1616 Be it enacted by the Senate and House of Representa-1
1717 tives of the United States of America in Congress assembled, 2
1818 SECTION 1. SHORT TITLE. 3
1919 This Act may be cited as the ‘‘Protect and Serve Act 4
2020 of 2025’’. 5
2121 SEC. 2. CRIMES TARGETING LAW ENFORCEMENT OFFI-6

2323 (a) I
2424 NGENERAL.—Chapter 7 of title 18, United 8
2525 States Code, is amended by adding at the end the fol-9

3030 ‘‘§ 120. Crimes targeting law enforcement officers 1
3131 ‘‘(a) I
3232 NGENERAL.—Whoever, in any circumstance 2
3333 described in subsection (b), knowingly assaults a law en-3
3434 forcement officer causing serious bodily injury, or at-4
3535 tempts to do so— 5
3636 ‘‘(1) shall be imprisoned not more than 10 6
3737 years, fined in accordance with this title, or both; 7
3838 and 8
3939 ‘‘(2) shall be imprisoned for any term of years 9
4040 or for life, fined in accordance with this title, or 10
4141 both, if— 11
4242 ‘‘(A) death results from the offense; or 12
4343 ‘‘(B) the offense includes kidnapping or an 13
4444 attempt to kidnap, or an attempt to kill. 14
4545 ‘‘(b) C
4646 IRCUMSTANCESDESCRIBED.—For purposes of 15
4747 subsection (a), the circumstances described in this sub-16
4848 section are that— 17
4949 ‘‘(1) the conduct described in subsection (a) oc-18
5050 curs during the course of, or as the result of, the 19
5151 travel of the defendant or the victim— 20
5252 ‘‘(A) across a State line or national border; 21
5353 or 22
5454 ‘‘(B) using a channel, facility, or instru-23
5555 mentality of interstate or foreign commerce; 24
5656 ‘‘(2) the defendant uses a channel, facility, or 25
5757 instrumentality of interstate or foreign commerce in 26

6161 connection with the conduct described in subsection 1
6262 (a); 2
6363 ‘‘(3) in connection with the conduct described in 3
6464 subsection (a), the defendant employs a firearm, 4
6565 dangerous weapon, explosive or incendiary device, or 5
6666 other weapon that has traveled in interstate or for-6
6767 eign commerce; 7
6868 ‘‘(4) the conduct described in subsection (a)— 8
6969 ‘‘(A) interferes with commercial or other 9
7070 economic activity in which the victim is engaged 10
7171 at the time of the conduct; or 11
7272 ‘‘(B) otherwise affects interstate or foreign 12
7373 commerce; or 13
7474 ‘‘(5) the victim is a Federal law enforcement of-14
7575 ficer. 15
7676 ‘‘(c) C
7777 ERTIFICATIONREQUIREMENT.— 16
7878 ‘‘(1) I
7979 N GENERAL.—No prosecution of any of-17
8080 fense described in this section may be undertaken by 18
8181 the United States, except under the certification in 19
8282 writing of the Attorney General, or a designee, 20
8383 that— 21
8484 ‘‘(A) the State does not have jurisdiction; 22
8585 ‘‘(B) the State has requested that the Fed-23
8686 eral Government assume jurisdiction; 24

9090 ‘‘(C) the verdict or sentence obtained pur-1
9191 suant to State charges left demonstratively 2
9292 unvindicated the Federal interest in protecting 3
9393 the public safety; or 4
9494 ‘‘(D) a prosecution by the United States is 5
9595 in the public interest and necessary to secure 6
9696 substantial justice. 7
9797 ‘‘(2) R
9898 ULE OF CONSTRUCTION .—Nothing in 8
9999 this subsection shall be construed to limit the au-9
100100 thority of Federal officers, or a Federal grand jury, 10
101101 to investigate possible violations of this section. 11
102102 ‘‘(d) D
103103 EFINITIONS.—In this section: 12
104104 ‘‘(1) L
105105 AW ENFORCEMENT OFFICER .—The term 13
106106 ‘law enforcement officer’ means an employee of a 14
107107 governmental or public agency who is authorized by 15
108108 law— 16
109109 ‘‘(A) to engage in or supervise the preven-17
110110 tion, detection, or the investigation of any 18
111111 criminal violation of law; or 19
112112 ‘‘(B) to engage in or supervise the deten-20
113113 tion or the incarceration of any person for any 21
114114 criminal violation of law. 22
115115 ‘‘(2) S
116116 TATE.—The term ‘State’ means a State 23
117117 of the United States, the District of Columbia, or 24

125125 for chapter 7 of title 18, United States Code, is amended 4
