18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘Sloan Canyon Con-4
21	21	servation and Lateral Pipeline Act’’. 5
22	22	SEC. 2. DEFINITIONS. 6

28	28	servation Area’’ means the Sloan Canyon National 2

62	62	‘‘(1) IN GENERAL.—Notwithstanding sections 1
63	63	202 and 503 of the Federal Land Policy and Man-2
64	64	agement Act of 1976 (43 U.S.C. 1712, 1763) and 3
65	65	subject to valid existing rights and paragraph (3), 4
66	66	the Secretary of the Interior, acting through the Di-5
67	67	rector of the Bureau of Land Management (referred 6
68	68	to in this subsection as the ‘Secretary’), shall, not 7
69	69	later than 1 year after the date of enactment of this 8
70	70	subsection, grant to the Southern Nevada Water Au-9
71	71	thority (referred to in this subsection as the ‘Author-10
72	72	ity’), not subject to the payment of rents or other 11
73	73	charges, the temporary and permanent water pipe-12
74	74	line infrastructure, and outside the boundaries of the 13
75	75	Conservation Area, powerline, facility, and access 14
76	76	road rights-of-way depicted on the map for the pur-15
77	77	poses of— 16
78	78	‘‘(A) performing geotechnical investigations 17
79	79	within the rights-of-way; and 18
80	80	‘‘(B) constructing and operating water 19
81	81	transmission and related facilities. 20

83	83	XCAVATION AND DISPOSAL .— 21
84	84	‘‘(A) I
85	85	N GENERAL.—The Authority may, 22
86	86	without consideration, excavate and use or dis-23
87	87	pose of sand, gravel, minerals, or other mate-24
88	88	rials from the tunneling of the water pipeline 25

92	92	necessary to fulfill the purpose of the rights-of- 1
93	93	way granted under paragraph (1). 2
94	94	‘‘(B) M
95	95	EMORANDUM OF UNDER -3
96	96	STANDING.—Not later than 30 days after the 4
97	97	date on which the rights-of-way are granted 5
98	98	under paragraph (1), the Secretary and the Au-6
99	99	thority shall enter into a memorandum of un-7
100	100	derstanding identifying Federal land on which 8
101	101	the Authority may dispose of materials under 9
102	102	subparagraph (A) to further the interests of the 10
103	103	Bureau of Land Management. 11
104	104	‘‘(3) R
105	105	EQUIREMENTS.—A right-of-way issued 12
106	106	under this subsection shall be subject to the fol-13
107	107	lowing requirements: 14
108	108	‘‘(A) The Secretary may include reasonable 15
109	109	terms and conditions, consistent with section 16
110	110	505 of the Federal Land Policy and Manage-17
111	111	ment Act of 1976 (43 U.S.C. 1765), as are nec-18
112	112	essary to protect Conservation Area resources. 19
113	113	‘‘(B) Construction of the water pipeline 20
114	114	shall not permanently adversely affect conserva-21
115	115	tion area surface resources. 22
116	116	‘‘(C) The right-of-way shall not be located 23
117	117	through or under any area designated as wilder-24
118	118	ness.’’. 25

122	122	(c) PRESERVATION OF TRANSMISSION AND UTILITY 1

124	124	ORRIDORS ANDRIGHTS-OF-WAY.—The expansion of the 2
125	125	Conservation Area boundary under the amendment made 3
126	126	by subsection (a)— 4
127	127	(1) shall be subject to valid existing rights, in-5
128	128	cluding land within a designated utility transmission 6
129	129	corridor or a transmission line right-of-way grant 7
130	130	approved by the Secretary in a record of decision 8
131	131	issued before the date of enactment of this Act; and 9
132	132	(2) shall not preclude— 10
133	133	(A) any activity authorized in accordance 11
134	134	with a designated corridor or right-of-way re-12
135	135	ferred to in paragraph (1), including the oper-13
136	136	ation, maintenance, repair, or replacement of 14
137	137	any authorized utility facility within the cor-15
138	138	ridor or right-of-way; or 16
139	139	(B) the Secretary from authorizing the es-17
140	140	tablishment of a new utility facility right-of-way 18
141	141	within an existing designated transportation 19
142	142	and utility corridor referred to in paragraph 20
143	143	(1)— 21
144	144	(i) in accordance with the National 22
145	145	Environmental Policy Act of 1969 (42 23
146	146	U.S.C. 4321 et seq.) and other applicable 24
147	147	laws; and 25

155	155	ANAGEMENT OF THE CONSERVATIONAREA.— 4
156	156	Except as provided in the amendment made by subsection 5
157	157	(b), nothing in this Act or the amendments made by this 6
158	158	Act shall modify the management of the Conservation 7
159	159	Area pursuant to section 605 of the Sloan Canyon Na-8
160	160	tional Conservation Area Act (16 U.S.C. 460qqq–3). 9
