2121 SECTION 1. SHORT TITLE. 3
2222 This Act may be cited as the ‘‘Denying Earnings to 4
2323 the Military Oligarchy in Cuba and Restricting Activities 5
2424 of the Cuban Intelligence Apparatus Act’’ or the 6
2525 ‘‘DEMOCRACIA Act’’. 7

2929 SEC. 2. FINDINGS; SENSE OF CONGRESS. 1

3131 INDINGS.—Congress finds the following: 2
3232 (1) The Cuban Communist takeover of 1959 es-3
3333 tablished in Cuba a one-party authoritarian state of 4
3434 the Cuban Communist Party. 5
3535 (2) Cuba is a totalitarian state, in which the 6
3636 Cuban Communist Party has brutally oppressed the 7
3737 people of Cuba for more than 60 years. 8
3838 (3) Cuban democracy activists, including Las 9
3939 Damas de Blanco (also known as ‘‘Ladies in 10
4040 White’’), a group composed of wives and relatives of 11
4141 political prisoners, prisoners of conscience, and 12
4242 peaceful activists in Cuba, are routinely repressed, 13
4343 censured, beaten, and unjustly imprisoned by the 14
4444 Cuban Communist Party. 15
4545 (4) On July 11, 2021, protesters marched in 16
4646 the streets throughout Cuba voicing their opposition 17
4747 against the communist regime of Cuba. 18
4848 (5) During those protests, Cubans in more than 19
4949 40 cities held demonstrations chanting ‘‘Freedom!’’, 20
5050 ‘‘Down with the Dictatorship!’’, and ‘‘Patria y Vida’’ 21
5151 (‘‘Homeland and Life’’). 22
5252 (6) Through those protests, the people of Cuba 23
5353 demanded the end to communism in Cuba and ac-24
5454 cess to food, medicine, water, and electricity, basic 25

6060 (7) Cubans gathered outside of the head-3
6161 quarters of the Cuban Communist Party chanting, 4
6262 ‘‘Cuba isn’t yours!’’. In a clear message, Cubans ex-5
6363 ercised their fundamental God-given rights to peace-6
6464 ably assemble, express their political opinions, and 7
6565 live free of censorship and oppression and demanded 8
6666 the ruling elites, especially the Cuban Communist 9
6767 Party, release its control of their government and 10
6868 give the power back to the people. 11
6969 (8) During the July 11, 2021, protests, the 12
7070 Cuban Communist Party deployed a wave of terror 13
7171 throughout Cuba by— 14
7272 (A) unleashing its secret police and some 15
7373 military forces on peaceful protesters and un-16
7474 lawfully detained them, including by— 17
7575 (i) harassing and threatening people 18
7676 in their homes; 19
7777 (ii) abducting and torturing civil soci-20
7878 ety leaders and other Cubans peacefully 21
7979 exercising their fundamental rights; and 22
8080 (iii) detaining more than 800 Cubans 23
8181 for peacefully protesting, who have gone 24
8282 missing since the protests and demonstra-25

8787 civil society groups such as UNPACU, the 2
8888 San Isidro Movement, the Ladies in White, 3
8989 and religious leaders; and 4
9090 (B) in a crude and savage effort to silence 5
9191 the Cuban people, cutting internet connectivity 6
9292 and mobile services throughout Cuba, which 7
9393 prevented the Cuban people from organizing 8
9494 and hid from the outside world images and vid-9
9595 eos of the oppressive and brutal crackdown by 10
9696 the Government of Cuba. 11
9797 (9) In response to these demonstrations and 12
9898 protests, the regime blocked access to social media, 13
9999 messaging platforms and cellular services, and ar-14
100100 rested and detained hundreds of protesters, activists, 15
101101 and journalists, according to Cuban human rights 16
102102 groups. 17
103103 (10) The Human Rights Report on Cuba for 18
104104 2020 set forth by the Department of State found 19
105105 that Cuba is an authoritarian state. 20
106106 (11) A new constitution ratified in February 21
107107 2019 codified that Cuba remains a one-party system 22
108108 in which the Cuban Communist Party is the only 23
109109 legal political party. Elections in Cuba were neither 24
110110 free, fair, nor competitive. 25

