2121 Be it enacted by the Senate and House of Representa-1
2222 tives of the United States of America in Congress assembled, 2
2323 SECTION 1. SHORT TITLE. 3
2424 This Act may be cited as the ‘‘Targeting Child Preda-4
2525 tors Act of 2025’’. 5

2929 SEC. 2. NONDISCLOSURE OF ADMINISTRATIVE SUBPOENAS. 1
3030 Section 3486(a) of title 18, United States Code, is 2
3131 amended— 3
3232 (1) by striking ‘‘the Secretary of the Treasury’’ 4
3333 each place it appears and inserting ‘‘the Secretary of 5
3434 Homeland Security’’; 6
3535 (2) in paragraph (5), by striking ‘‘ordered by a 7
3636 court’’; and 8
3737 (3) in paragraph (6)— 9
3838 (A) in subparagraph (A), by striking ‘‘A 10
3939 United States’’ and inserting ‘‘Except as pro-11
4040 vided in subparagraph (D), a United States’’; 12
4141 and 13
4242 (B) by adding at the end the following: 14
4343 ‘‘(D)(i)(I) If a subpoena issued under this section as 15
4444 described in paragraph (1)(A)(i)(II) is accompanied by a 16
4545 certification under subclause (II) of this clause and notice 17
4646 of the right to judicial review under clause (iii) of this 18
4747 subparagraph, no recipient of such a subpoena shall dis-19
4848 close to any person that the Federal official who issued 20
4949 the subpoena has sought or obtained access to information 21
5050 or records under this section, for a period of 180 days. 22
5151 ‘‘(II) The requirements of subclause (I) shall apply 23
5252 if the Federal official who issued the subpoena certifies 24
5353 that the absence of a prohibition of disclosure under this 25
5454 subsection may result in— 26

5858 ‘‘(aa) endangering the life or physical safety of 1
5959 an individual; 2
6060 ‘‘(bb) flight from prosecution; 3
6161 ‘‘(cc) destruction of or tampering with evidence; 4
6262 ‘‘(dd) intimidation of potential witnesses; or 5
6363 ‘‘(ee) otherwise seriously jeopardizing an inves-6
6464 tigation. 7
6565 ‘‘(ii)(I) A recipient of a subpoena under this section 8
6666 as described in paragraph (1)(A)(i)(II) may disclose infor-9
6767 mation otherwise subject to any applicable nondisclosure 10
6868 requirement to— 11
6969 ‘‘(aa) those persons to whom disclosure is nec-12
7070 essary in order to comply with the request; 13
7171 ‘‘(bb) an attorney in order to obtain legal advice 14
7272 or assistance regarding the request; or 15
7373 ‘‘(cc) other persons as permitted by the Federal 16
7474 official who issued the subpoena. 17
7575 ‘‘(II) A person to whom disclosure is made under sub-18
7676 clause (I) shall be subject to the nondisclosure require-19
7777 ments applicable to a person to whom a subpoena is issued 20
7878 under this section in the same manner as the person to 21
7979 whom the subpoena was issued. 22
8080 ‘‘(III) Any recipient that discloses to a person de-23
8181 scribed in subclause (I) information otherwise subject to 24

8585 a nondisclosure requirement shall notify the person of the 1
8686 applicable nondisclosure requirement. 2
8787 ‘‘(IV) At the request of the Federal official who 3
8888 issued the subpoena, any person making or intending to 4
8989 make a disclosure under item (aa) or (cc) of subclause 5
9090 (I) shall identify to the individual making the request 6
9191 under this clause the person to whom such disclosure will 7
9292 be made or to whom such disclosure was made prior to 8
9393 the request. 9
9494 ‘‘(iii)(I) A nondisclosure requirement imposed under 10
9595 clause (i) shall be subject to judicial review under section 11
9696 3486A. 12
9797 ‘‘(II) A subpoena issued under this section as de-13
9898 scribed in paragraph (1)(A)(i)(II), in connection with 14
9999 which a nondisclosure requirement under clause (i) is im-15
100100 posed, shall include notice of the availability of judicial re-16
101101 view described in subclause (I). 17
102102 ‘‘(iv) A nondisclosure requirement imposed under 18
103103 clause (i) may be extended in accordance with section 19
104104 3486A(a)(4).’’. 20
105105 SEC. 3. JUDICIAL REVIEW OF NONDISCLOSURE REQUIRE-21

