2323 This Act may be cited as the ‘‘Situational Awareness 4
2424 of Flying Elements in Orbit Act’’ or the ‘‘SAFE Orbit 5

3131 (a) I
3232 NGENERAL.—The Secretary of Commerce shall 3
3333 facilitate safe operations in space and encourage the devel-4
3434 opment of commercial space capabilities by acquiring and 5
3535 disseminating unclassified data, analytics, information, 6
3636 and services on space activities. 7
3737 (b) I
3838 MMUNITY.—The United States, any agencies and 8
3939 instrumentalities thereof, and any individuals, firms, cor-9
4040 porations, and other persons acting for the United States 10
4141 Government, including nongovernmental entities, shall be 11
4242 immune from any suit in any court for any cause of action 12
4343 arising from the provision or receipt of space situational 13
4444 awareness services or information, whether or not pro-14
4545 vided in accordance with this section, or any related action 15
4646 or omission. 16
4747 (c) A
4848 CQUISITION OFDATA.—The Assistant Secretary 17
4949 of Commerce for Space Commerce (established under sec-18
5050 tion 50702(b) of title 51, United States Code, as amended 19
5151 by section 3) is authorized to acquire— 20
5252 (1) data, analytics, information, and services, 21
5353 including with respect to— 22
5454 (A) location tracking data; 23
5555 (B) positional and orbit determination in-24
5656 formation; and 25
5757 (C) conjunction data messages; and 26

6565 ATABASE ONSATELLITELOCATION ANDBE-4
6666 HAVIOR.—The Assistant Secretary of Commerce for Space 5
6767 Commerce shall provide access for the public, at no 6
6868 charge, a fully updated, unclassified database of informa-7
6969 tion concerning space objects and behavior that includes— 8
7070 (1) the data and information acquired under 9
7171 subsection (c), except to the extent that such data 10
7272 or information is classified or a trade secret (as de-11
7373 fined in section 1839 of title 18, United States 12
7474 Code); and 13
7575 (2) the provision of basic space situational 14
7676 awareness services and space traffic coordination 15
7777 based on the data referred to in paragraph (1), in-16
7878 cluding basic analytics, tracking calculations, and 17
7979 conjunction data messages. 18

8282 ICES.—The Assistant Secretary of Commerce for Space 20

8484 (1) shall provide to satellite operators, at no 22
8585 charge, basic space situational awareness services, 23
8686 including the data, analytics, information, and serv-24
8787 ices described in subsection (c); 25

9393 ness products, to the maximum extent practicable; 3

9595 (3) not less frequently than every 3 years, shall 5
9696 review the basic space situational awareness services 6
9797 described in paragraph (1) to ensure that such serv-7
9898 ices provided by the Federal Government do not 8
9999 compete with space situational awareness services of-9
100100 fered by the private sector. 10

102102 EQUIREMENTS FOR DATAACQUISITION AND 11

104104 ISSEMINATION.—In acquiring data, analytics, informa-12
105105 tion, and services under subsection (c) and disseminating 13
106106 data, analytics, information, and services under sub-14
107107 sections (d) and (e), the Assistant Secretary of Commerce 15
108108 for Space Commerce shall— 16
109109 (1) leverage commercial capabilities to the max-17
110110 imum extent practicable; 18
111111 (2) prioritize the acquisition of data, analytics, 19
112112 information, and services from commercial industry 20
113113 located in or licensed in the United States to supple-21
114114 ment data collected by United States Government 22
115115 agencies, including the Department of Defense and 23
116116 the National Aeronautics and Space Administration; 24

122122 United States, including by using appropriate infra-3
123123 structure and cybersecurity measures, including 4
124124 measures set forth in the most recent version of the 5
125125 Cybersecurity Framework, or successor document, 6
126126 maintained by the National Institute of Standards 7
127127 and Technology; 8
128128 (4) facilitate the development of standardization 9
129129 and consistency in data reporting, in collaboration 10
130130 with satellite owners and operators, commercial 11
131131 space situational awareness data and service pro-12
132132 viders, the academic community, nonprofit organiza-13
133133 tions, and the Director of the National Institute of 14
134134 Standards and Technology; and 15
135135 (5) encourage foreign governments to partici-16
136136 pate in unclassified data sharing arrangements for 17
137137 space situational awareness and space traffic coordi-18
138138 nation. 19

140140 THERTRANSACTIONAUTHORITY.—In carrying 20
141141 out the activities required by this section, the Secretary 21
142142 of Commerce shall enter into such contracts, leases, coop-22
143143 erative agreements, or other transactions as may be nec-23
144144 essary. 24

223223 end the following: ‘‘, which, not later than 5 years after 10
224224 the date of the enactment of this Act, shall be elevated 11
225225 by the Secretary of Commerce from an office within the 12
226226 National Oceanic and Atmospheric Administration to a 13
227227 bureau reporting directly to the Office of the Secretary 14

292292 tion and continuity of operations plans for the func-14
293293 tional and administrative transfer of the Office of 15
294294 Space Commerce from the National Oceanic and At-16
295295 mospheric Administration to a bureau reporting to 17
296296 the Office of the Secretary of Commerce. 18

298298 OAL.—The goal of transition and con-19
299299 tinuity of operations planning shall be to minimize 20
300300 the cost and administrative burden of establishing 21
301301 the Bureau of Space Commerce while maximizing 22
302302 the efficiency and effectiveness of the functions and 23
303303 responsibilities of the Bureau of Space Commerce, in 24
