9696 hibiting any individual, entity, or State or locality from 19
9797 purchasing separate abortion coverage or health benefits 20
9898 coverage that includes abortion so long as such coverage 21
9999 is paid for entirely using only funds not authorized or ap-22
100100 propriated by Federal law and such coverage shall not be 23
101101 purchased using matching funds required for a federally 24
102102 subsidized program, including a State’s or locality’s con-25
103103 tribution of Medicaid matching funds. 26

108108 eral funds for health coverage 2
109109 ‘‘Nothing in this chapter shall be construed as re-3
110110 stricting the ability of any non-Federal health benefits cov-4
111111 erage provider from offering abortion coverage, or the abil-5
112112 ity of a State or locality to contract separately with such 6
113113 a provider for such coverage, so long as only funds not 7
114114 authorized or appropriated by Federal law are used and 8
115115 such coverage shall not be purchased using matching 9
116116 funds required for a federally subsidized program, includ-10
117117 ing a State’s or locality’s contribution of Medicaid match-11
118118 ing funds. 12
119119 ‘‘§ 306. Non-preemption of other Federal laws 13
120120 ‘‘Nothing in this chapter shall repeal, amend, or have 14
121121 any effect on any other Federal law to the extent such 15
122122 law imposes any limitation on the use of funds for abortion 16
123123 or for health benefits coverage that includes coverage of 17
124124 abortion, beyond the limitations set forth in this chapter. 18
125125 ‘‘§ 307. Construction relating to complications arising 19
126126 from abortion 20
127127 ‘‘Nothing in this chapter shall be construed to apply 21
128128 to the treatment of any infection, injury, disease, or dis-22
129129 order that has been caused by or exacerbated by the per-23
130130 formance of an abortion. This rule of construction shall 24
131131 be applicable without regard to whether the abortion was 25
132132 performed in accord with Federal or State law, and with-26

138138 ‘‘§ 308. Treatment of abortions related to rape, incest, 3
139139 or preserving the life of the mother 4
140140 ‘‘The limitations established in sections 301, 302, 5
141141 and 303 shall not apply to an abortion— 6
142142 ‘‘(1) if the pregnancy is the result of an act of 7
143143 rape or incest; or 8
144144 ‘‘(2) in the case where a woman suffers from a 9
145145 physical disorder, physical injury, or physical illness 10
146146 that would, as certified by a physician, place the 11
147147 woman in danger of death unless an abortion is per-12
148148 formed, including a life-endangering physical condi-13
149149 tion caused by or arising from the pregnancy itself. 14
150150 ‘‘§ 309. Application to District of Columbia 15
151151 ‘‘In this chapter: 16
152152 ‘‘(1) Any reference to funds appropriated by 17
153153 Federal law shall be treated as including any 18
154154 amounts within the budget of the District of Colum-19
155155 bia that have been approved by an Act of Congress 20
156156 pursuant to section 446 of the District of Columbia 21
157157 Home Rule Act (or any applicable successor Federal 22
158158 law). 23
159159 ‘‘(2) The term ‘Federal Government’ includes 24
160160 the Government of the District of Columbia.’’. 25
