8181 TATEMENT OFPOLICY.—It is the policy of the 17
8282 United States to prioritize collaboration with friendly 18
8383 countries, and through appropriate international institu-19
8484 tions, to combat illegal, unreported, or unregulated fish-20
8585 ing. 21

8787 CTIONS BYSECRETARY OFSTATE.—The Sec-22
8888 retary of State shall take such actions as may be necessary 23
8989 to use the voice, vote, and influence of the United States 24

9595 (1) to ensure that cutting edge technology is de-3
9696 ployed in accordance to existing or future maritime 4
9797 law enforcement agreements the United States may 5
9898 enter or has entered into; and 6
9999 (2) to hold accountable those individuals or en-7
100100 tities that are responsible or complicit in illegal, un-8
101101 reported, or unregulated fishing, with a particular 9
102102 focus on the harmful actions of the People’s Repub-10
103103 lic of China. 11

105105 DVOCACY ATUNITEDNATIONS.—The President 12
106106 may direct the United States Permanent Representative 13
107107 to the United Nations to use the voice, vote, and influence 14
108108 of the United States to urge the United Nations to take 15
109109 greater action with respect to collaborative global efforts 16
110110 to counter illegal, unreported, or unregulated fishing. 17
111111 SEC. 4. AUTHORIZATION OF IMPOSITION OF SANCTIONS 18
112112 WITH RESPECT TO ILLEGAL, UNREPORTED, 19
113113 OR UNREGULATED FISHING AND TRADE IN 20
114114 ENDANGERED SPECIES. 21
115115 (a) I
116116 NGENERAL.—The President may impose the 22
117117 sanctions described in subsection (b) with respect to any 23
118118 foreign person or foreign vessel (regardless of ownership) 24
119119 that the President determines— 25

124124 (A) illegal, unreported, or unregulated fish-2
125125 ing; or 3
126126 (B) except as part of a conservation effort, 4
127127 the sale, supply, purchase, or transfer (includ-5
128128 ing transportation) of endangered species, as 6
129129 defined in section 3(6) of the Endangered Spe-7
130130 cies Act of 1973 (16 U.S.C. 1532(6)); 8
131131 (2) is a leader or official of an entity, including 9
132132 a government entity, that has engaged in, or the 10
133133 members of which have engaged in, any of the ac-11
134134 tivities described in paragraph (1) during the tenure 12
135135 of the leader or official; 13
136136 (3) has ever owned, operated, chartered, or con-14
137137 trolled a vessel during which time the personnel of 15
138138 the vessel engaged in any of the activities described 16
139139 in paragraph (1); or 17
140140 (4) has materially assisted, sponsored, or pro-18
141141 vided financial, material, or technological support 19
142142 for, or goods or services in support of— 20
143143 (A) any of the activities described in para-21
144144 graph (1); or 22
145145 (B) any foreign person engaged in any 23
146146 such activity. 24

150150 (b) SANCTIONSDESCRIBED.—The sanctions that 1
151151 may be imposed under subsection (a) with respect to a 2
152152 foreign person or foreign vessel are the following: 3

154154 LOCKING OF PROPERTY .—Notwith-4
155155 standing section 202 of the International Emergency 5
156156 Economic Powers Act (50 U.S.C. 1701), the exercise 6
157157 of all powers granted to the President by the Inter-7
158158 national Emergency Economic Powers Act (50 8
159159 U.S.C. 1701 et seq.) to the extent necessary to block 9
160160 and prohibit all transactions in all property and in-10
161161 terests in property of a foreign person described in 11
162162 subsection (a), if such property and interests in 12
163163 property are in the United States, come within the 13
164164 United States, or are or come within the possession 14
165165 or control of a United States person. 15

167167 NADMISSIBILITY TO THE UNITED 16
168168 STATES.—In the case of an alien described in sub-17
169169 section (a), or any alien that the President deter-18
170170 mines is a corporate officer or principal of, or a 19
171171 shareholder with a controlling interest in, a foreign 20
172172 person described in subsection (a) that is an enti-21
173173 ty— 22
174174 (A) ineligibility for a visa and inadmis-23
175175 sibility to the United States; and 24

185185 STATES.—In the case of a foreign vessel described in 6

190190 INSTITUTIONS.—The President may prohibit any 10
191191 United States financial institution from making 11
192192 loans or providing credits to a foreign person de-12
193193 scribed in subsection (a). 13

195195 OREIGN EXCHANGE .—The President may, 14
196196 pursuant to such regulations as the President may 15
197197 prescribe, prohibit any transactions in foreign ex-16
198198 change that are subject to the jurisdiction of the 17
199199 United States and in which a foreign person or for-18
200200 eign vessel described in subsection (a) has any inter-19
201201 est. 20

203203 EPORTREQUIRED.—Not later than 1 year after 21
204204 the date of the enactment of this Act, and annually there-22
205205 after, the President shall submit a report on the imposi-23
206206 tion of sanctions under this section to— 24

