3030 SECTION 1. SHORT TITLES. 3
3131 This Act may be cited as the ‘‘National Origin-Based 4
3232 Antidiscrimination for Nonimmigrants Act’’ or the ‘‘NO 5
3333 BAN Act’’. 6

3737 SEC. 2. EXPANSION OF NONDISCRIMINATION PROVISION. 1
3838 Section 202(a)(1)(A) of the Immigration and Nation-2
3939 ality Act (8 U.S.C. 1152(a)(1)(A)) is amended— 3
4040 (1) by striking ‘‘Except as specifically provided 4
4141 in paragraph (2) and in sections 101(a)(27), 5
4242 201(b)(2)(A)(i), and 203, no’’ and inserting ‘‘No’’; 6
4343 (2) by inserting ‘‘or a nonimmigrant visa, ad-7
4444 mission or other entry into the United States, or the 8
4545 approval or revocation of any immigration benefit’’ 9
4646 after ‘‘immigrant visa’’; 10
4747 (3) by inserting ‘‘religion,’’ after ‘‘sex,’’; and 11
4848 (4) by inserting before the period at the end the 12
4949 following: ‘‘, except as specifically provided in para-13
5050 graph (2) and sections 101(a)(27), 201(b)(2)(A)(i), 14
5151 and 203, if otherwise expressly required by statute, 15

7373 United States or the preservation of human rights, 5
7474 democratic processes or institutions, or international 6
7575 stability, the President may temporarily— 7
7676 ‘‘(A) suspend the entry of such aliens or 8
7777 class of aliens as immigrants or nonimmigrants; 9
7878 or 10
7979 ‘‘(B) impose any restrictions on the entry 11
8080 of such aliens that the President deems appro-12
8181 priate. 13

8383 IMITATIONS.—In carrying out paragraph 14
8484 (1), the President, the Secretary of State, and the 15
8585 Secretary of Homeland Security shall— 16
8686 ‘‘(A) only issue a suspension or restriction 17
8787 when required to address specific acts impli-18
8888 cating a compelling government interest in a 19
8989 factor identified under paragraph (1); 20
9090 ‘‘(B) narrowly tailor such suspension or re-21
9191 striction, using the least restrictive means, to 22
9292 achieve such compelling government interest; 23
9393 ‘‘(C) specify the duration of such suspen-24
9494 sion or restriction; 25

104104 ONGRESSIONAL NOTIFICATION .— 6
105105 ‘‘(A) I
106106 N GENERAL.—Before the President 7
107107 may exercise the authority under paragraph 8
108108 (1), the Secretary of State and the Secretary of 9
109109 Homeland Security shall consult with Congress 10
110110 and provide Congress with specific evidence 11
111111 supporting the need for the proposed suspen-12
112112 sion or restriction and its proposed duration. 13
113113 ‘‘(B) B
114114 RIEFING AND REPORT .—Not later 14
115115 than 48 hours after the President exercises the 15
116116 authority under paragraph (1), the Secretary of 16
117117 State and the Secretary of Homeland Security 17
118118 shall provide a briefing and submit a written re-18
119119 port to Congress that describes— 19
120120 ‘‘(i) the action taken pursuant to 20
121121 paragraph (1) and the specified objective 21
122122 of such action; 22
123123 ‘‘(ii) the estimated number of individ-23
124124 uals who will be impacted by such action; 24

133133 complies with paragraph (2) and any intel-6
134134 ligence informing such actions. 7
135135 ‘‘(C) T
136136 ERMINATION.—If the briefing and 8
137137 report described in subparagraph (B) are not 9
138138 provided to Congress during the 48-hour period 10
139139 beginning when the President exercises the au-11
140140 thority under paragraph (1), the suspension or 12
141141 restriction shall immediately terminate absent 13
142142 intervening congressional action. 14
143143 ‘‘(D) D
144144 EFINED TERM.—In this paragraph, 15
145145 the term ‘Congress’ means— 16
146146 ‘‘(i) the Select Committee on Intel-17
147147 ligence of the Senate; 18
148148 ‘‘(ii) the Committee on Foreign Rela-19
149149 tions of the Senate; 20
150150 ‘‘(iii) the Committee on the Judiciary 21

177177 other provision of law, an individual or entity 17
178178 who is present in the United States and has 18
179179 been harmed by a violation of this subsection 19
180180 may file an action in an appropriate district 20
181181 court of the United States to seek declaratory 21
182182 or injunctive relief. 22

