16	16	United States, and for other purposes.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘Creating Obstructions 4
21	21	Necessary To Address Illegal and Nefarious Entry Rap-5
22	22	idly Act’’ or the ‘‘CONTAINER Act’’. 6

31	31	EFINITIONS.—In this section: 5
32	32	(1) B
33	33	ORDER STATE.—The term ‘‘Border State’’ 6
34	34	means a State that is adjacent to the northern bor-7
35	35	der or southern border. 8

37	37	EDERAL LAND.—The term ‘‘Federal land’’ 9
38	38	means land under the jurisdiction and management 10
39	39	of a Federal land management agency that is adja-11
40	40	cent to the northern border or southern border. 12

42	42	EDERAL LAND MANAGEMENT AGENCY .— 13
43	43	The term ‘‘Federal land management agency’’ 14
44	44	means— 15
45	45	(A) the Bureau of Indian Affairs; 16
46	46	(B) the Bureau of Land Management; 17
47	47	(C) the Bureau of Reclamation; 18
48	48	(D) the Forest Service; 19
49	49	(E) the United States Fish and Wildlife 20
50	50	Service; and 21
51	51	(F) the National Park Service. 22

53	53	ORTHERN BORDER .—The term ‘‘northern 23
54	54	border’’ means the international border between the 24
55	55	United States and Canada. 25

59	59	(5) OPERATIONAL CONTROL .—The term ‘‘oper-1
60	60	ational control’’ has the meaning given such term in 2
61	61	section 2(b) of the Secure Fence Act of 2006 (8 3
62	62	U.S.C. 1701 note; Public Law 109–367). 4

64	64	ECRETARY CONCERNED .—The term ‘‘Sec-5
65	65	retary concerned’’ means— 6
66	66	(A) the Secretary of the Interior, with re-7
67	67	spect to Federal land under the jurisdiction and 8
68	68	management of the Secretary of the Interior, 9
69	69	acting through, as applicable— 10
70	70	(i) the Director of the Bureau of In-11
71	71	dian Affairs; 12
72	72	(ii) the Director of the Bureau of 13
73	73	Land Management; 14
74	74	(iii) the Commissioner of Reclamation; 15
75	75	(iv) the Director of the United States 16
76	76	Fish and Wildlife Service; and 17
77	77	(v) the Director of the National Park 18
78	78	Service; and 19
79	79	(B) the Secretary of Agriculture, with re-20
80	80	spect to National Forest System land, acting 21
81	81	through the Chief of the Forest Service. 22

83	83	OUTHERN BORDER .—The term ‘‘southern 23
84	84	border’’ means the international border between the 24
85	85	United States and Mexico. 25

89	89	(b) SPECIALUSEAUTHORIZATION.—Subject to sub-1
90	90	section (c), the Secretary concerned shall not require a 2
91	91	Border State to obtain a special use authorization for the 3
92	92	temporary placement on Federal land within the Border 4
93	93	State of a movable, temporary structure for the purpose 5
94	94	of securing the northern border or southern border, if the 6
95	95	Border State submits to the Secretary concerned notice 7
96	96	of the proposed placement not later than 45 days before 8
97	97	the date of the proposed placement. 9

99	99	EMPORARYPLACEMENT.— 10

101	101	N GENERAL.—A movable, temporary struc-11
102	102	ture described in subsection (b) may be placed by a 12
103	103	Border State on Federal land in accordance with 13
104	104	that subsection for a period of not more than 1 year, 14
105	105	subject to paragraph (2). 15

107	107	XTENSION.— 16

109	109	N GENERAL.—The period described in 17
110	110	paragraph (1) may be extended in 90-day incre-18
111	111	ments, on approval by the Secretary concerned. 19
112	112	(B) C
113	113	ONSULTATION REQUIRED .—The Sec-20
114	114	retary concerned shall consult with the Commis-21
115	115	sioner of U.S. Customs and Border Protection 22
116	116	for purposes of determining whether to approve 23
117	117	an extension under subparagraph (A). 24

122	122	shall approve a request for an extension under 2
123	123	this paragraph if the Commissioner of U.S. 3
124	124	Customs and Border Protection determines that 4
125	125	operational control has not been achieved as of 5
126	126	the date of the consultation required under sub-6
127	127	paragraph (B). 7
