RELOCATION OF EMPLOYEES. 1 (a) I NGENERAL.—Notwithstanding any other provi-2 sions of law, and not later than 1 year after the date of 3 enactment of this Act, if the Administrator determines that 4 implementing the requirements under paragraphs (1) and 5 (2) of this subsection will reduce the cost to the Federal Gov-6 ernment (which determination the Administrator shall ex-7 plain in detail in the report required under subsection (d) 8 of this section), the Administrator shall— 9 (1) change the permanent duty station of not less 10 than 30 percent of the headquarters employees of the 11 Administration, as of the date of enactment of this 12 Act, to be at an office of the Administration at a loca-13 tion outside the Washington metropolitan area, which 14 shall be at locations throughout the regions of the Ad-15 ministration; and 16 (2) for each employee of the Administration 17 whose permanent duty station is changed under para-18 graph (1), ensure that— 19 (A) the rate of pay of the employee is cal-20 culated based on the pay locality for the perma-21 nent duty station of the employee; and 22 (B) the employee is not authorized to 23 telework on a full-time basis. 24 (b) D ETERMINATION OFNEWDUTYSTATIONS.—In de-25 termining the permanent duty stations of headquarters em-26 VerDate Sep 11 2014 02:48 Mar 05, 2025 Jkt 059200 PO 00000 Frm 00014 Fmt 6652 Sfmt 6203 E:\BILLS\S298.RS S298 ssavage on LAPJG3WLY3PROD with BILLS 15 •S 298 RS ployees of the Administration under subsection (a)(1), the 1 Administrator shall— 2 (1) promote geographic diversity, including con-3 sideration of rural markets; and 4 (2) ensure adequate staffing throughout the re-5 gions of the Administration, to promote in-person 6 customer service. 7 (c) D ETERMINATION OFEMPLOYEESELIGIBLE FOR A 8 C HANGE INDUTYSTATION.— 9 (1) I N GENERAL.—Except as provided in para-10 graph (2), the Administrator shall include each head-11 quarters employee of the Administration as eligible 12 for a change in permanent duty station under sub-13 section (a). 14 (2) E XCEPTION.—A headquarters employee of the 15 Administration who is a qualified individual who re-16 ceives an accommodation to telework on a full-time 17 basis as a reasonable accommodation under title I of 18 the Americans with Disabilities Act of 1990 (42 19 U.S.C. 12111 et seq.)— 20 (A) shall not be determined to be eligible for 21 a change in permanent duty station under sub-22 section (a); and 23 VerDate Sep 11 2014 02:48 Mar 05, 2025 Jkt 059200 PO 00000 Frm 00015 Fmt 6652 Sfmt 6203 E:\BILLS\S298.RS S298 ssavage on LAPJG3WLY3PROD with BILLS 16 •S 298 RS (B) shall be counted as a headquarters em-1 ployee of the Administration for purposes of 2 complying with subsection (a)(1). 3 (3) N OTICE OF DETERMINATION OF ELIGI -4 BILITY.—Not later than the day before the date on 5 which the Administrator submits the report required 6 under subsection (d), the Administrator shall notify 7 each headquarters employee of the Administration 8 who the Administrator determines is eligible for a 9 change in permanent duty station under subsection 10 (a) of that determination. 11 (d) R EPORT.—Not later than 180 days after the date 12 of enactment of this Act, the Administrator shall submit 13 to the Committee on Small Business and Entrepreneurship 14 of the Senate and the Committee on Small Business of the 15 House of Representatives a report that provides— 16 (1) the number of headquarters employees of the 17 Administration, as of the date of enactment of this 18 Act; 3 (4) the number of headquarters employees of the 4 Administration subject to an exception under sub-5 section (c)(2); and 6 (5) the plan of the Administrator to implement 7 subsection (a). 8 (e) I MPLEMENTATION.— 9 (1) I N GENERAL.—Not earlier than 60 days, and 10 not later than 90 days, after the date on which the 11 Administrator submits the report required under sub-12 section (d), the Administrator shall notify each head-13 quarters employee of the Administration whose per-14 manent duty station will be changed to be at an office 15 of the Administration located outside the Washington 16 metropolitan area under subsection (a)— 17 (A) that, effective 90 days after the date of 18 the notification— 19 (i) the permanent duty station of the 20 employee shall be changed; and 2 (B) of the location of such permanent duty 3 station. 4 (2) F ULL-TIME TELEWORKERS REMAINING IN 5 THE WASHINGTON METROPOLITAN AREA .— 6 (A) I N GENERAL.—For any employee de-7 scribed in subparagraph (B), effective on the 8 date that is 180 days after the date on which the 9 Administrator submits the report required under 10 subsection (d), the employee shall not be author-11 ized to telework on a full-time basis. 12 (B) E MPLOYEES COVERED .—An employee 13 described in this subparagraph is a headquarters 14 employee of the Administration— 15 (i) who teleworks on a full-time basis, 16 as of the date of enactment of this Act; 17 (ii) who is not subject to an exception 18 under subsection (c)(2); and 19 (iii) whose permanent duty station is 20 not changed to be an office of the Adminis-21 tration at a location outside the Washington 22 metropolitan area under subsection (a). 23 (3) N O RELOCATION INCENTIVES .—If, pursuant 24 to this Act, the official worksite (as defined in section 25 VerDate Sep 11 2014 02:48 Mar 05, 2025 Jkt 059200 PO 00000 Frm 00018 Fmt 6652 Sfmt 6203 E:\BILLS\S298.RS S298 ssavage on LAPJG3WLY3PROD with BILLS 19 •S 298 RS 531.602 of title 5, Code of Federal Regulations, or 1 any successor regulation) of an employee changes 2 from the residence of the employee to the headquarters 3 of the Administration, notwithstanding any other 4 provision of law, the employee shall not be paid any 5 relocation incentive. 6 SEC. 4. REDUCTION IN HEADQUARTERS OFFICE SPACE. 7 (a) I NGENERAL.—The Administrator shall reduce the 8 amount of office space for the headquarters of the Adminis-9 tration by not less than 30 percent. 10 (b) I MPLEMENTATION.—The Administrator shall— 11 (1) begin reducing office space under subsection 12 (a) not later than 180 days after the date of enact-13 ment of this Act; and 14 (2) complete the reduction of office space re-15 quired under subsection (a) not later than 2 years 16 after the date of enactment of this Act. 17 SEC. 5.
