To amend the Family and Medical Leave Act of 1993 and title 5, United 
States Code, to permit leave to care for a domestic partner, parent- 
in-law, or adult child, or another related individual, who has a serious 
health condition, and to allow employees to take, as additional leave, 
parental involvement and family wellness leave to participate in or attend 
their children’s and grandchildren’s educational and extracurricular ac-
tivities or meet family care needs.

A BILL 
To amend the Family and Medical Leave Act of 1993 and 
title 5, United States Code, to permit leave to care 
for a domestic partner, parent-in-law, or adult child, 
or another related individual, who has a serious health 
condition, and to allow employees to take, as additional 
leave, parental involvement and family wellness leave to 
participate in or attend their children’s and grand-
children’s educational and extracurricular activities or 
meet family care needs.

Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Caring for All Families 4
Act’’. 5
SEC. 2. LEAVE TO CARE FOR A DOMESTIC PARTNER, SON- 6
IN-LAW, DAUGHTER-IN-LAW, PARENT-IN-LAW, 7
ADULT CHILD, GRANDPARENT, GRANDCHILD, 8
OR SIBLING OF THE EMPLOYEE, OR AN-9
OTHER RELATED INDIVIDUAL. 10
(a) D
EFINITIONS.— 11
(1) I
NCLUSION OF RELATED INDIVIDUALS .— 12
Section 101 of the Family and Medical Leave Act of 13
1993 (29 U.S.C. 2611) is amended by adding at the 14
end the following: 15
‘‘(20) A
NY OTHER INDIVIDUAL WHOSE CLOSE 16
ASSOCIATION IS THE EQUIVALENT OF A FAMILY RE -17
LATIONSHIP.—The term ‘any other individual whose 18
close association is the equivalent of a family rela-19
tionship’, used with respect to an employee or a cov-20
ered servicemember, means any person with whom 21
the employee or covered servicemember, as the case 22
may be, has a significant personal bond that is or 23
is like a family relationship, regardless of biological 24
or legal relationship. 25

‘‘(21) DOMESTIC PARTNER.—The term ‘domes-1
tic partner’, used with respect to an employee or a 2
covered servicemember, means— 3
‘‘(A) the person recognized as the domestic 4
partner of the employee or covered servicemem-5
ber under any domestic partnership or civil 6
union law of a State or political subdivision of 7
a State; or 8
‘‘(B) in the case of an unmarried employee 9
or covered servicemember, an unmarried adult 10
person who is in a committed, personal relation-11
ship with the employee or covered servicemem-12
ber, is not a domestic partner as described in 13
subparagraph (A) to or in such a relationship 14
with any other person, and who is designated to 15
the employer by such employee or covered serv-16
ice member as the domestic partner of that em-17
ployee or covered servicemember. 18
‘‘(22) G
RANDCHILD.—The term ‘grandchild’, 19
used with respect to an employee or a covered serv-20
icemember, means the son or daughter of a son or 21
daughter of the employee or covered service member. 22
‘‘(23) G
RANDPARENT.—The term ‘grand-23
parent’, used with respect to an employee or a cov-24

‘‘(24) N
EPHEW; NIECE.—The terms ‘nephew’ 3
and ‘niece’, used with respect to an employee or a 4
covered servicemember, mean a son or daughter of 5
the sibling of the employee or covered service mem-6
ber. 7
‘‘(25) P
ARENT-IN-LAW.— The term ‘parent-in- 8
law’, used with respect to an employee or a covered 9
servicemember, means a parent of the spouse or do-10
mestic partner of the employee or covered service 11
member. 12
‘‘(26) S
IBLING.—The term ‘sibling’, used with 13
respect to an employee or a covered servicemember, 14
means any person who is a son or daughter of par-15
ent of the employee or covered service member 16
(other than the employee or covered servicemember). 17
‘‘(27) S
ON-IN-LAW; DAUGHTER-IN-LAW.—The 18
terms ‘son-in-law’ and ‘daughter-in-law’, used with 19
respect to an employee or a covered servicemember, 20
mean any person who is a spouse or domestic part-21
ner of a son or daughter, as the case may be, of the 22
employee or covered service member. 23
‘‘(28) U
NCLE; AUNT.—The terms ‘uncle’ and 24
‘aunt’, used with respect to an employee or a covered 25

