3232 NGENERAL.—Section 529(c)(7) of the Internal 4
3333 Revenue Code of 1986 is amended to read as follows: 5
3434 ‘‘(7) T
3535 REATMENT OF ELEMENTARY AND SEC -6
3636 ONDARY TUITION.—Any reference in this section to 7
3737 the term ‘qualified higher education expense’ shall 8
3838 include a reference to the following expenses in con-9
3939 nection with enrollment or attendance at, or for stu-10
4040 dents enrolled at or attending, an elementary or sec-11
4141 ondary public, private, or religious school: 12
4242 ‘‘(A) Tuition. 13
4343 ‘‘(B) Curriculum and curricular materials. 14
4444 ‘‘(C) Books or other instructional mate-15
4545 rials. 16
4646 ‘‘(D) Online educational materials. 17
4747 ‘‘(E) Tuition for tutoring or educational 18
4848 classes outside of the home, including at a tu-19
4949 toring facility, but only if the tutor or instruc-20
5050 tor is not related to the student and— 21
5151 ‘‘(i) is licensed as a teacher in any 22
5252 State, 23
5353 ‘‘(ii) has taught at an eligible edu-24
5454 cational institution, or 25

5858 ‘‘(iii) is a subject matter expert in the 1
5959 relevant subject. 2
6060 ‘‘(F) Fees for a nationally standardized 3
6161 norm-referenced achievement test, an advanced 4
6262 placement examination, or any examinations re-5
6363 lated to college or university admission. 6
6464 ‘‘(G) Fees for dual enrollment in an insti-7
6565 tution of higher education. 8
6666 ‘‘(H) Educational therapies for students 9
6767 with disabilities provided by a licensed or ac-10
6868 credited practitioner or provider, including oc-11
6969 cupational, behavioral, physical, and speech-lan-12
7070 guage therapies. 13
7171 Such term shall include expenses for the purposes 14
7272 described in subparagraphs (A) through (H) in con-15
7373 nection with a homeschool (whether treated as a 16
7474 homeschool or a private school for purposes of appli-17
7575 cable State law).’’. 18
7676 (b) E
7777 FFECTIVEDATE.—The amendment made by 19
7878 this section shall apply to distributions made after the 20
7979 date of the enactment of this Act. 21
