23	23	To amend title 41, United States Code, to prohibit the Fed-
24	24	eral Government from entering into contracts with an
25	25	entity that discriminates against firearm or ammunition
26	26	industries, and for other purposes.
27	27	Be it enacted by the Senate and House of Representa-1
28	28	tives of the United States of America in Congress assembled, 2
29	29	SECTION 1. SHORT TITLE. 3
30	30	This Act may be cited as the ‘‘Firearm Industry Non- 4
31	31	Discrimination Act’’ or the ‘‘FIND Act’’. 5

36	36	WITH ENTITIES DISCRIMINATING AGAINST 2
37	37	FIREARM OR AMMUNITION INDUSTRIES. 3

39	39	ROHIBITION.—Chapter 47 of title 41, United 4
40	40	States Code, is amended by adding at the end the fol-5
41	41	lowing: 6
42	42	‘‘§ 4715. Prohibition on entering into contracts with 7
43	43	entities discriminating against firearm or 8
44	44	ammunition industries. 9
45	45	‘‘(a) P
46	46	ROHIBITION.— 10
47	47	‘‘(1) I
48	48	N GENERAL.—The head of an executive 11
49	49	agency shall include in each contract for the pro-12
50	50	curement of goods or services awarded by the execu-13
51	51	tive agency, a clause requiring the prime contractor 14
52	52	to certify that the contractor— 15
53	53	‘‘(A) has no policy, practice, guidance, or 16
54	54	directive that discriminates against a firearm 17
55	55	entity or firearm trade association; and 18
56	56	‘‘(B) will not adopt a policy, practice, guid-19
57	57	ance, or directive that discriminates against a 20
58	58	firearm entity or firearm trade association dur-21
59	59	ing the term of the contract. 22
60	60	‘‘(2) S
61	61	UBCONTRACTS.—The head of an execu-23
62	62	tive agency shall include in each contract for the 24
63	63	procurement of goods or services awarded by the ex-25

67	67	ecutive agency, a clause that prohibits the prime 1
68	68	contractor on such contract from— 2
69	69	‘‘(A) awarding a first-tier subcontract with 3
70	70	a value greater than 10 percent of the total 4
71	71	value of the prime contract to an entity that 5
72	72	fails to certify in writing to the prime con-6
73	73	tractor that the entity— 7
74	74	‘‘(i) has no policy, practice, guidance, 8
75	75	or directive that discriminates against a 9
76	76	firearm entity or firearm trade association; 10
77	77	and 11
78	78	‘‘(ii) will not adopt a policy, practice, 12
79	79	guidance, or directive that discriminates 13
80	80	against a firearm entity or firearm trade 14
81	81	association during the term of the con-15
82	82	tract; and 16
83	83	‘‘(B) structuring subcontract tiers in a 17
84	84	manner designed to avoid violating subpara-18
85	85	graph (A) by enabling a subcontractor to per-19
86	86	form more than 10 percent of the total value of 20
87	87	the prime contract as a lower-tier subcon-21
88	88	tractor. 22
89	89	‘‘(3) P
90	90	ENALTIES.—The clause included in con-23
91	91	tracts pursuant to paragraph (1) or paragraph (2) 24

95	95	shall provide that, in the event that the prime con-1
96	96	tractor violates the clause— 2
97	97	‘‘(A) the prime contract shall be termi-3
98	98	nated for default; and 4
99	99	‘‘(B) a suspension or debarment pro-5
100	100	ceeding will be initiated for the contractor on 6
101	101	the basis of the violation. 7
102	102	‘‘(b) E
103	103	XCEPTION.—Subsection (a) shall not apply to 8
104	104	a contract for the procurement of goods or services that 9
105	105	is a sole-source contract. 10
106	106	‘‘(c) D
107	107	EFINITIONS.—In this section: 11
108	108	‘‘(1) D
109	109	ISCRIMINATE.—The term ‘discriminate’ 12
110	110	means to— 13
111	111	‘‘(A) make a judgement about a policy, 14
112	112	practice, guidance, or directive on the basis 15
113	113	of— 16
114	114	‘‘(i) partial criteria or a category- 17
115	115	based assessment analysis, rather than— 18
116	116	‘‘(I) on a case-by-case basis; or 19
117	117	‘‘(II) using empirical data evalu-20
118	118	ated under quantifiable standards; or 21
119	119	‘‘(ii) criteria other than criteria free 22
120	120	from— 23
121	121	‘‘(I) favoritism or prejudice 24
122	122	against or dislike for the firearm enti-25