servicemember, mean the son or daughter, as the 1
case may be, of the grandparent of the employee or 2
covered servicemember (other than the parent of the 3
employee or covered service member).’’. 4
(2) I
NCLUSION OF ADULT CHILDREN AND CHIL -5
DREN OF A DOMESTIC PARTNER .—Section 101(12) 6
of such Act (29 U.S.C. 2611(12)) is amended— 7
(A) by inserting ‘‘a child of an individual’s 8
domestic partner,’’ after ‘‘a legal ward,’’; and 9
(B) by striking ‘‘who is—’’ and all that 10
follows and inserting ‘‘and includes an adult 11
child.’’. 12
(b) L
EAVEREQUIREMENT.—Section 102 of the Fam-13
ily and Medical Leave Act of 1993 (29 U.S.C. 2612) is 14
amended— 15
(1) in subsection (a)— 16
(A) in paragraph (1)— 17
(i) in subparagraph (C), by striking 18
‘‘spouse, or a son, daughter, or parent, of 19
the employee, if such spouse, son, daugh-20
ter, or parent’’ and inserting ‘‘spouse or 21
domestic partner, or a son or daughter, 22
son-in-law or daughter-in-law, parent, par-23
ent-in-law, grandparent, grandchild, sib-24
ling, uncle or aunt, or nephew or niece of 25

in-law or daughter-in-law, parent, parent- 13
in-law, grandchild, sibling, uncle or aunt, 14
or nephew or niece of the employee, or any 15
other individual whose close association is 16

inserting ‘‘son or daughter, son-in-law or 8
daughter-in-law, spouse or domestic partner, 9
parent, parent-in-law, grandparent, grandchild, 10
sibling, uncle or aunt, nephew or niece, or cov-11
ered servicemember of the employee, or any 12
other individual whose close association is the 13
equivalent of a family relationship with the em-14
ployee, as appropriate’’; and 15
(B) in paragraph (3), by striking ‘‘spouse, 16

(c) C
ERTIFICATION.—Section 103 of the Family and 10
Medical Leave Act of 1993 (29 U.S.C. 2613) is amend-11
ed— 12
(1) in subsection (a), by striking ‘‘son, daugh-13
ter, spouse, or parent of the employee, or of the next 14
of kin of an individual in the case of leave taken 15
under such paragraph (3), as appropriate’’ and in-16
serting ‘‘son or daughter, son-in-law or daughter-in- 17
law, spouse or domestic partner, parent, parent-in- 18
law, grandparent, grandchild, sibling, uncle or aunt, 19
or nephew or niece of the employee, or the next of 20
kin of an individual, or any other individual whose 21
close association is the equivalent of a family rela-22
tionship with the employee, as appropriate’’; and 23
(2) in subsection (b)— 24

the amount of time that such employee is need-3
ed to care for the son, daughter, spouse, or par-4
ent’’ and inserting ‘‘son or daughter, son-in-law 5
or daughter-in-law, spouse or domestic partner, 6
parent, parent-in-law, grandparent, grandchild, 7
sibling, uncle or aunt, or nephew or niece of the 8
employee, or any other individual whose close 9

an estimate of the amount of time that such 12
employee is needed to care for such son or 13
daughter, son-in-law or daughter-in-law, spouse 14

or nephew or niece, or such other individual’’; 17
and 18
(B) in paragraph (7), by striking ‘‘son, 19
daughter, parent, or spouse who has a serious 20
health condition, or will assist in their recov-21
ery,’’ and inserting ‘‘son or daughter, son-in-law 22
or daughter-in-law, spouse or domestic partner, 23
parent, parent-in-law, grandparent, grandchild, 24
sibling, uncle or aunt, or nephew or niece, with 25