115115 (MININT) controls police, internal security forces, 2
116116 and the prison system. The National Revolutionary 3
117117 Police are the primary law enforcement organization 4
118118 of the Ministry. Specialized units of the state secu-5
119119 rity branch of the Ministry are responsible for moni-6
120120 toring, infiltrating, and suppressing independent po-7
121121 litical activity. The national leadership of Cuba, in-8
122122 cluding members of the military, maintain effective 9
123123 control over the security forces. Members of the se-10
124124 curity forces have committed numerous abuses. 11
125125 (13) Significant human rights issues in Cuba 12
126126 include the following: 13
127127 (A) Unlawful or arbitrary killings by the 14
128128 Government of Cuba, including extrajudicial 15
129129 killings. 16
130130 (B) Forced disappearances by the Govern-17
131131 ment of Cuba. 18
132132 (C) Torture and cruel, inhuman, and de-19
133133 grading treatment of political dissidents, detain-20
134134 ees, and prisoners by security forces. 21
135135 (D) Harsh and life-threatening prison con-22
136136 ditions. 23
137137 (E) Arbitrary arrests and detentions. 24
138138 (F) The detaining of political prisoners. 25

181181 national Religious Freedom recommended in its 12
182182 2021 Annual Report that the United States Govern-13
183183 ment again place Cuba on the special watch list 14
184184 under section 402(b)(1)(A)(iii) of the International 15
185185 Religious Freedom Act of 1998 (22 U.S.C. 16
186186 6442(b)(1)(A)(iii)) and recommended imposing sanc-17
187187 tions on the Office of Religious Affairs of Cuba. 18
188188 (16) In the report specified in paragraph (15), 19

190190 gious Freedom raised concerns regarding the denial 21
191191 in Cuba of religious freedom for human rights activ-22
192192 ists, independent journalists, and protesters, particu-23

210210 (19) The Trade Sanctions Reform and Export 14
211211 Enhancement Act of 2000 (22 U.S.C. 7201 et seq.) 15

213213 ricultural or medical sanctions against Cuba. 17

239239 (25) On May 14, 2021, Secretary of State 13
240240 Antony Blinken determined and certified to Con-14
241241 gress that Cuba is not cooperating fully with United 15
242242 States antiterrorism efforts. 16
243243 (26) The Cuban Communist Party continues to 17
244244 support international terrorist groups such as the 18
245245 Revolutionary Armed Forces of Colombia (FARC) 19
246246 and the National Liberation Army (ELN). 20
247247 (27) Commercial engagement with the defense, 21
248248 security, and intelligence sectors of Cuba empowers 22
249249 the human rights abuses, racism against Afro-Cu-23
250250 bans, and support for international terrorism by the 24
251251 Cuban Communist Party. 25

255255 (b) SENSE OFCONGRESS.—It is the sense of Con-1
256256 gress that Congress— 2
257257 (1) reaffirms subsection (a) of section 1704 of 3
258258 the Cuban Democracy Act of 1992 (22 U.S.C. 4
259259 6003), which states that the President should en-5
260260 courage foreign countries to restrict trade and credit 6
261261 relations with Cuba in a manner consistent with the 7
262262 purposes of that Act; and 8
263263 (2) urges the President to take immediate steps 9
264264 to apply the sanctions described in subsection (b)(1) 10
265265 of that section with respect to countries assisting 11
266266 Cuba. 12
267267 SEC. 3. STATEMENT OF POLICY. 13
268268 It shall be the policy of the United States— 14
269269 (1) to support the desire of the people of Cuba 15
270270 for freedom and democracy; and 16
271271 (2) to work with allies and the international 17
272272 community to seek to restrict and reduce the finan-18
273273 cial resources of the Cuban dictatorship, which sup-19
274274 ports terrorism and perpetrates injustice and human 20
275275 rights abuses against the Cuban people, that being 21
276276 the Cuban military, security, and intelligence sec-22
277277 tors. 23

282282 EIGN PERSONS THAT ENGAGE IN CERTAIN 2

285285 MPOSITION OFSANCTIONS.— 4
286286 (1) I
287287 N GENERAL.—The President shall impose 5
288288 the sanctions described in subsection (b) with re-6
289289 spect to a foreign person if the President determines 7
290290 that the foreign person, on or after the date of the 8
291291 enactment of this Act, knowingly engages in an ac-9
292292 tivity described in paragraph (2). 10
293293 (2) A
294294 CTIVITIES DESCRIBED.—Except as pro-11
295295 vided in paragraph (3), a foreign person engages in 12
296296 an activity described in this paragraph if the foreign 13
297297 person provides financial, material, or technological 14
298298 support to, or engages in a transaction with— 15
299299 (A) a covered sector of the Government of 16
300300 Cuba, or any entity or individual affiliated with 17
301301 such sector (including an immediate adult fam-18
302302 ily member of such individual); 19
303303 (B) an agency, instrumentality, or other 20
304304 entity owned by an entity that is part of or as-21
305305 sociated with a covered sector, entity, or indi-22
306306 vidual described in subparagraph (A) in a per-23
307307 centage share exceeding 25 percent; 24
308308 (C) an individual who is a senior official of 25
309309 a covered sector or entity described in subpara-26