108108 NGENERAL.—Chapter 223 of title 18, United 23
109109 States Code, is amended by inserting after section 3486 24

117117 ONDISCLOSURE.— 3

119119 N GENERAL.— 4

121121 OTICE.—If a recipient of a sub-5
122122 poena under section 3486 as described in sub-6
123123 section (a)(1)(A)(i)(II) of section 3486 wishes 7
124124 to have a court review a nondisclosure require-8
125125 ment imposed in connection with the subpoena, 9
126126 the recipient may notify the Government or file 10
127127 a petition for judicial review in any court de-11
128128 scribed in subsection (a)(5) of section 3486. 12
129129 ‘‘(B) A
130130 PPLICATION.—Not later than 30 13
131131 days after the date of receipt of a notification 14
132132 under subparagraph (A), the Government shall 15
133133 apply for an order prohibiting the disclosure of 16
134134 the existence or contents of the relevant sub-17
135135 poena. An application under this subparagraph 18
136136 may be filed in the district court of the United 19
137137 States for the judicial district in which the re-20
138138 cipient of the subpoena is doing business or in 21
139139 the district court of the United States for any 22
140140 judicial district within which the authorized in-23
141141 vestigation that is the basis for the subpoena is 24
142142 being conducted. The applicable nondisclosure 25
143143 requirement shall remain in effect during the 26

148148 ment. 2
149149 ‘‘(C) C
150150 ONSIDERATION.—A district court of 3
151151 the United States that receives a petition under 4
152152 subparagraph (A) or an application under sub-5
153153 paragraph (B) should rule expeditiously, and 6
154154 shall, subject to paragraph (3), issue a non-7
155155 disclosure order that includes conditions appro-8
156156 priate to the circumstances. 9
157157 ‘‘(2) A
158158 PPLICATION CONTENTS .—An application 10
159159 for a nondisclosure order or extension thereof or a 11
160160 response to a petition filed under paragraph (1) 12
161161 shall include a certification from the Federal official 13
162162 who issued the subpoena indicating that the absence 14
163163 of a prohibition of disclosure under this subsection 15
164164 may result in— 16
165165 ‘‘(A) endangering the life or physical safety 17
166166 of an individual; 18
167167 ‘‘(B) flight from prosecution; 19
168168 ‘‘(C) destruction of or tampering with evi-20
169169 dence; 21
170170 ‘‘(D) intimidation of potential witnesses; or 22
171171 ‘‘(E) otherwise seriously jeopardizing an 23
172172 investigation. 24

176176 ‘‘(3) STANDARD.—A district court of the 1
177177 United States shall issue a nondisclosure order or 2
178178 extension thereof under this subsection if the court 3
179179 determines that there is reason to believe that disclo-4
180180 sure of the information subject to the nondisclosure 5
181181 requirement during the applicable time period may 6
182182 result in— 7
183183 ‘‘(A) endangering the life or physical safety 8
184184 of an individual; 9
185185 ‘‘(B) flight from prosecution; 10
186186 ‘‘(C) destruction of or tampering with evi-11
187187 dence; 12
188188 ‘‘(D) intimidation of potential witnesses; or 13
189189 ‘‘(E) otherwise seriously jeopardizing an 14
190190 investigation. 15
191191 ‘‘(4) E
192192 XTENSION.—Upon a showing that the 16
193193 circumstances described in subparagraphs (A) 17
194194 through (E) of paragraph (3) continue to exist, a 18
195195 district court of the United States may issue an ex 19
196196 parte order extending a nondisclosure order imposed 20
197197 under this subsection or under section 21
198198 3486(a)(6)(D) for additional periods of 180 days, 22
199199 or, if the court determines that the circumstances 23
200200 necessitate a longer period of nondisclosure, for ad-24
201201 ditional periods which are longer than 180 days. 25

205205 ‘‘(b) CLOSEDHEARINGS.—In all proceedings under 1
206206 this section, subject to any right to an open hearing in 2
207207 a contempt proceeding, the court must close any hearing 3
208208 to the extent necessary to prevent an unauthorized disclo-4
209209 sure of a request for records, a report, or other informa-5
210210 tion made to any person or entity under section 3486. Pe-6
211211 titions, filings, records, orders, certifications, and sub-7
212212 poenas must also be kept under seal to the extent and 8
213213 as long as necessary to prevent the unauthorized disclo-9
214214 sure of a subpoena under section 3486.’’. 10

216216 LERICALAMENDMENT.—The table of sections 11
217217 at the beginning of chapter 223 of title 18, United States 12
218218 Code, is amended by inserting after the item relating to 13
219219 section 3486 the following: 14
220220 ‘‘3486A. Judicial review of nondisclosure requirements.’’.