an individual, with a serious health condition, 2
who is any other individual whose close associa-3
tion is the equivalent of a family relationship 4
with the employee, as appropriate, or will assist 5
in the recovery,’’. 6
(d) E
MPLOYMENT AND BENEFITSPROTECTION.— 7
Section 104(c)(3) of the Family and Medical Leave Act 8
of 1993 (29 U.S.C. 2614(c)(3)) is amended— 9
(1) in subparagraph (A)(i), by striking ‘‘son, 10
daughter, spouse, or parent of the employee, as ap-11
propriate,’’ and inserting ‘‘son or daughter, son-in- 12
law or daughter-in-law, spouse or domestic partner, 13
parent, parent-in-law, grandparent, grandchild, sib-14
ling, uncle or aunt, or nephew or niece of the em-15
ployee, or any other individual whose close associa-16
tion is the equivalent of a family relationship with 17
the employee, as appropriate,’’; and 18
(2) in subparagraph (C)(ii), by striking ‘‘son, 19
daughter, spouse, or parent’’ and inserting ‘‘employ-20
ee’s son or daughter, son-in-law or daughter-in-law, 21
spouse or domestic partner, parent, parent-in-law, 22
grandparent, grandchild, sibling, uncle or aunt, or 23
nephew or niece, or (with relation to the employee) 24

SEC. 3. LEAVE TO CARE FOR A DOMESTIC PARTNER, SON- 3
IN-LAW, DAUGHTER-IN-LAW, PARENT-IN-LAW, 4
ADULT CHILD, GRANDPARENT, GRANDCHILD, 5
OR SIBLING OF THE EMPLOYEE, OR AN-6
OTHER RELATED INDIVIDUAL FOR FEDERAL 7
EMPLOYEES. 8
(a) D
EFINITIONS.— 9
(1) I

tionship’, used with respect to an employee or a cov-24

‘‘(16) the term ‘grandparent’, used with respect 3

‘‘(17) the terms ‘nephew’ and ‘niece’, used with 7
respect to an employee or a covered servicemember, 8
mean a son or daughter of the sibling of the em-9
ployee or covered service member; 10
‘‘(18) the term ‘parent-in-law’, used with re-11
spect to an employee or a covered servicemember, 12
means a parent of the spouse or domestic partner of 13
the employee or covered service member; 14
‘‘(19) the term ‘sibling’, used with respect to an 15
employee or a covered servicemember, means any 16
person who is a son or daughter of parent of the em-17
ployee or covered service member (other than the 18
employee or covered servicemember); 19
‘‘(20) the terms ‘son-in-law’ and ‘daughter-in- 20
law’, used with respect to an employee or a covered 21
servicemember, mean any person who is a spouse or 22
domestic partner of a son or daughter, as the case 23
may be, of the employee or covered service member; 24

‘‘(21) the term ‘State’ has the same meaning 1
given the term in section 3 of the Fair Labor Stand-2
ards Act of 1938 (29 U.S.C. 203); and 3
‘‘(22) terms ‘uncle’ and ‘aunt’, used with re-4
spect to an employee or a covered servicemember, 5
mean the son or daughter, as the case may be, of 6
the grandparent of the employee or covered service-7
member (other than the parent of the employee or 8
covered service member).’’. 9
(2) I
NCLUSION OF ADULT CHILDREN AND CHIL -10
DREN OF A DOMESTIC PARTNER .—Section 6381(6) 11
of such title is amended— 12
(A) by inserting ‘‘a child of an individual’s 13
domestic partner,’’ after ‘‘a legal ward,’’; and 14
(B) by striking ‘‘who is—’’ and all that 15
follows and inserting ‘‘and includes an adult 16
child’’. 17
(b) L
EAVEREQUIREMENT.—Section 6382 of title 5, 18
United States Code, is amended— 19
(1) in subsection (a)— 20
(A) in paragraph (1)— 21

SEC. 4. ENTITLEMENT TO ADDITIONAL LEAVE UNDER THE 6
FMLA FOR PARENTAL INVOLVEMENT AND 7
FAMILY WELLNESS. 8
(a) L
EAVEREQUIREMENT.—Section 102(a) of the 9
Family and Medical Leave Act of 1993 (29 U.S.C. 10
2612(a)), as amended by section 2(b), is further amend-11
ed— 12
(1) by redesignating paragraph (5) as para-13
graph (6); and 14
(2) by inserting after paragraph (4) the fol-15
lowing new paragraph: 16
‘‘(5) E
NTITLEMENT TO ADDITIONAL LEAVE FOR 17
PARENTAL INVOLVEMENT AND FAMILY 18
WELLNESS.— 19
‘‘(A) I
N GENERAL.—Subject to subpara-20
graph (B) and section 103(g), an eligible em-21
ployee shall be entitled to leave under this para-22
graph to— 23
‘‘(i) participate in or attend an activ-24