337337 4301 et seq.) with respect to Cuba or any other 25

345345 XCEPTIONS.—The following activities en-4
346346 gaged in by a foreign person shall not be considered 5
347347 to be activities described in paragraph (2) for pur-6
348348 poses of imposing sanctions described in subsection 7
349349 (b) with respect to the person: 8
350350 (A) The sale of agricultural commodities, 9
351351 medicines, and medical devices sold to Cuba 10
352352 consistent with the Trade Sanctions Reform 11
353353 and Export Enhancement Act of 2000 (22 12
354354 U.S.C. 7201 et seq.). 13
355355 (B) A remittance to an immediate family 14
356356 member, other than— 15
357357 (i) an individual who is a high-level 16
358358 member of the Cuban Communist Party; 17
359359 or 18
360360 (ii) an individual who is an immediate 19
361361 family member of an individual described 20
362362 in clause (i). 21
363363 (C) A payment in furtherance of the lease 22
364364 agreement for, or other financial transactions 23
365365 necessary for maintenance and improvements 24
366366 of, the military base at Guantanamo Bay, 25

372372 (D) Assistance or support in furtherance 3
373373 of democracy-building efforts for Cuba de-4
374374 scribed in section 109 of the Cuban Liberty and 5
375375 Democratic Solidarity (LIBERTAD) Act of 6
376376 1996 (22 U.S.C. 6039). 7
377377 (E) Customary and routine financial trans-8
378378 actions necessary for the maintenance, improve-9
379379 ments, or regular duties of the United States 10
380380 Embassy in Havana, Cuba, including outreach 11
381381 to the pro-democracy opposition. 12
382382 (F) Accessing the internet or providing cel-13
383383 lular services if the internet and cellular serv-14
384384 ices have been restored, are without interference 15
385385 from the Cuban regime, and do not include any 16
386386 technology, services, or communications backed 17
387387 by the Communist Party of the People’s Repub-18
388388 lic of China. 19

390390 ENSE OF CONGRESS .—It is the sense of 20
391391 Congress that the President should, in making a de-21
392392 termination of whether a foreign person engages in 22
393393 an activity described in paragraph (2), consider the 23
394394 provision of loans, credits, or export credits by the 24
395395 person to be a form of significant financial, material, 25

402402 OVERED SECTOR DEFINED .—In this sub-3
403403 section, the term ‘‘covered sector’’ means— 4
404404 (A) the defense sector; 5
405405 (B) the security sector; 6
406406 (C) the intelligence sector; or 7
407407 (D) any other sector of the Government of 8
408408 Cuba beginning 15 days after the date on which 9
409409 the President certifies to Congress that such 10
410410 sector is involved in carrying out human rights 11
411411 abuses or providing support for international 12
412412 terrorism. 13

414414 ANCTIONSDESCRIBED.— 14

416416 N GENERAL.—The sanctions to be imposed 15
417417 with respect to a foreign person subject to sub-16
418418 section (a) are the following: 17
419419 (A) B
420420 LOCKING OF PROPERTY .—The Presi-18
421421 dent shall exercise all of the powers granted to 19
422422 the President under the International Emer-20
423423 gency Economic Powers Act (50 U.S.C. 1701 et 21
424424 seq.) and the Trading with the Enemy Act (50 22
425425 U.S.C. 4301 et seq.) to the extent necessary to 23
426426 block and prohibit all transactions in property 24
427427 and interests in property of the foreign person 25

445445 section (a)(2) is— 13
446446 (I) inadmissible to the United 14
447447 States; 15
448448 (II) ineligible to receive a visa or 16
449449 other documentation to enter the 17
450450 United States; and 18
451451 (III) otherwise ineligible to be 19
452452 admitted or paroled into the United 20
453453 States or to receive any other benefit 21
454454 under the Immigration and Nation-22
455455 ality Act (8 U.S.C. 1101 et seq.). 23

10121012 censored or blocked by the Government of Cuba. 17

10161016 agency task force established under paragraph (1) 20
10171017 shall submit to the President and the appropriate 21
