knowingly violates 1
3030 any requirement under this subsection— 2
3131 ‘‘(i) shall be terminated from Federal employ-3
3232 ment; 4
3333 ‘‘(ii) may not be employed by the Federal Gov-5
3434 ernment after such violation; and 6
3535 ‘‘(iii) shall be fiscally liable for, and shall pay 7
3636 to the Federal Government, an amount equal to the 8
3737 amount of funds illegally allocated to the activity 9
3838 that was in violation of such requirement in order to 10
3939 provide restitution for such violation. 11
4040 ‘‘(B) A grantee, subgrantee, contractor or other re-12
4141 cipient of Federal funds who violates any of the require-13
4242 ments under this subsection may not receive any Federal 14
4343 funds after such violation. 15
4444 ‘‘(C) The Secretary of State— 16
4545 ‘‘(i) shall make a final determination with re-17
4646 spect to any violation of a requirement under this 18
4747 subsection and the penalties to be imposed pursuant 19
4848 to subparagraph (A) or (B), and such final deter-20
4949 mination shall not be subject to review or reversal 21
5050 except by a Federal court of competent jurisdiction; 22

5555 ‘‘(ii) not later than 60 days after making a de-1
5656 termination pursuant to clause (i), shall submit a re-2
5757 port to Congress that includes— 3
5858 ‘‘(I) a description of the nature of the vio-4
5959 lation; 5
6060 ‘‘(II) who carried out or was involved in 6
6161 the violation; and 7
6262 ‘‘(III) what will be done to ensure such 8
6363 violation is not repeated. 9
6464 ‘‘(D) Each final determination by the Secretary of 10
6565 State pursuant to subparagraph (C)(i) shall be subject to 11
6666 the procedures set forth in chapter 8 of title 5, United 12
6767 States Code (commonly referred to as the ‘Congressional 13
6868 Review Act’).’’. 14