217217 ATIONALINTERESTWAIVER.—The President 7
218218 may waive the imposition of sanctions under subsection 8
219219 (a) with respect to a foreign person or foreign vessel if 9
220220 the President determines that such a waiver is in the na-10
221221 tional interests of the United States. 11

223223 XCEPTIONS.— 12

225225 XCEPTIONS FOR AUTHORIZED INTEL -13
226226 LIGENCE AND LAW ENFORCEMENT ACTIVITIES .— 14
227227 Sanctions under this section shall not apply with re-15
228228 spect to activities subject to the reporting require-16
229229 ments under title V of the National Security Act of 17
230230 1947 (50 U.S.C. 3091 et seq.) or any authorized in-18
231231 telligence, law enforcement, or national security ac-19
232232 tivities of the United States. 20

234234 XCEPTION TO COMPLY WITH INTER -21
235235 NATIONAL AGREEMENTS .—Sanctions under sub-22
236236 section (b)(2) shall not apply with respect to the ad-23
237237 mission of an alien to the United States if such ad-24
238238 mission is necessary to comply with the obligations 25

244244 Lake Success on June 26, 1947, and entered into 3
245245 force on November 21, 1947, between the United 4
246246 Nations and the United States, or the Convention on 5
247247 Consular Relations, done at Vienna on April 24, 6
248248 1963, and entered into force on March 19, 1967, or 7
249249 other international obligations. 8

251251 XCEPTION FOR SAFETY OF VESSELS AND 9
252252 CREW.—Sanctions under this section shall not apply 10
253253 with respect to a person providing provisions to a 11
254254 vessel if such provisions are intended for the safety 12
255255 and care of the crew aboard the vessel or the main-13
256256 tenance of the vessel to avoid any environmental or 14
257257 other significant damage. 15

259259 UMANITARIAN EXCEPTION .— 16
260260 (A) I
261261 N GENERAL.—Except as provided in 17
262262 subparagraph (B), the President may not im-18
263263 pose sanctions under this section with respect 19
264264 to any person for conducting or facilitating a 20
265265 transaction for the sale of agricultural commod-21
266266 ities, food, medicine, or medical devices or for 22
267267 the provision of humanitarian assistance. 23

270270 subparagraph (A) does not include transactions 25

280280 MPLEMENTATION.—The President may ex-5
281281 ercise all authorities provided under sections 203 6
282282 and 205 of the International Emergency Economic 7
283283 Powers Act (50 U.S.C. 1702 and 1704) to carry out 8
284284 this section. 9

286286 ENALTIES.—A person that violates, at-10
287287 tempts to violate, conspires to violate, or causes a 11
288288 violation of this section or any regulation, license, or 12
289289 order issued to carry out this section shall be subject 13
290290 to the penalties set forth in subsections (b) and (c) 14
291291 of section 206 of the International Emergency Eco-15
292292 nomic Powers Act (50 U.S.C. 1705) to the same ex-16
293293 tent as a person that commits an unlawful act de-17
294294 scribed in subsection (a) of that section. 18

299299 agency responsible for the implementation of this 21
300300 section may promulgate such rules and regulations 22
301301 as may be necessary to carry out the provisions of 23

315315 SEC. 5. BRIEFING AND REPORT ON GLOBAL ILLEGAL, UN-8
316316 REPORTED, OR UNREGULATED FISHING. 9

318318 RIEFING.—Not later than 90 days after the date 10
319319 of the enactment of this Act, the Secretary of State, in 11
320320 consultation with the Secretary of Defense, shall brief the 12
321321 appropriate congressional committees on— 13
322322 (1) efforts to work with United States partners 14
323323 and allies to counter illegal, unreported, or unregu-15
324324 lated fishing via bilateral engagements; 16
325325 (2) efforts to counter, and challenges faced in 17
326326 countering, illegal, unreported, or unregulated fish-18
327327 ing through existing international agreements, insti-19
328328 tutions, and mechanisms; and 20
329329 (3) efforts by the Department of State and the 21
330330 Department of Defense to engage and collaborate 22
331331 with nongovernmental organizations and State and 23
332332 local agencies to spread awareness and coordinate 24

341341 N GENERAL.—Not later than 1 year after 4
342342 the date of the enactment of this Act, and annually 5
343343 thereafter for 4 years, the Secretary of State, in con-6
344344 sultation with the Secretary of Defense, shall submit 7
345345 to the appropriate congressional committees a report 8
346346 that includes— 9
347347 (A) recommendations to bolster maritime 10
348348 law enforcement agreements with United States 11
349349 allies and partners; 12
350350 (B) an assessment of the global illegal, un-13
351351 reported, or unregulated fishing patterns, stra-14
352352 tegic goals, and regional priorities of the Peo-15
353353 ple’s Republic of China, and government and 16
354354 non-government resourcing vectors of the Peo-17
355355 ple’s Republic of China for illegal, unreported, 18
356356 or unregulated fishing fleets; and 19
357357 (C) an assessment of the efficacy of global 20
358358 forums to respond to illegal, unreported, or un-21
359359 regulated fishing, and a strategy for United 22
360360 States engagement in such forums. 23
