13	13	purposes.
14	14	Be it enacted by the Senate and House of Representa-1
15	15	tives of the United States of America in Congress assembled, 2
16	16	SECTION 1. SHORT TITLE. 3
17	17	This Act may be cited as the ‘‘Protect Our Seniors 4
18	18	Act’’. 5
19	19	SEC. 2. POINT OF ORDER FOR REDUCTIONS IN MEDICARE 6
20	20	AND SOCIAL SECURITY BENEFITS. 7
21	21	Section 301 of the Congressional Budget Act of 1974 8
22	22	(2 U.S.C. 632) is amended by adding at the end the fol-9
23	23	lowing: 10

30	30	‘‘(1) I
31	31	N GENERAL.—It shall not be in order in 3
32	32	the Senate to consider any bill or resolution (or 4
33	33	amendment, motion, or conference report on that bill 5
34	34	or resolution) that would reduce benefits under the 6
35	35	Medicare program under title XVIII of the Social 7
36	36	Security Act (42 U.S.C. 1395 et seq.) or benefits 8
37	37	payable under title II of that Act (42 U.S.C. 401 et 9
38	38	seq.). 10
39	39	‘‘(2) W
40	40	AIVER.—Paragraph (1) may be waived 11
41	41	or suspended in the Senate only by the affirmative 12
42	42	vote of two-thirds of the Members, duly chosen and 13
43	43	sworn.’’. 14
44	44	SEC. 3. MEDICARE POINT OF ORDER. 15
45	45	Section 301 of the Congressional Budget Act of 1974 16
46	46	(2 U.S.C. 632), as amended by section 3, is further 17
47	47	amended by adding at the end the following: 18
48	48	‘‘(k) M

51	51	N GENERAL.—It shall not be in order in 20
52	52	the Senate to consider any bill or resolution (or 21
53	53	amendment, motion, or conference report on that bill 22
54	54	or resolution) for which the total budgetary effects 23
55	55	of the measure, as determined by the Congressional 24
56	56	Budget Office, use a decrease in outlays, or an in-25

60	60	crease in revenue, under the health insurance pro-1
61	61	grams under title XVIII of the Social Security Act 2
62	62	(42 U.S.C. 1395 et seq.) to offset a cost of a provi-3
63	63	sion of the measure that is not for the purpose of 4
64	64	carrying out those programs. 5
65	65	‘‘(2) W
66	66	AIVER.—Paragraph (1) may be waived 6
67	67	or suspended in the Senate only by the affirmative 7
68	68	vote of two-thirds of the Members, duly chosen and 8
69	69	sworn. An affirmative vote of two-thirds of the Mem-9
70	70	bers of the Senate, duly chosen and sworn, shall be 10
71	71	required to sustain an appeal of the ruling of the 11
72	72	Chair on a point of order raised under paragraph 12
73	73	(1).’’. 13
