2323 This Act may be cited as the ‘‘Combatting China’s 4
2424 Pilfering of Intellectual Property Act’’ or the ‘‘CCP IP 5

2929 SEC. 2. IMPOSITION OF SANCTIONS RELATED TO THE 1
3030 THEFT OF INTELLECTUAL PROPERTY. 2
3131 (a) I
3232 NGENERAL.—The President shall impose the 3
3333 sanctions described in subsection (b) with respect to each 4
3434 person described in subsection (c) that the President de-5
3535 termines, on or after the date of enactment of this Act, 6
3636 operates in a sector of the economy of the People’s Repub-7
3737 lic of China in which the person— 8
3838 (1) has engaged in a pattern of significant theft 9
3939 of the intellectual property of a United States per-10
4040 son; or 11
4141 (2) has received the intellectual property of a 12
4242 United States person through a pattern of signifi-13
4343 cant theft engaged in by other persons. 14

4545 ANCTIONSIMPOSED.—The sanctions described 15
4646 in this subsection are the following: 16
4747 (1) A
4848 SSET BLOCKING.—The exercise of all pow-17
4949 ers granted to the President by the International 18
5050 Emergency Economic Powers Act (50 U.S.C. 1701 19
5151 et seq.) to the extent necessary to block and prohibit 20
5252 all transactions in all property and interests in prop-21
5353 erty of a person described in subsection (a) if such 22
5454 property and interests in property are in the United 23
5555 States, come within the United States, or are or 24
5656 come within the possession or control of a United 25
5757 States person. 26

6161 (2) ALIENS INELIGIBLE FOR VISAS, ADMISSION, 1
6262 OR PAROLE.— 2

6464 ISAS, ADMISSION, OR PAROLE.—An 3
6565 alien described in subsection (a) is— 4
6666 (i) inadmissible to the United States; 5
6767 (ii) ineligible to receive a visa or other 6
6868 documentation to enter the United States; 7
6969 and 8
7070 (iii) otherwise ineligible to be admitted 9
7171 or paroled into the United States or to re-10
7272 ceive any other benefit under the Immigra-11
7373 tion and Nationality Act (8 U.S.C. 1101 et 12
7474 seq.). 13

7676 URRENT VISAS REVOKED .— 14
7777 (i) I
7878 N GENERAL.—The issuing con-15
7979 sular officer, the Secretary of State, or the 16
8080 Secretary of Homeland Security (or a des-17
8181 ignee of one of such Secretaries) shall, in 18
8282 accordance with section 221(i) of the Im-19
8383 migration and Nationality Act (8 U.S.C. 20
8484 1201(i)), revoke any visa or other entry 21
8585 documentation issued to an alien who the 22
8686 Secretary of State or the Secretary of 23
8787 Homeland Security (or a designee of one of 24
8888 such Secretaries) determines is described 25

9393 visa or other documentation is issued. 2

9595 FFECT OF REVOCATION .—A rev-3
9696 ocation under clause (i) shall take effect 4
9797 immediately and shall automatically cancel 5
9898 any other valid visa or entry documenta-6
9999 tion that is in the alien’s possession. 7

101101 ERSONSDESCRIBED.—A person described in 8
102102 this subsection is one of the following: 9
103103 (1) An individual who— 10
104104 (A) is a national of the People’s Republic 11
105105 of China or acting at the direction of a national 12
106106 of the People’s Republic of China or an entity 13
107107 described in paragraph (2); and 14
108108 (B) is not a United States person. 15
109109 (2) An entity that is— 16
110110 (A) organized under the laws of the Peo-17
111111 ple’s Republic of China or of any jurisdiction 18
112112 within the People’s Republic of China; 19
113113 (B) owned or controlled by individuals who 20
114114 are nationals of the People’s Republic of China; 21
115115 or 22
116116 (C) owned or controlled by an entity de-23
117117 scribed in subparagraph (A) that is not a 24
118118 United States person. 25

