353353 N GENERAL.—To the extent that the Com-6
354354 pact does not conflict with this title, the Secretary 7
355355 shall execute the Compact, including all appendices 8
356356 to, or parts of, the Compact requiring the signature 9
357357 of the Secretary. 10

359359 ODIFICATIONS.—Nothing in this title pre-11
360360 cludes the Secretary from approving any modifica-12
361361 tion to an appendix to the Compact that is con-13
362362 sistent with this title, to the extent that the modi-14
363363 fication does not otherwise require congressional ap-15
364364 proval under section 2116 of the Revised Statutes 16
365365 (25 U.S.C. 177) or any other applicable provision of 17
366366 Federal law. 18

368368 NVIRONMENTAL COMPLIANCE.— 19

370370 N GENERAL.—In implementing the Com-20
371371 pact and this title, the Secretary shall comply with 21
372372 all applicable provisions of— 22
373373 (A) the Endangered Species Act of 1973 23
374374 (16 U.S.C. 1531 et seq.); 24

387387 Compact and this title, the Fort Belknap In-8
388388 dian Community shall prepare any necessary 9
389389 environmental documents, except for any envi-10
390390 ronmental documents required under section 11
391391 108, consistent with all applicable provisions 12
392392 of— 13
393393 (i) the Endangered Species Act of 14
394394 1973 (16 U.S.C. 1531 et seq.); 15
395395 (ii) the National Environmental Policy 16
396396 Act of 1969 (42 U.S.C. 4231 et seq.), in-17
397397 cluding the implementing regulations of 18
398398 that Act; and 19
399399 (iii) all other applicable Federal envi-20
400400 ronmental laws and regulations. 21

402402 UTHORIZATIONS.—The Secretary 22
403403 shall— 23

408408 mentation submitted under subparagraph 2

410410 (ii) be responsible for the accuracy, 4
411411 scope, and contents of that documentation. 5

413413 FFECT OF EXECUTION .—The execution of 6
414414 the Compact by the Secretary under this section 7
415415 shall not constitute a major Federal action for pur-8
416416 poses of the National Environmental Policy Act of 9
417417 1969 (42 U.S.C. 4321 et seq.). 10
418418 (4) C
419419 OSTS.—Any costs associated with the per-11
420420 formance of the compliance activities described in 12
421421 paragraph (2) shall be paid from funds deposited in 13
422422 the Trust Fund, subject to the condition that any 14
423423 costs associated with the performance of Federal ap-15
424424 proval or other review of such compliance work or 16
425425 costs associated with inherently Federal functions 17
426426 shall remain the responsibility of the Secretary. 18
427427 SEC. 105. TRIBAL WATER RIGHTS. 19

429429 ONFIRMATION OFTRIBALWATERRIGHTS.— 20

431431 N GENERAL.—The Tribal water rights are 21
432432 ratified, confirmed, and declared to be valid. 22
433433 (2) U
434434 SE.—Any use of the Tribal water rights 23
435435 shall be subject to the terms and conditions of the 24
436436 Compact and this title. 25

441441 tween the Compact and this title, this title shall con-2
442442 trol. 3

444444 NTENT OFCONGRESS.—It is the intent of Con-4
445445 gress to provide to each allottee benefits that are equiva-5
446446 lent to, or exceed, the benefits the allottees possess on the 6
447447 day before the date of enactment of this Act, taking into 7
448448 consideration— 8
449449 (1) the potential risks, cost, and time delay as-9
450450 sociated with litigation that would be resolved by the 10
451451 Compact and this title; 11
452452 (2) the availability of funding under this title 12
453453 and from other sources; 13
454454 (3) the availability of water from the Tribal 14
455455 water rights; and 15
456456 (4) the applicability of section 7 of the Act of 16
457457 February 8, 1887 (24 Stat. 390, chapter 119; 25 17
458458 U.S.C. 381), and this title to protect the interests of 18
459459 allottees. 19
460460 (c) T
461461 RUSTSTATUS OFTRIBALWATERRIGHTS.— 20
462462 The Tribal water rights— 21
463463 (1) shall be held in trust by the United States 22
464464 for the use and benefit of the Fort Belknap Indian 23
465465 Community and allottees in accordance with this 24
466466 title; and 25