127	127	or services sold by the firearm entity 2
128	128	or trade association; or 3
129	129	‘‘(II) favoritism for market alter-4
130	130	natives to the business of the firearm 5
131	131	entity or the trade association; 6
132	132	‘‘(B) refuse to provide services, or deny, 7
133	133	cancel, or limit services, to the firearm entity or 8
134	134	trade association on the basis of criteria other 9
135	135	than— 10
136	136	‘‘(i) criteria free from— 11
137	137	‘‘(I) favoritism or prejudice 12
138	138	against or dislike for the firearm enti-13
139	139	ty or trade association or the products 14
140	140	or services sold by the firearm entity 15
141	141	or trade association; or 16
142	142	‘‘(II) favoritism for market alter-17
143	143	natives to the business of the firearm 18
144	144	entity or the trade association; 19
145	145	‘‘(ii) criteria related to credit history 20
146	146	and financial risk specific to a customer or 21
147	147	potential customer; or 22
148	148	‘‘(iii) criteria related to noncompliance 23
149	149	with Federal, State, or local law; or 24

154	154	tity or trade association in manner not required 2
155	155	by— 3
156	156	‘‘(i) Federal, State, or local law; or 4
157	157	‘‘(ii) Federal, State, or local regula-5
158	158	tion. 6

160	160	IREARM ENTITY.—The term ‘firearm en-7
161	161	tity’ means any— 8
162	162	‘‘(A) person who is licensed under section 9
163	163	923 of title 18 to import, manufacture, or deal 10
164	164	in firearms; 11
165	165	‘‘(B) seller of ammunition, as defined in 12
166	166	section 7903 of title 15; 13
167	167	‘‘(C) manufacturer or importer of, or deal-14
168	168	er in, a secure gun storage or safety device, as 15
169	169	defined in section 921(a) of title 18; and 16
170	170	‘‘(D) manufacturer or importer of, or deal-17
171	171	er in, a component part or accessory of a fire-18
172	172	arm or ammunition. 19

174	174	IREARM TRADE ASSOCIATION .—The term 20
175	175	‘firearm trade association’ has the meaning in sec-21
176	176	tion 7903 of title 15. 22
177	177	‘‘(4) F
178	178	IRST-TIER SUBCONTRACT .—The term 23
179	179	‘first-tier subcontract’ means a subcontract entered 24

184	184	for the purposes of carrying out the prime contract. 2

186	186	OWER-TIER SUBCONTRACTOR .—The term 3
187	187	‘lower-tier subcontractor’ means any person entering 4
188	188	into a contract with a subcontractor of a prime con-5
189	189	tractor for the purposes of carrying out the prime 6
190	190	contract. 7
191	191	‘‘(6) P
192	192	RIME CONTRACT; PRIME CONTRACTOR .— 8
193	193	The terms ‘prime contract’ and ‘prime contractor’ 9
194	194	have the meaning given those terms in section 8701 10
195	195	of title 41.’’. 11
196	196	(b) A
197	197	PPLICATION.—Section 4715 of title 41, United 12
198	198	States Code, as added by subsection (a), shall apply with 13
199	199	respect to contracts awarded on or after the date of the 14
200	200	enactment of this Act. 15

202	202	LERICALAMENDMENT.—The table of sections 16
203	203	for chapter 47 of title 41, United States Code, is amended 17
204	204	by adding at the end the following: 18
205	205	‘‘4715. Prohibition on entering into contracts with entities discriminating
206	206	against firearm or ammunition industries.’’.
