14	14	To amend title XVIII of the Social Security Act to perma-
15	15	nently extend certain in-home cardiopulmonary rehabili-
16	16	tation flexibilities established in response to COVID–
17	17	19, and for other purposes.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Sustainable 4
22	22	Cardiopulmonary Rehabilitation Services in the Home 5
23	23	Act’’. 6

28	28	BILITATION FLEXIBILITIES ESTABLISHED IN 2
29	29	RESPONSE TO COVID–19. 3
30	30	(a) I
31	31	NGENERAL.—Section 1861(eee)(2) of the Social 4
32	32	Security Act (42 U.S.C. 1395x(eee)(2)) is amended— 5
33	33	(1) in subparagraph (A)(ii), by inserting ‘‘, in-6
34	34	cluding in the home of an individual when furnished 7
35	35	as a telehealth service through audio-visual real-time 8
36	36	communications technology, or when such home is 9
37	37	designated as a provider-based location of a hospital 10
38	38	outpatient department’’ after ‘‘outpatient basis’’; 11
39	39	and 12
40	40	(2) in subparagraph (B), by inserting ‘‘, includ-13
41	41	ing through the virtual presence of such physician, 14
42	42	physician assistant, nurse practitioner, or clinical 15
43	43	nurse specialist, through audio-visual real-time com-16
44	44	munications technology’’ after ‘‘under the program’’. 17

46	46	XPANDING ORIGINATING SITES.—Section 18
47	47	1834(m) of the Social Security Act (42 U.S.C. 1395m(m)) 19
48	48	is amended— 20
49	49	(1) in paragraph (1), by striking ‘‘and (9)’’ and 21
50	50	all that follows through ‘‘(as defined in paragraph 22
51	51	(4)(E))’’ and inserting ‘‘, (9), and (10), the Sec-23
52	52	retary shall pay for telehealth services that are fur-24
53	53	nished via a telecommunications system by a physi-25
54	54	cian (as defined in section 1861(r)) or a practitioner 26

81	81	HEALTH.—In the case of items and services fur-23
82	82	nished on or after January 1, 2026, the geographic 24
83	83	requirements described in paragraph (4)(C)(i) shall 25

88	88	diac rehabilitation programs and intensive cardiac 2
89	89	rehabilitation programs (as such terms are defined 3
90	90	in section 1861(eee)) and pulmonary rehabilitation 4
91	91	programs (as defined in section 1861(fff)) at an 5
92	92	originating site described in subclause (V) or (X) of 6
93	93	paragraph (4)(C)(ii).’’. 7

97	97	LLOW FOR CERTAINPROGRAMSTOUTILIZETELE-9
98	98	HEALTHSERVICES.— 10
99	99	(1) I
100	100	N GENERAL.—Not later than 30 days after 11
101	101	the date of enactment of this section, the Secretary 12
102	102	of Health and Human Services shall— 13
103	103	(A) establish standards for the designation 14
104	104	of the home of an individual with status as a 15
105	105	provider-based organization of a hospital con-16
106	106	sistent with waivers issued through the Hospital 17
107	107	Without Walls program for cardiac rehabilita-18
108	108	tion, pulmonary rehabilitation, and intensive 19
109	109	cardiac rehabilitation; and 20
110	110	(B) include items and services furnished 21
111	111	under a cardiac rehabilitation program or under 22
112	112	an intensive cardiac rehabilitation program (as 23
113	113	such terms are defined in section 1861(eee) of 24
114	114	the Social Security Act (42 U.S.C. 1395x(eee)), 25

119	119	(as defined in section 1861(fff) of such Act (42 2
120	120	U.S.C. 1395x(fff)) among telehealth services to 3
121	121	be specified under section 1834(m)(4)(F) of 4
122	122	such Act (42 U.S.C. 1395m(m)(4)(F)). 5

124	124	FFECTIVE DATE.—The standards estab-6
125	125	lished under paragraph (1) shall apply to items and 7
126	126	services furnished on or after January 1, 2026. 8
127	127	(d) I
128	128	MPLEMENTATION.—Notwithstanding any other 9
129	129	provision of the law, the Secretary of Health and Human 10
130	130	Services may implement the provisions of, and the amend-11
131	131	ments made by, this section by program instruction or oth-12
132	132	erwise. 13

134	134	FFECTIVEDATE.—The amendments made by 14
135	135	subsections (a) and (b) shall apply to items and services 15
136	136	furnished on or after January 1, 2026. 16
