179179 N GENERAL.—Not later than 90 days after 15
180180 the date of enactment of this Act, the head of a 16
181181 Federal agency under which any program or office 17
182182 carries out an Executive order or memorandum de-18
183183 scribed in subsection (a)(2) between the date of en-19
184184 actment of this Act and 90 days after the date of 20
185185 enactment of this Act shall close, terminate, and 21
186186 wind up the program or office. 22

188188 O REASSIGNMENT.—The head of a Fed-23
189189 eral agency that closes, terminates, and winds up a 24
190190 program or office under paragraph (1)— 25

200200 SEC. 102. OFFICE OF PERSONNEL MANAGEMENT. 7
201201 (a) I
202202 NGENERAL.—Not later than 180 days after the 8
203203 date of enactment of this Act, the Director of the Office 9
204204 of Personnel Management shall— 10
205205 (1) revise all regulations, policies, procedures, 11
206206 manuals, circulars, courses, training, and guidance 12
207207 of the Office such that all such material is in compli-13
208208 ance with and consistent with this Act and the 14
209209 amendments made by this Act; 15
210210 (2) revise so as to effectively rescind all regula-16
211211 tions, policies, procedures, manuals, circulars, 17
212212 courses, training, and guidance of the Office that 18
213213 were promulgated, adopted, or implemented to com-19
214214 ply with the Executive orders and memoranda de-20
215215 scribed in section 101(a)(2); 21
216216 (3) terminate, close, and wind up the Office of 22
217217 Diversity, Equity, Inclusion, and Accessibility of the 23
218218 Office of Personnel Management (referred to in this 24
219219 paragraph as ‘‘ODEIA’’) and undertake an appro-25

229229 versity Officers Executive Council and undertake an 7
230230 appropriate reduction in force with respect to, and 8
231231 not transfer, reassign, or redesignate any, employees 9
232232 or contractors of that Council, the positions or func-10
233233 tions of whom are eliminated by operation of this 11
234234 Act or the amendments made by this Act. 12

237237 CILCHARTER.—Effective on the date of enactment of this 14
238238 Act, the charter of the Chief Diversity Officers Executive 15
239239 Council is revoked. 16

241241 ROHIBITION ON RACISM INGOVERNMENT.— 17
242242 Section 1104 of title 5, United States Code, is amended 18
243243 by adding at the end the following: 19
244244 ‘‘(d)(1) In this subsection, the term ‘prohibited diver-20
245245 sity, equity, or inclusion practice’ has the meaning given 21
246246 the term in section 1201 of the Civil Rights Act of 1964. 22
247247 ‘‘(2) Racist behavior and racist training in the Gov-23
248248 ernment are prohibited, including any of the following: 24

261261 ‘‘(C) Maintaining an office, bureau, division, or 10
262262 other organization to further promote or enforce a 11
263263 prohibited diversity, equity, or inclusion practice. 12
264264 ‘‘(D) Retaining or employing a consultant or 13
265265 advisor to further promote or enforce a prohibited 14
266266 diversity, equity, or inclusion practice. 15
267267 ‘‘(E) Maintaining a rule, a regulation, a policy, 16
268268 guidance, a guideline, management control, a prac-17
269269 tice, a requirement, training, education, coursework, 18
270270 or a similar device to further promote or enforce a 19
271271 prohibited diversity, equity, or inclusion practice. 20
272272 ‘‘(F) Requiring as a condition of employment, 21
273273 as a condition for promotion or advancement, or as 22
274274 a condition for speaking, making a presentation, or 23
275275 submitting written materials, the signing of or as-24
276276 sent to a statement, code of conduct, work program, 25

285285 ‘‘(3) The Office shall establish standards that shall— 6
286286 ‘‘(A) apply to the activities of the Office or any 7
287287 other agency under authority delegated under sub-8
288288 section (a); 9
289289 ‘‘(B) prohibit racist behavior and racist training 10
290290 in the Government, as described in paragraph (2) of 11
291291 this subsection; 12
292292 ‘‘(C) ensure compliance with this subsection; 13
293293 ‘‘(D) ensure compliance with section 717 of the 14
294294 Civil Rights Act of 1964 (42 U.S.C. 2000e–16); and 15
295295 ‘‘(E) be in accordance with the merit system 16
296296 principles under section 2301. 17
297297 ‘‘(4) The Office shall establish and maintain an over-18
298298 sight program to ensure that activities under any author-19
299299 ity delegated under subsection (a)— 20
300300 ‘‘(A) prohibit racist behavior and racist training 21
301301 in the Government, as described in paragraph (2) of 22
302302 this subsection; 23
303303 ‘‘(B) ensure compliance with this subsection; 24