122122 (d) PENALTIES; IMPLEMENTATION.— 1

124124 ENALTIES.—A person that violates, at-2
125125 tempts to violate, conspires to violate, or causes a 3
126126 violation of subsection (b)(1) or any regulation, li-4
127127 cense, or order issued to carry out that subsection 5
128128 shall be subject to the penalties set forth in sub-6
129129 sections (b) and (c) of section 206 of the Inter-7
130130 national Emergency Economic Powers Act (50 8
131131 U.S.C. 1705) to the same extent as a person that 9
132132 commits an unlawful act described in subsection (a) 10
133133 of that section. 11
134134 (2) I
135135 MPLEMENTATION.—The President may ex-12
136136 ercise all authorities provided to the President under 13
137137 sections 203 and 205 of the International Emer-14
138138 gency Economic Powers Act (50 U.S.C. 1702 and 15
139139 1704) for purposes of carrying out this section. 16

141141 AIVER.—The President may waive the imposi-17
142142 tion of sanctions under subsection (a) on a case-by-case 18
143143 basis with respect to a person if the President— 19
144144 (1) certifies to the Committee on Foreign Af-20
145145 fairs and the Committee on the Judiciary of the 21
146146 House of Representatives and the Committee on 22
147147 Foreign Relations and the Committee on the Judici-23
148148 ary of the Senate that such waiver is in the national 24
149149 security interests of the United States; and 25

156156 ERMINATION OF SANCTIONS.—The President 3
157157 may terminate sanctions imposed under subsection (a) 4
158158 with respect to a person if the President certifies to the 5
159159 Committee on Foreign Affairs of the House of Representa-6
160160 tives and the Committee on Foreign Relations of the Sen-7
161161 ate that such person is no longer engaging in efforts to 8
162162 steal intellectual property of United States persons. 9

164164 EPORTREQUIRED.—Not later than 180 days 10
165165 after the date of the enactment of this Act, the President 11
166166 shall submit to the Committee on Foreign Affairs of the 12
167167 House of Representatives and the Committee on Foreign 13
168168 Relations of the Senate a report that specifies each person 14
169169 the President determines meets the criteria described in 15
170170 subsection (a) for the imposition of sanctions. 16

172172 EFINITIONS.—In this section: 17
173173 (1) A
174174 DMITTED; ALIEN.—The terms ‘‘admitted’’ 18
175175 and ‘‘alien’’ have the meanings given those terms in 19
176176 section 101 of the Immigration and Nationality Act 20
177177 (8 U.S.C. 1101). 21

179179 NITED STATES PERSON .—The term 22
180180 ‘‘United States person’’ means— 23

185185 citizen or an alien lawfully admitted for perma-2
186186 nent residence to the United States; or 3
187187 (B) an entity organized under the laws of 4
188188 the United States or of any jurisdiction within 5
189189 the United States. 6
190190 SEC. 3. RESTRICTION ON ISSUANCE OF VISAS. 7
191191 (a) R
192192 ESTRICTION.—The Secretary of State may not 8
193193 issue a visa to, and the Secretary of Homeland Security 9
194194 shall deny entry to the United States of, each of the fol-10
195195 lowing: 11
196196 (1) Senior officials in the Chinese Communist 12
197197 Party, including the Politburo, the Central Com-13
198198 mittee, and each delegate to the 20th National Con-14
199199 gress of the Chinese Communist Party. 15
200200 (2) The spouses and children of the senior offi-16
201201 cials described in paragraph (1). 17
202202 (3) Members of the cabinet of the Government 18
203203 of the People’s Republic of China. 19
204204 (4) Active duty members of the People’s Libera-20
205205 tion Army of China. 21

207207 PPLICABILITY.—The restriction under sub-22
208208 section (a) shall not apply for any year in which the Presi-23
209209 dent certifies to the Committee on the Judiciary of the 24
210210 House of Representatives and the Committee on the Judi-25

214214 ciary of the Senate that the Government of the People’s 1
215215 Republic of China has ceased sponsoring, funding, facili-2
216216 tating, and actively working to support efforts to infringe 3
217217 on the intellectual property rights of citizens and entities 4
218218 of the United States. 5
219219 (c) R
220220 EPORTREQUIRED.—Not later than 180 days 6
221221 after the date of the enactment of this Act, the Secretary 7
222222 of State shall submit to Congress a report that— 8
223223 (1) details the efficacy of visa screening mecha-9
224224 nisms to mitigate intellectual property theft by the 10
225225 People’s Republic of China; and 11
226226 (2) includes a list of research institutions asso-12
227227 ciated with the People’s Liberation Army and the 13
228228 Ministry of State Security of the People’s Republic 14
229229 of China. 15