The term ‘community organization’ means 8
a private nonprofit organization that is 9
representative of a community or a signifi-10
cant segment of a community and provides 11
activities for individuals described in sec-12
tion 101(12), such as a scouting or sports 13
organization. 14
‘‘(ii) S
CHOOL.—The term ‘school’ 15
means an elementary school or secondary 16
school (as such terms are defined in sec-17
tion 8101 of the Elementary and Sec-18
ondary Education Act of 1965 (20 U.S.C. 19
7801)), a Head Start program assisted 20
under the Head Start Act (42 U.S.C. 9831 21
et seq.), and a child care facility licensed 22
under State law.’’. 23
(b) S
CHEDULE.—Section 102(b)(1) of such Act (29 24
U.S.C. 2612(b)(1)) is amended by inserting after the third 25

UBSTITUTION OF PAIDLEAVE.—Section 5
102(d)(2) of such Act (29 U.S.C. 2612(d)(2)) is amended 6
by adding at the end the following new subparagraph: 7
‘‘(C) P
ARENTAL INVOLVEMENT LEAVE AND 8
FAMILY WELLNESS LEAVE .— 9
‘‘(i) V
ACATION LEAVE ; PERSONAL 10
LEAVE; FAMILY LEAVE.—An eligible em-11
ployee may elect, or an employer may re-12
quire the employee, to substitute any of 13
the accrued paid vacation leave, personal 14
leave, or family leave of the employee for 15
any part of the period of leave under sub-16
section (a)(5). 17
‘‘(ii) M
EDICAL OR SICK LEAVE .—An 18
eligible employee may elect, or an employer 19
may require the employee, to substitute 20
any of the accrued paid medical or sick 21
leave of the employee for any part of the 22
period of leave provided under clause (ii) of 23
subsection (a)(5)(A), except that nothing 24
in this title shall require an employer to 25

provide paid sick leave or paid medical 1
leave in any situation in which such em-2
ployer would not normally provide any 3
such paid leave. 4
‘‘(iii) P
ROHIBITION ON RESTRICTIONS 5
AND LIMITATIONS.—If the employee elects 6
or the employer requires the substitution 7
of accrued paid leave for leave under sub-8
section (a)(5), the employer shall not re-9
strict or limit the leave that may be sub-10
stituted or impose any additional terms 11
and conditions on the substitution of such 12
leave that are more stringent for the em-13
ployee than the terms and conditions set 14
forth in this Act.’’. 15
(d) N
OTICE.—Section 102(e) of such Act (29 U.S.C. 16
2612(e)), as amended by section 2(b), is further amended 17
by adding at the end the following new paragraph: 18

fort to schedule the activity or care involved so 6
as not to disrupt unduly the operations of the 7
employer, subject to the approval of the health 8
care provider involved (if any).’’. 9
(e) C
ERTIFICATION.—Section 103 of such Act (29 10
U.S.C. 2613) is amended by adding at the end the fol-11
lowing new subsection: 12
‘‘(g) C
ERTIFICATIONRELATED TOPARENTALIN-13
VOLVEMENT AND FAMILYWELLNESSLEAVE.—An em-14
ployer may require that a request for leave under section 15
102(a)(5) be supported by a certification issued at such 16
time and in such manner as the Secretary may by regula-17
tion prescribe.’’. 18
SEC. 5. ENTITLEMENT OF FEDERAL EMPLOYEES TO LEAVE 19
FOR PARENTAL INVOLVEMENT AND FAMILY 20

‘‘(3) An employee may elect to substitute for any part 8
of the period of leave under subsection (a)(5), any of the 9
employee’s accrued or accumulated annual or sick leave. 10
If the employee elects the substitution of that accrued or 11
accumulated annual or sick leave for leave under sub-12
section (a)(5), the employing agency shall not restrict or 13
limit the leave that may be substituted or impose any addi-14
tional terms and conditions on the substitution of such 15
leave that are more stringent for the employee than the 16
terms and conditions set forth in this subchapter.’’. 17