192192 REATMENT OF COMMERCIAL AIRLINES .— 3
193193 Whenever the Secretary of Homeland Security deter-4
194194 mines that a commercial airline has failed to comply 5
195195 with regulations of the Secretary of Homeland Secu-6
196196 rity relating to requirements of airlines for the de-7
197197 tection of fraudulent documents used by passengers 8
198198 traveling to the United States (including the train-9
199199 ing of personnel in such detection), the Secretary of 10
200200 Homeland Security may suspend the entry of some 11
201201 or all aliens transported to the United States by 12
202202 such airline. 13
203203 ‘‘(7) R
204204 ULE OF CONSTRUCTION .—Nothing in 14
205205 this subsection may be construed as authorizing the 15
206206 President, the Secretary of State, or the Secretary 16
207207 of Homeland Security to act in a manner incon-17
208208 sistent with the policy decisions expressed in the im-18
209209 migration laws.’’. 19
210210 SEC. 4. VISA APPLICANTS REPORT. 20

212212 NITIALREPORTS.— 21

214214 N GENERAL.—Not later than 90 days after 22
215215 the date of the enactment of this Act, the Secretary 23
216216 of State, in coordination with the Secretary of 24
217217 Homeland Security and the heads of other relevant 25

222222 gressional committees referred to in section 2
223223 212(f)(3)(D) of the Immigration and Nationality 3
224224 Act, as amended by section 3, that describes the im-4
225225 plementation of Presidential Proclamations 9645, 5
226226 9822, and 9983 and Executive Order Nos. 13769, 6
227227 13780, and 13815, during the effective period of 7
228228 each such proclamation and order. 8
229229 (2) P
230230 RESIDENTIAL PROCLAMATIONS 9645 AND 9
231231 9983.—In addition to the content described in para-10
232232 graph (1), the report submitted with respect to Pres-11
233233 idential Proclamation 9645, issued on September 24, 12
234234 2017, and Presidential Proclamation 9983, issued 13
235235 on January 31, 2020, shall include, for each country 14
236236 listed in such proclamation— 15
237237 (A) the total number of individuals who 16
238238 applied for a visa during the period the procla-17
239239 mation was in effect, disaggregated by country 18
240240 and visa category; 19
241241 (B) the total number of visa applicants de-20
242242 scribed in subparagraph (A) who were ap-21
243243 proved, disaggregated by country and visa cat-22
244244 egory; 23
245245 (C) the total number of visa applicants de-24
246246 scribed in subparagraph (A) whose applications 25

256256 (E) the total number of visa applicants de-7
257257 scribed in subparagraph (A) who were granted 8
258258 a waiver, disaggregated by country and visa 9
259259 category; 10
260260 (F) the total number of visa applicants de-11
261261 scribed in subparagraph (A) who were denied a 12
262262 waiver, disaggregated by country and visa cat-13
263263 egory, and the reasons such waiver requests 14
264264 were denied; 15
265265 (G) the total number of refugees admitted, 16
266266 disaggregated by country; and 17
267267 (H) the complete reports that were sub-18
268268 mitted to the President every 180 days in ac-19
269269 cordance with section 4 of Presidential Procla-20
270270 mation 9645 in its original form, and as 21
271271 amended by Presidential Proclamation 9983. 22

286286 sional committees referred to in paragraph (3)(D) of 7
287287 such section 212(f) that identifies, with respect to 8
288288 countries affected by a suspension or restriction— 9
289289 (A) the information described in subpara-10
290290 graphs (A) through (G) of subsection (a)(2); 11
291291 and 12
292292 (B) the specific evidence supporting the 13
293293 need for the continued exercise of presidential 14
294294 authority under such section 212(f), including 15
295295 the information described in paragraph (3)(B) 16
296296 of such section 212(f). 17

298298 AILURE TO SUBMIT TIMELY REPORT .—If 18
299299 the Secretary of State fails to provide any report re-19
300300 quired under paragraph (1) to the appropriate con-20
301301 gressional committees by the specified deadline, the 21
302302 suspension or restriction of any aliens or class of 22
303303 aliens pursuant to such section 212(f) shall imme-23
304304 diately terminate absent intervening congressional 24
305305 action. 25

315315 pare and submit a final report to the congressional 7
316316 committees referred to in paragraph (3)(D) of such 8
317317 section containing the information and evidence de-9
318318 scribed in subparagraphs (A) and (B) of paragraph 10
