9494 SEC. 3. ELIGIBILITY OF TRANSFERRED CHILDREN; RETRO-10

399399 Security Act (42 U.S.C. 18

425425 GREEMENT.—For the school year 15
426426 beginning on July 1, 2025, and each school 16
427427 year thereafter, each State shall enter into an 17
428428 agreement described in subparagraph (C) with 18
429429 the 1 or more State agencies conducting eligi-19
430430 bility determinations for the Medicaid program. 20
431431 ‘‘(C) P
432432 ROCEDURES.— 21
433433 ‘‘(i) I
434434 N GENERAL.—Subject to sub-22
435435 paragraph (D) and paragraph (6), an 23
436436 agreement entered into under subpara-24
437437 graph (B) shall establish procedures under 25

447447 trition Act of 1966 (42 U.S.C. 1773). 7
448448 ‘‘(ii) F
449449 REE MEALS.—Each agreement 8
450450 entered into under subparagraph (B) shall 9
451451 ensure that a child who is simultaneously 10
452452 eligible for reduced price meals under this 11
453453 paragraph or based on an income eligibility 12
454454 determination, and for free meals based on 13
455455 documentation provided under subsection 14
456456 (d)(2), shall be certified for free meals. 15
457457 ‘‘(D) C
458458 ERTIFICATION.—Subject to para-16
459459 graph (6), and according to an agreement en-17
460460 tered into under subparagraph (B), the local 18
461461 educational agency conducting eligibility deter-19
462462 minations under that agreement shall certify an 20
463463 eligible child as eligible, without further applica-21
464464 tion, for— 22
465465 ‘‘(i) free or reduced price lunch under 23
466466 this Act; and 24
