1717 tives of the United States of America in Congress assembled, 2
1818 SECTION 1. SHORT TITLE. 3
1919 This Act may be cited as the ‘‘Advancing Digital Sup-4
2020 port for Mental Health Services Act’’ or the ‘‘ADS for 5
2121 Mental Health Services Act’’. 6

2727 (a) I
2828 NGENERAL.—A covered digital advertising plat-3
2929 form shall submit to the Commission an annual report 4
3030 that includes the following: 5
3131 (1) The number and percentage of total adver-6
3232 tisements on the platform during the previous 12- 7
3333 month period that were public service advertise-8
3434 ments. 9
3535 (2) The estimated dollar value of such public 10
3636 service advertisements. 11
3737 (3) The number of such public service adver-12
3838 tisements that focus on local or regional mental, be-13
3939 havioral, and physical health care resources. 14
4040 (4) The number of such public service adver-15
4141 tisements that promote free mental, behavioral, or 16
4242 physical health care resources. 17
4343 (5) A description of how such advertisements 18
4444 meet the definition of a public service advertisement 19
4545 as described in subsection (c)(3). 20

4747 EPORT TOCONGRESS.—Not later than 180 days 21
4848 after receiving the reports required under subsection (a), 22
4949 and annually thereafter, the Commission shall submit to 23
5050 the Committee on Commerce, Science, and Transportation 24
5151 of the Senate and the Committee on Energy and Com-25
5252 merce of the House of Representatives a publicly available 26

5959 EFINITIONS.—In this Act: 3

6161 OMMISSION.—The term ‘‘Commission’’ 4
6262 means the Federal Trade Commission. 5

6464 UBLIC SERVICE ADVERTISEMENT .—The 6
6565 term ‘‘public service advertisement’’ means an adver-7
6666 tisement that— 8
6767 (A) a covered digital advertising platform 9
6868 displays for free and without receiving any pay-10
6969 ment or other consideration in exchange; 11
7070 (B) promotes mental, behavioral, or phys-12
7171 ical health care resources, and may include ad-13
7272 vertisements that— 14
7373 (i) raise awareness of community 15
7474 events to address social isolation; or 16
7575 (ii) promote State, local, or regional 17
7676 mental health care resources that are ap-18
7777 proved by the Substance Abuse and Mental 19
7878 Health Services Administration that miti-20
7979 gate— 21
8080 (I) self-harm, suicide, eating dis-22
8181 orders, substance abuse, and other 23
8282 matters that pose a risk to physical 24
8383 and mental health; 25

9090 (C) is relevant and accessible to targeted 4

9393 OVERED DIGITAL ADVERTISING PLAT -6
9494 FORM.—The term ‘‘covered digital advertising plat-7
9595 form’’ means a social media platform, search engine, 8
9696 or other public-facing website, online service, or ap-9
9797 plication that— 10
9898 (A) sells digital advertising space; and 11
9999 (B) has more than 100,000,000 unique 12
100100 monthly users. 13

102102 ELATIONSHIP TO OTHERLAWS.—Nothing in 14
103103 this Act shall be construed to supersede any applicable pri-15
104104 vacy or data security laws. 16
