26	26	To amend title 18, United States Code, to prohibit machine-
27	27	gun conversion devices and illegal modifications of semi-
28	28	automatic firearms, and for other purposes.
29	29	Be it enacted by the Senate and House of Representa-1
30	30	tives of the United States of America in Congress assembled, 2
31	31	SECTION 1. SHORT TITLE. 3
32	32	This Act may be cited as the ‘‘Banning Unlawful Ma-4
33	33	chinegun Parts Act’’ or the ‘‘BUMP Act’’. 5

37	37	SEC. 2. PROHIBITION. 1
38	38	(a) I
39	39	NGENERAL.—Chapter 44 of title 18, United 2
40	40	States Code, is amended— 3
41	41	(1) in section 921(a), by inserting after para-4
42	42	graph (30) the following: 5
43	43	‘‘(31) The term ‘semiautomatic firearm’ means any 6
44	44	firearm that— 7
45	45	‘‘(A) upon initiating the firing sequence, fires 8
46	46	the first chambered cartridge and uses a portion of 9
47	47	the energy of the firing cartridge to— 10
48	48	‘‘(i) extract the expended cartridge case; 11
49	49	‘‘(ii) chamber the next round; and 12
50	50	‘‘(iii) prepare the firing mechanism to fire 13
51	51	again; 14
52	52	‘‘(B) requires a separate pull, release, push, or 15
53	53	initiation of the trigger to fire each cartridge; and 16
54	54	‘‘(C) is not a machinegun.’’; 17
55	55	(2) in section 922, by inserting after subsection 18
56	56	(u) the following: 19
57	57	‘‘(v)(1) Except as provided in paragraphs (3) and (4), 20
58	58	on and after the date that is 120 days after the date of 21
59	59	enactment of this subsection, it shall be unlawful for any 22
60	60	person to import, sell, manufacture, transfer, receive, or 23
61	61	possess, in or affecting interstate or foreign commerce— 24
62	62	‘‘(A) any manual, power-driven, or electronic 25
63	63	device primarily designed, or redesigned, so that 26

67	67	when the device is attached to a semiautomatic fire-1
68	68	arm the device— 2
69	69	‘‘(i) materially increases the rate of fire of 3
70	70	the firearm; or 4
71	71	‘‘(ii) approximates the action or rate of fire 5
72	72	of a machinegun; 6
73	73	‘‘(B) any device, part, or combination of parts, 7
74	74	that is designed or functions to materially increase 8
75	75	the rate of fire of a firearm, by eliminating the need 9
76	76	for the operator of the firearm to make a separate 10
77	77	movement for each individual function of the trigger; 11
78	78	or 12
79	79	‘‘(C) a semiautomatic firearm that has been 13
80	80	modified in any way that— 14
81	81	‘‘(i) materially increases the rate of fire of 15
82	82	the firearm; or 16
83	83	‘‘(ii) approximates the action or rate of fire 17
84	84	of a machinegun. 18
85	85	‘‘(2) Except as provided in paragraph (3), not later 19
86	86	than 120 days after the date of enactment of this sub-20
87	87	section, any person who lawfully owns or possesses a semi-21
88	88	automatic firearm that was modified as described in para-22
89	89	graph (1)(C) before such date of enactment shall register 23
90	90	the semiautomatic firearm in accordance with section 24
91	91	5841 of the Internal Revenue Code of 1986. 25

95	95	‘‘(3) This subsection does not apply with respect to 1
96	96	the importation for, manufacture for, sale to, transfer to, 2
97	97	or possession by or under the authority of, the United 3
98	98	States or any department or agency thereof or a State 4
99	99	or Tribe, or a department, agency, or political subdivision 5
100	100	thereof. 6
101	101	‘‘(4) Paragraph (1) shall not apply to any lawful 7
102	102	transfer or possession of a semiautomatic firearm de-8
103	103	scribed in paragraph (1)(C) that— 9
104	104	‘‘(A) was lawfully modified and possessed before 10
105	105	the date of enactment of this subsection; and 11
106	106	‘‘(B) is registered in accordance with paragraph 12
107	107	(2).’’; and 13
108	108	(3) in section 924(a)(2), by striking ‘‘, or (o)’’ 14
109	109	and inserting ‘‘(o), or (v)’’. 15

111	111	MENDMENT TO THE NATIONALFIREARMS 16

113	113	CT.—Section 5845(a) of the Internal Revenue Code of 17
114	114	1986 is amended by striking ‘‘and (8) a destructive de-18
115	115	vice’’ and inserting ‘‘(8) a destructive device; and (9) a 19
116	116	semiautomatic firearm, as defined in section 921 of title 20
117	117	18, United States Code, that is modified as described in 21
118	118	section 922(v)(1)(C) of such title’’. 22
