A BILL
To amend title XIX of the Social Security Act to establish
a minimum Medicaid disproportionate share hospital al-
lotment for States.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Fair Funding for 4
Rural Hospitals Act’’. 5
SEC. 2. MINIMUM MEDICAID DSH ALLOTMENT. 6
Section 1923(f)(6) of the Social Security Act (42 7
U.S.C. 1396r–4(f)(6)) is amended by adding at the end 8
the following new subparagraph: 9

‘‘(C) MINIMUM DSH ALLOTMENT FOR FIS -1
CAL YEARS AFTER 2024.— 2
‘‘(i) I
N GENERAL.—Notwithstanding 3
the table set forth in paragraph (2) or the 4
reductions required under paragraph (7), 5
for fiscal year 2025 and each succeeding 6
fiscal year, the DSH allotment for any 7
State shall not be less than the minimum 8
DSH allotment amount established for the 9
fiscal year under clause (ii). 10
‘‘(ii) M
INIMUM DSH ALLOTMENT 11
AMOUNT.—The minimum DSH allotment 12
amount established under this clause— 13
‘‘(I) for each of fiscal years 2025 14
through 2029, shall be equal to 15
$20,000,000; and 16
‘‘(II) for fiscal year 2030 and 17
each succeeding fiscal year, shall be 18
equal to the minimum DSH allotment 19
amount established under this clause 20
for the preceding fiscal year, subject 21
to an increase for inflation as pro-22
vided in paragraph (3)(A).’’. 23
