14	14	offenses targeting law enforcement officers, and for other
15	15	purposes.
16	16	Be it enacted by the Senate and House of Representa-1
17	17	tives of the United States of America in Congress assembled, 2
18	18	SECTION 1. SHORT TITLE. 3
19	19	This Act may be cited as the ‘‘Protect and Serve Act 4
20	20	of 2025’’. 5
21	21	SEC. 2. CRIMES TARGETING LAW ENFORCEMENT OFFI-6
22	22	CERS. 7
23	23	(a) I
24	24	NGENERAL.—Chapter 7 of title 18, United 8
25	25	States Code, is amended by adding at the end the fol-9
26	26	lowing: 10

30	30	‘‘§ 120. Crimes targeting law enforcement officers 1
31	31	‘‘(a) I
32	32	NGENERAL.—Whoever, in any circumstance 2
33	33	described in subsection (b), knowingly assaults a law en-3
34	34	forcement officer causing serious bodily injury, or at-4
35	35	tempts to do so— 5
36	36	‘‘(1) shall be imprisoned not more than 10 6
37	37	years, fined in accordance with this title, or both; 7
38	38	and 8
39	39	‘‘(2) shall be imprisoned for any term of years 9
40	40	or for life, fined in accordance with this title, or 10
41	41	both, if— 11
42	42	‘‘(A) death results from the offense; or 12
43	43	‘‘(B) the offense includes kidnapping or an 13
44	44	attempt to kidnap, or an attempt to kill. 14
45	45	‘‘(b) C
46	46	IRCUMSTANCESDESCRIBED.—For purposes of 15
47	47	subsection (a), the circumstances described in this sub-16
48	48	section are that— 17
49	49	‘‘(1) the conduct described in subsection (a) oc-18
50	50	curs during the course of, or as the result of, the 19
51	51	travel of the defendant or the victim— 20
52	52	‘‘(A) across a State line or national border; 21
53	53	or 22
54	54	‘‘(B) using a channel, facility, or instru-23
55	55	mentality of interstate or foreign commerce; 24
56	56	‘‘(2) the defendant uses a channel, facility, or 25
57	57	instrumentality of interstate or foreign commerce in 26

61	61	connection with the conduct described in subsection 1
62	62	(a); 2
63	63	‘‘(3) in connection with the conduct described in 3
64	64	subsection (a), the defendant employs a firearm, 4
65	65	dangerous weapon, explosive or incendiary device, or 5
66	66	other weapon that has traveled in interstate or for-6
67	67	eign commerce; 7
68	68	‘‘(4) the conduct described in subsection (a)— 8
69	69	‘‘(A) interferes with commercial or other 9
70	70	economic activity in which the victim is engaged 10
71	71	at the time of the conduct; or 11
72	72	‘‘(B) otherwise affects interstate or foreign 12
73	73	commerce; or 13
74	74	‘‘(5) the victim is a Federal law enforcement of-14
75	75	ficer. 15
76	76	‘‘(c) C
77	77	ERTIFICATIONREQUIREMENT.— 16
78	78	‘‘(1) I
79	79	N GENERAL.—No prosecution of any of-17
80	80	fense described in this section may be undertaken by 18
81	81	the United States, except under the certification in 19
82	82	writing of the Attorney General, or a designee, 20
83	83	that— 21
84	84	‘‘(A) the State does not have jurisdiction; 22
85	85	‘‘(B) the State has requested that the Fed-23
86	86	eral Government assume jurisdiction; 24

90	90	‘‘(C) the verdict or sentence obtained pur-1
91	91	suant to State charges left demonstratively 2
92	92	unvindicated the Federal interest in protecting 3
93	93	the public safety; or 4
94	94	‘‘(D) a prosecution by the United States is 5
95	95	in the public interest and necessary to secure 6
96	96	substantial justice. 7
97	97	‘‘(2) R
98	98	ULE OF CONSTRUCTION .—Nothing in 8
99	99	this subsection shall be construed to limit the au-9
100	100	thority of Federal officers, or a Federal grand jury, 10
101	101	to investigate possible violations of this section. 11
102	102	‘‘(d) D
103	103	EFINITIONS.—In this section: 12
104	104	‘‘(1) L
105	105	AW ENFORCEMENT OFFICER .—The term 13
106	106	‘law enforcement officer’ means an employee of a 14
107	107	governmental or public agency who is authorized by 15
108	108	law— 16
109	109	‘‘(A) to engage in or supervise the preven-17
110	110	tion, detection, or the investigation of any 18
111	111	criminal violation of law; or 19
112	112	‘‘(B) to engage in or supervise the deten-20
113	113	tion or the incarceration of any person for any 21
114	114	criminal violation of law. 22
115	115	‘‘(2) S
116	116	TATE.—The term ‘State’ means a State 23
117	117	of the United States, the District of Columbia, or 24

125	125	for chapter 7 of title 18, United States Code, is amended 4
