2424 SECTION 1. SHORT TITLE. 3
2525 This Act may be cited as the ‘‘Stifling Transnational 4
2626 Operations and Proliferators by Mitigating Activities that 5

3232 SEC. 2. SENSE OF CONGRESS. 3
3333 It is the sense of Congress that— 4
3434 (1) migrants who have unlawfully entered the 5
3535 United States— 6
3636 (A) are a threat to national security; and 7
3737 (B) should be repatriated to their countries 8
3838 of origin; 9
3939 (2) if a country of origin resists repatriation of 10
4040 its citizens that unlawfully entered the United 11
4141 States, that country should be subject to economic 12
4242 sanctions, denying the country access to the United 13
4343 States financial system; and 14
4444 (3) any country, entity, or individual that know-15
4545 ingly facilitates unlawful immigration into the 16
4646 United States should be subject to economic sanc-17
4747 tions, denying them access to the United States fi-18
4848 nancial system. 19
4949 SEC. 3. DEFINITIONS. 20

6464 OREIGN GOVERNMENT .—The term ‘‘for-6
6565 eign government’’— 7
6666 (A) means any governing body or political 8
6767 organization that exercises control over a for-9
6868 eign country or a substantial portion of a for-10
6969 eign country; and 11
7070 (B) includes— 12
7171 (i) a ministry, department, agency, or 13
7272 instrumentality of a body or organization 14
7373 described in subparagraph (A); 15
7474 (ii) an official, representative, or other 16
7575 individual acting on behalf of such a body 17
7676 or organization, including an individual 18
7777 who holds a formal or informal role of au-19
7878 thority; and 20
7979 (iii) an entity— 21
8080 (I) owned or controlled by such a 22

8989 OREIGN PERSON.—The term ‘‘foreign per-4
9090 son’’— 5
9191 (A) means an individual or entity that is 6
9292 not a United States person; and 7
9393 (B) does not include a foreign government. 8

9595 NOWINGLY.—The term ‘‘knowingly’’, with 9
9696 respect to conduct, a circumstance, or a result, 10
9797 means that a person has actual knowledge, or should 11
9898 have known, of the conduct, the circumstance, or the 12

101101 NITED STATES PERSON .—The term 14
102102 ‘‘United States person’’ means— 15
103103 (A) a United States citizen; 16
104104 (B) an alien lawfully admitted for perma-17
105105 nent residence to the United States; 18
106106 (C) an alien lawfully admitted to the 19
107107 United States, including any alien admitted for 20
108108 temporary residence, tourism, or employment, 21
109109 or to pursue a course of study; or 22
110110 (D) an entity organized under the laws of 23
111111 the United States or of any jurisdiction within 24

117117 SEC. 4. SENSE OF CONGRESS; STATEMENT OF POLICY. 3

119119 ENSE OFCONGRESS.—It is the sense of Con-4
120120 gress that— 5
121121 (1) foreign governments that refuse or obstruct 6
122122 the efforts of the United States to repatriate their 7
123123 citizens who have unlawfully entered the United 8
124124 States constitute an unusual and extraordinary 9
125125 threat to the national security, foreign policy, and 10
126126 economy of the United States, and pose a national 11
127127 emergency; and 12
128128 (2) foreign governments and foreign persons 13
129129 that knowingly facilitate unlawful immigration into 14
130130 the United States constitute an unusual and extraor-15
131131 dinary threat to the national security, foreign policy, 16
132132 and economy of the United States, and pose a na-17
133133 tional emergency. 18

135135 TATEMENT OFPOLICY.—It is the policy of the 19
136136 United States, in order to protect the national security 20
137137 of the United States, to apply economic and other finan-21
138138 cial sanctions with respect to— 22
139139 (1) foreign governments that resist efforts to 23
140140 repatriate their citizens who have unlawfully entered 24
141141 the United States; and 25

148148 SEC. 5. USE OF NATIONAL EMERGENCY AUTHORITIES; RE-4
149149 PORTING. 5

151151 NGENERAL.—The President may exercise all 6
152152 authorities provided under sections 203 and 205 of the 7
153153 International Emergency Economic Powers Act (50 8
154154 U.S.C. 1702 and 1704) to carry out this Act. 9

