Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Federal Employee Re-4 turn to Work Act’’. 5 SEC. 2. DEFINITIONS. 6 In this Act: 7 (1) C OVERED EMPLOYEE .—The term ‘‘covered 8 employee’’— 9 VerDate Sep 11 2014 02:58 Jan 31, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S27.IS S27 kjohnson on DSK7ZCZBW3PROD with $$_JOB 2 •S 27 IS (A) means an employee who teleworks not 1 fewer than 1 day, or in the case of an alter-2 native work schedule, not less than 20 percent, 3 a week; and 4 (B) does not include an employee who— 5 (i) teleworks not fewer than 1 day a 6 week; and 7 (ii) is— 8 (I) is disabled and receives rea-9 sonable accommodations; 10 (II) a member of the Foreign 11 Service of the United States; 12 (III) a Federal law enforcement 13 officer; 14 (IV) a member of the Armed 15 Forces on active duty; or 16 (V) any other employee, the offi-17 cial worksite of whom is not described 18 in section 531.605(a)(1) of title 5, 19 Code of Federal Regulations (or any 20 corresponding similar regulation or 21 ruling). 22 (2) E MPLOYEE.—The term ‘‘employee’’ has the 23 meaning given the term in section 2105 of title 5, 24 United States Code. 25 VerDate Sep 11 2014 02:58 Jan 31, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S27.IS S27 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •S 27 IS (3) TELEWORK.—The term ‘‘telework’’ has the 1 meaning given the term in section 6501 of title 5, 2 United States Code. 3 SEC. 3. ANNUAL ADJUSTMENTS TO PAY SCHEDULES. 4 No covered employee may receive an annual adjust-5 ment under section 5303 of title 5, United States Code. 6 SEC. 4. PAY LOCALITIES. 7 Each covered employee shall be paid at the rate of 8 basic pay under the applicable grade and step for that em-9 ployee under the locality pay area designated as ‘‘Rest of 10 U.S.’’— 11 (1) as of the date on which the employee be-12 comes a covered employee; and 13 (2) which shall not be adjusted under section 14 5304 of title 5, United States Code. 15 SEC. 5.