311311 SEC. 103. OFFICE OF MANAGEMENT AND BUDGET. 5
312312 Not later than 180 days after the date of enactment 6
313313 of this Act, the Director of the Office of Management and 7
314314 Budget shall— 8
315315 (1) revise all regulations, policies, procedures, 9
316316 manuals, circulars, courses, training, and guidance 10
317317 of the Office of Management and Budget to ensure 11
318318 those regulations, policies, procedures, manuals, cir-12
319319 culars, courses, training, and guidance are in compli-13
320320 ance and consistent with this Act and the amend-14
321321 ments made by this Act; 15
322322 (2) rescind all regulations, policies, procedures, 16
323323 manuals, circulars, courses, training, and guidance 17
324324 of the Office of Management and Budget that were 18
325325 promulgated, adopted, or implemented to comply 19
326326 with the Executive orders and memoranda described 20
327327 in section 101(a)(2); and 21
328328 (3) rescind the version of Circular A–4 of the 22
329329 Office of Management and Budget adopted on No-23
330330 vember 9, 2023. 24

343343 N GENERAL.—No Federal funds appro-7
344344 priated or otherwise made available by law shall be 8
345345 used for the purpose of maintaining in any agency 9
346346 an— 10
347347 (A) office relating to diversity, equity, in-11
348348 clusion, or accessibility; or 12
349349 (B) a substantially similar office. 13

351351 ROHIBITION.—No Federal funds appro-14
352352 priated or otherwise made available by law shall be 15
353353 used for the purposes of— 16
354354 (A) maintaining in any agency the Chief 17
355355 Diversity Officers Executive Council or a sub-18
356356 stantially similar council; 19
357357 (B) maintaining or employing in any agen-20
358358 cy a chief diversity officer or a substantially 21
359359 similar officer; 22
360360 (C) subject to paragraph (3), developing, 23
361361 implementing, distributing, or publishing in any 24
362362 agency— 25

372372 (D) developing, implementing, or maintain-7
373373 ing in any agency an employee resource group 8
374374 or an affinity group based on race, color, eth-9
375375 nicity, religion, national origin, sexual orienta-10
376376 tion, or gender identity; 11
377377 (E) developing, implementing, or maintain-12
378378 ing in any agency an agency equity team or a 13
379379 substantially similar team; 14
380380 (F) maintaining the White House Environ-15
381381 mental Justice Interagency Council or a sub-16
382382 stantially similar Council; 17
383383 (G) maintaining the Equitable Data Work-18
384384 ing Group or substantially similar group; 19
385385 (H) developing, implementing, distributing, 20
386386 publishing, establishing, or purchasing in any 21
387387 agency— 22
388388 (i) a training course relating to— 23
389389 (I) diversity; 24
390390 (II) equity; 25

397397 (V) intersectionality; or 4
398398 (ii) a training course substantiality 5
399399 similar to a training course described in 6
400400 clause (i); 7
401401 (I) developing, implementing, or maintain-8
402402 ing in any agency a diversity, equity, inclusion, 9
403403 and accessibility data dashboard or a substan-10
404404 tially similar data dashboard; 11
405405 (J) maintaining within the Office of Per-12
406406 sonnel Management a council relating to diver-13
407407 sity, equity, inclusion, or accessibility; or 14
408408 (K) maintaining or employing in any agen-15
409409 cy a position relating to diversity, equity, inclu-16
410410 sion, or accessibility. 17
411411 (3) E
412412 XCEPTION.—The prohibition under para-18
413413 graph (2)(C) shall not apply to a plan, report, or 19
414414 survey required by law. 20

416416 ULE OF CONSTRUCTION .—Nothing in this 21
417417 section shall be construed to prevent the mainte-22
418418 nance and funding of— 23
419419 (A) Equal Employment Opportunity offices 24
420420 as historically organized and operated; or 25

428428 SEC. 105. DEI OFFICES CLOSED. 5
429429 (a) I
430430 NGENERAL.—Not later than 90 days after date 6
431431 of enactment of this Act, the head of any Federal agency 7
432432 that has an office relating to diversity, equity, inclusion, 8
433433 or accessibility— 9
434434 (1) shall— 10
435435 (A) terminate, close, and wind up that of-11
436436 fice; and 12
437437 (B) undertake an appropriate reduction in 13
438438 force; and 14
439439 (2) may not transfer, reassign, or redesignate 15
440440 any employee or contractor with a position or func-16
441441 tion that is eliminated by operation of this sub-17
442442 section. 18

444444 PPLICATION.—Nothing in this section shall be 19
445445 construed to prevent the maintenance and funding of— 20
446446 (1) Equal Employment Opportunity offices as 21
447447 historically organized and operated; or 22
448448 (2) an office enforcing the Americans with Dis-23