156156 EPORTREQUIRED.— 10
157157 (1) I
158158 N GENERAL.—Not later than 180 days 11
159159 after the date of the enactment of this Act, and an-12
160160 nually thereafter until the date that is 7 years after 13
161161 such date of enactment, the President shall submit 14
162162 to the appropriate congressional committees a report 15
163163 on actions taken by the executive branch pursuant 16
164164 to this Act and any national emergency declared 17
165165 with respect to the facilitation of unlawful immigra-18
166166 tion to the United States, including— 19
167167 (A) the issuance of any new or revised reg-20
168168 ulations, policies, or guidance; 21
169169 (B) the imposition of sanctions; 22
170170 (C) the collection of relevant information 23
171171 from outside parties; 24

176176 licenses, specific licenses, and statements of li-2
177177 censing policy by the Office of Foreign Assets 3
178178 Control of the Department of the Treasury; 4
179179 (E) any pending enforcement actions; or 5
180180 (F) the implementation of mitigation pro-6
181181 cedures. 7

183183 ORM OF REPORT.—Each report required 8
184184 by paragraph (1) shall be submitted in unclassified 9
185185 form, but may include the matters required by sub-10
186186 paragraphs (C), (D), (E), and (F) of that paragraph 11
187187 in a classified annex. 12
188188 SEC. 6. IMPOSITION OF SANCTIONS WITH RESPECT TO EF-13
189189 FORTS TO RESIST REPATRIATION OR FACILI-14
190190 TATE UNLAWFUL IMMIGRATION. 15
191191 (a) I
192192 NGENERAL.—The President may impose the 16
193193 sanctions described in subsection (b) with respect to— 17
194194 (1) any foreign government the President deter-18
195195 mines knowingly refuses or obstructs the efforts of 19
196196 the United States to repatriate its citizens who have 20
197197 unlawfully entered the United States; and 21
198198 (2) any foreign government or foreign person 22
199199 the President determines knowingly facilitates un-23
200200 lawful immigration into the United States. 24

204204 (b) SANCTIONSDESCRIBED.—The President may, 1
205205 pursuant to the International Emergency Economic Pow-2
206206 ers Act (50 U.S.C. 1701 et seq.), block and prohibit all 3
207207 transactions in property and interests in property of a for-4
208208 eign government or foreign person described in subsection 5
209209 (a) if such property and interests in property are in the 6
210210 United States, come within the United States, or are or 7
211211 come within the possession or control of a United States 8
212212 person. 9

214214 EPORTREQUIRED.—Not later than 180 days 10
215215 after the date of the enactment of this Act, and annually 11
216216 thereafter until the date that is 7 years after such date 12
217217 of enactment, the President shall submit to the appro-13
218218 priate congressional committees a report on actions taken 14
219219 by the executive branch with respect to the foreign govern-15
220220 ments and foreign persons identified under subsection (a). 16
221221 SEC. 7. PENALTIES; WAIVERS; EXCEPTIONS. 17
222222 (a) P
223223 ENALTIES.—A person that violates, attempts to 18
224224 violate, conspires to violate, or causes a violation of this 19
225225 Act or any regulation, license, or order issued to carry out 20
226226 this Act shall be subject to the penalties set forth in sub-21
227227 sections (b) and (c) of section 206 of the International 22
228228 Emergency Economic Powers Act (50 U.S.C. 1705) to the 23
229229 same extent as a person that commits an unlawful act de-24
230230 scribed in subsection (a) of that section. 25

234234 (b) NATIONALSECURITYWAIVER.—The President 1
235235 may waive the application of sanctions under this Act with 2
236236 respect to a foreign government or foreign person if the 3
237237 President determines that the waiver is in the national se-4
238238 curity interest of the United States. 5

240240 XCEPTIONS FORINTELLIGENCE AND LAWEN-6
241241 FORCEMENTACTIVITIES.—This Act shall not apply with 7
242242 respect to— 8
243243 (1) activities subject to the reporting require-9
244244 ments under title V of the National Security Act of 10
245245 1947 (50 U.S.C. 3091 et seq.) or any authorized in-11
246246 telligence activities of the United States; or 12
247247 (2) activities necessary to carry out or assist 13
248248 law enforcement activity of the United States. 14
