23	23	benefits and services for surviving spouses, and for other
24	24	purposes.
25	25	Be it enacted by the Senate and House of Representa-1
26	26	tives of the United States of America in Congress assembled, 2
27	27	SECTION 1. SHORT TITLE. 3
28	28	This Act may be cited as the ‘‘Love Lives On Act 4
29	29	of 2025’’. 5

37	37	Section 103(d) of title 38, United States Code, is 5
38	38	amended— 6
39	39	(1) in paragraph (2)(B)— 7
40	40	(A) by inserting ‘‘(i)’’ before ‘‘The remar-8
41	41	riage’’; 9
42	42	(B) in clause (i), as designated by subpara-10
43	43	graph (A), by striking ‘‘Notwithstanding the 11
44	44	previous sentence’’ and inserting the following: 12
45	45	‘‘(ii) Notwithstanding clause (i)’’; and 13
46	46	(C) by adding at the end the following new 14
47	47	clause: 15
48	48	‘‘(iii) Notwithstanding clause (ii), the remarriage of 16
49	49	a surviving spouse shall not bar the furnishing of benefits 17
50	50	under section 1311 or 1562 of this title to the surviving 18
51	51	spouse of a veteran.’’; and 19
52	52	(2) in paragraph (5)— 20
53	53	(A) by striking subparagraph (A); and 21
54	54	(B) by renumbering subparagraphs (B) 22
55	55	through (E) as subparagraphs (A) through (D), 23
56	56	respectively. 24

63	63	Section 1450(b)(2) of title 10, United States Code, 4
64	64	is amended— 5
65	65	(1) by striking ‘‘An annuity’’ and inserting the 6
66	66	following: 7
67	67	‘‘(A) I
68	68	N GENERAL.—(A) Subject to sub-8
69	69	paragraph (B), an annuity’’; and 9
70	70	(2) by adding at the end the following new sub-10
71	71	paragraph: 11
72	72	‘‘(B) T
73	73	REATMENT OF SURVIVORS OF MEM -12
74	74	BERS WHO DIE ON ACTIVE DUTY .—The Sec-13
75	75	retary may not terminate payment of an annu-14
76	76	ity for a surviving spouse described in subpara-15
77	77	graph (A) or (B) of section 1448(d)(1) solely 16
78	78	because that surviving spouse remarries. In the 17
79	79	case of a surviving spouse who remarried before 18
80	80	reaching age 55 and before the date of the en-19
81	81	actment of Love Lives On Act of 2025, the Sec-20
82	82	retary shall resume payment of the annuity to 21
83	83	that surviving spouse— 22
84	84	‘‘(i) except as provided by clause (ii), 23
85	85	for each month that begins on or after the 24
86	86	date that is one year after such date of en-25
87	87	actment; or 26

92	92	month beginning after such date of enact-2
93	93	ment, in the case of a surviving spouse 3
94	94	who elected to transfer payment of that 4
95	95	annuity to a surviving child or children 5
96	96	under the provisions of section 6
97	97	1448(d)(2)(B) of title 10, United States 7
98	98	Code, as in effect on December 31, 2019.’’. 8
99	99	SEC. 4. EXPANSION OF DEFINITION OF DEPENDENT UNDER 9
100	100	TRICARE PROGRAM TO INCLUDE A REMAR-10
101	101	RIED WIDOW OR WIDOWER WHOSE SUBSE-11
102	102	QUENT MARRIAGE HAS ENDED. 12
103	103	Section 1072(2) of title 10, United States Code, is 13
104	104	amended— 14
105	105	(1) in subparagraph (H), by striking ‘‘; and’’ 15
106	106	and inserting a semicolon; 16
107	107	(2) in subparagraph (I)(v), by striking the pe-17
108	108	riod at the end and inserting ‘‘; and’’; and 18
109	109	(3) by adding at the end the following new sub-19
110	110	paragraph: 20
111	111	‘‘(J) a remarried widow or widower whose 21
112	112	subsequent marriage has ended due to death, 22
113	113	divorce, or annulment.’’. 23
