2929 SECTION 1. SHORT TITLE. 3
3030 This Act may be cited as the ‘‘Firearm Industry Non- 4
3131 Discrimination Act’’ or the ‘‘FIND Act’’. 5

3939 ROHIBITION.—Chapter 47 of title 41, United 4
4040 States Code, is amended by adding at the end the fol-5
4141 lowing: 6
4242 ‘‘§ 4715. Prohibition on entering into contracts with 7
4343 entities discriminating against firearm or 8
4444 ammunition industries. 9
4545 ‘‘(a) P
4646 ROHIBITION.— 10
4747 ‘‘(1) I
4848 N GENERAL.—The head of an executive 11
4949 agency shall include in each contract for the pro-12
5050 curement of goods or services awarded by the execu-13
5151 tive agency, a clause requiring the prime contractor 14
5252 to certify that the contractor— 15
5353 ‘‘(A) has no policy, practice, guidance, or 16
5454 directive that discriminates against a firearm 17
5555 entity or firearm trade association; and 18
5656 ‘‘(B) will not adopt a policy, practice, guid-19
5757 ance, or directive that discriminates against a 20
5858 firearm entity or firearm trade association dur-21
5959 ing the term of the contract. 22

6161 UBCONTRACTS.—The head of an execu-23
6262 tive agency shall include in each contract for the 24
6363 procurement of goods or services awarded by the ex-25

6767 ecutive agency, a clause that prohibits the prime 1
6868 contractor on such contract from— 2
6969 ‘‘(A) awarding a first-tier subcontract with 3
7070 a value greater than 10 percent of the total 4
7171 value of the prime contract to an entity that 5
7272 fails to certify in writing to the prime con-6
7373 tractor that the entity— 7
7474 ‘‘(i) has no policy, practice, guidance, 8
7575 or directive that discriminates against a 9
7676 firearm entity or firearm trade association; 10
7777 and 11
7878 ‘‘(ii) will not adopt a policy, practice, 12
7979 guidance, or directive that discriminates 13
8080 against a firearm entity or firearm trade 14
8181 association during the term of the con-15
8282 tract; and 16
8383 ‘‘(B) structuring subcontract tiers in a 17
8484 manner designed to avoid violating subpara-18
8585 graph (A) by enabling a subcontractor to per-19
8686 form more than 10 percent of the total value of 20
8787 the prime contract as a lower-tier subcon-21
8888 tractor. 22
8989 ‘‘(3) P
9090 ENALTIES.—The clause included in con-23
9191 tracts pursuant to paragraph (1) or paragraph (2) 24

9696 tractor violates the clause— 2
9797 ‘‘(A) the prime contract shall be termi-3
9898 nated for default; and 4
9999 ‘‘(B) a suspension or debarment pro-5
100100 ceeding will be initiated for the contractor on 6
101101 the basis of the violation. 7
102102 ‘‘(b) E
103103 XCEPTION.—Subsection (a) shall not apply to 8
104104 a contract for the procurement of goods or services that 9
105105 is a sole-source contract. 10
106106 ‘‘(c) D
107107 EFINITIONS.—In this section: 11
108108 ‘‘(1) D
109109 ISCRIMINATE.—The term ‘discriminate’ 12
110110 means to— 13
111111 ‘‘(A) make a judgement about a policy, 14
112112 practice, guidance, or directive on the basis 15
113113 of— 16
114114 ‘‘(i) partial criteria or a category- 17
115115 based assessment analysis, rather than— 18
116116 ‘‘(I) on a case-by-case basis; or 19
117117 ‘‘(II) using empirical data evalu-20
118118 ated under quantifiable standards; or 21
119119 ‘‘(ii) criteria other than criteria free 22
120120 from— 23
121121 ‘‘(I) favoritism or prejudice 24
122122 against or dislike for the firearm enti-25

127127 or services sold by the firearm entity 2
128128 or trade association; or 3
129129 ‘‘(II) favoritism for market alter-4
130130 natives to the business of the firearm 5
131131 entity or the trade association; 6
132132 ‘‘(B) refuse to provide services, or deny, 7
133133 cancel, or limit services, to the firearm entity or 8
134134 trade association on the basis of criteria other 9
135135 than— 10
136136 ‘‘(i) criteria free from— 11
137137 ‘‘(I) favoritism or prejudice 12
138138 against or dislike for the firearm enti-13
139139 ty or trade association or the products 14
140140 or services sold by the firearm entity 15
141141 or trade association; or 16
142142 ‘‘(II) favoritism for market alter-17
143143 natives to the business of the firearm 18
144144 entity or the trade association; 19
145145 ‘‘(ii) criteria related to credit history 20
146146 and financial risk specific to a customer or 21
147147 potential customer; or 22
148148 ‘‘(iii) criteria related to noncompliance 23
149149 with Federal, State, or local law; or 24

154154 tity or trade association in manner not required 2
155155 by— 3
156156 ‘‘(i) Federal, State, or local law; or 4
157157 ‘‘(ii) Federal, State, or local regula-5
158158 tion. 6

160160 IREARM ENTITY.—The term ‘firearm en-7
161161 tity’ means any— 8
162162 ‘‘(A) person who is licensed under section 9
163163 923 of title 18 to import, manufacture, or deal 10
164164 in firearms; 11
165165 ‘‘(B) seller of ammunition, as defined in 12
166166 section 7903 of title 15; 13
167167 ‘‘(C) manufacturer or importer of, or deal-14
168168 er in, a secure gun storage or safety device, as 15
169169 defined in section 921(a) of title 18; and 16
170170 ‘‘(D) manufacturer or importer of, or deal-17
171171 er in, a component part or accessory of a fire-18
172172 arm or ammunition. 19

174174 IREARM TRADE ASSOCIATION .—The term 20
175175 ‘firearm trade association’ has the meaning in sec-21
176176 tion 7903 of title 15. 22
177177 ‘‘(4) F
178178 IRST-TIER SUBCONTRACT .—The term 23
179179 ‘first-tier subcontract’ means a subcontract entered 24

186186 OWER-TIER SUBCONTRACTOR .—The term 3
187187 ‘lower-tier subcontractor’ means any person entering 4
188188 into a contract with a subcontractor of a prime con-5
189189 tractor for the purposes of carrying out the prime 6
190190 contract. 7
191191 ‘‘(6) P
192192 RIME CONTRACT; PRIME CONTRACTOR .— 8
193193 The terms ‘prime contract’ and ‘prime contractor’ 9
194194 have the meaning given those terms in section 8701 10
195195 of title 41.’’. 11

197197 PPLICATION.—Section 4715 of title 41, United 12
198198 States Code, as added by subsection (a), shall apply with 13
199199 respect to contracts awarded on or after the date of the 14
200200 enactment of this Act. 15

202202 LERICALAMENDMENT.—The table of sections 16
203203 for chapter 47 of title 41, United States Code, is amended 17
204204 by adding at the end the following: 18
205205 ‘‘4715. Prohibition on entering into contracts with entities discriminating
206206 against firearm or ammunition industries.’’.
