20 | 20 | | SEC. 2. AUTOMATIC CONTINUING APPROPRIATIONS. 6 |

---|
22 | 22 | | NGENERAL.—Chapter 13 of title 31, United 7 |

23 | 23 | | States Code, is amended by inserting after section 1310 8 |

---|
29 | 29 | | ‘‘(a)(1) On and after the first day of each fiscal year, 2 |
---|
30 | 30 | | if an appropriation Act for such fiscal year with respect 3 |
---|
31 | 31 | | to the account for a program, project, or activity has not 4 |
---|
32 | 32 | | been enacted and continuing appropriations are not in ef-5 |
---|
33 | 33 | | fect with respect to the program, project, or activity, there 6 |
---|
34 | 34 | | are appropriated, at the rate for operations specified in 7 |
---|
35 | 35 | | paragraph (2), such sums as may be necessary to continue 8 |
---|
36 | 36 | | the program, project, or activity if funds were provided 9 |
---|
37 | 37 | | for the program, project, or activity during the preceding 10 |
---|
38 | 38 | | fiscal year— 11 |
---|
39 | 39 | | ‘‘(A) in the corresponding appropriation Act for 12 |
---|
40 | 40 | | such preceding fiscal year; or 13 |
---|
41 | 41 | | ‘‘(B) if the corresponding appropriation bill for 14 |
---|
42 | 42 | | such preceding fiscal year did not become law, in a 15 |
---|
43 | 43 | | law making continuing appropriations for such pre-16 |
---|
44 | 44 | | ceding fiscal year. 17 |

45 | 45 | | ‘‘(2)(A) Subject to subparagraph (C), appropriations 18 |
---|
46 | 46 | | and funds made available, and authority granted, for a 19 |
---|
47 | 47 | | program, project, or activity for any fiscal year pursuant 20 |
---|
48 | 48 | | to this section shall be at a rate of operations not in excess 21 |
---|
49 | 49 | | of the lower of— 22 |
---|
50 | 50 | | ‘‘(i) 94 percent of the rate of operations pro-23 |
---|
51 | 51 | | vided for in the regular appropriation Act providing 24 |
---|
52 | 52 | | for such program, project, or activity for the pre-25 |
---|
53 | 53 | | ceding fiscal year; 26 |

63 | 63 | | ations provided for in the most recently enacted law 7 |

64 | 64 | | making continuing appropriations for part of that 8 |

65 | 65 | | fiscal year or any funding levels established under 9 |
---|
66 | 66 | | the provisions of this section, 10 |

67 | 67 | | for the period of 90 days. After the first 90-day period 11 |
---|
68 | 68 | | during which this subsection is in effect for that fiscal 12 |
---|
69 | 69 | | year, the applicable rate of operations shall be reduced by 13 |
---|
70 | 70 | | 1 percentage point. For each subsequent 90-day period 14 |
---|
71 | 71 | | during which this subsection is in effect for that fiscal 15 |
---|
72 | 72 | | year, the applicable rate of operations shall be reduced by 16 |
---|
73 | 73 | | 1 percentage point. The 90-day period reductions shall ex-17 |
---|
74 | 74 | | tend beyond the last day of that fiscal year. 18 |
---|
75 | 75 | | ‘‘(B) If this section is in effect at the end of a fiscal 19 |
---|
76 | 76 | | year, funding levels shall continue as provided in this sec-20 |
---|
77 | 77 | | tion for the next fiscal year. 21 |
---|
78 | 78 | | ‘‘(C) For entitlements and other mandatory pay-22 |

79 | 79 | | ments whose budget authority was provided for the pre-23 |
---|
80 | 80 | | vious fiscal year in appropriations Acts, under a law other 24 |

81 | 81 | | than this section providing continuing appropriations for 25 |

94 | 94 | | for the period beginning with the first day of a lapse in 10 |

95 | 95 | | appropriations and ending with the date on which the ap-11 |

96 | 96 | | plicable regular appropriation bill for such fiscal year be-12 |

97 | 97 | | comes law (whether or not such law provides for such pro-13 |
---|
98 | 98 | | gram, project, or activity) or a continuing resolution mak-14 |

100 | 100 | | ‘‘(4) During any period during which amounts are 16 |

103 | 103 | | amounts are being made available shall apportion such 19 |

104 | 104 | | amounts in the same proportion as amounts made avail-20 |

123 | 123 | | tries, grantees, or others, such high initial rates of oper-11 |
---|
124 | 124 | | ation or complete distribution shall not be made, and no 12 |
---|
125 | 125 | | grants shall be awarded for such programs, projects, or 13 |
---|
126 | 126 | | activities funded by this section that would impinge on 14 |
---|
127 | 127 | | final funding prerogatives. 15 |
---|
128 | 128 | | ‘‘(d) Expenditures made for a program, project, or 16 |
---|
129 | 129 | | activity for any fiscal year pursuant to this section shall 17 |
---|
130 | 130 | | be charged to the applicable appropriation, fund, or au-18 |
---|
131 | 131 | | thorization whenever a regular appropriation bill or a 19 |
---|
132 | 132 | | measure making continuing appropriations until the end 20 |
---|
133 | 133 | | of a fiscal year providing for such program, project, or 21 |
---|
134 | 134 | | activity for such period becomes law. 22 |

135 | 135 | | ‘‘(e) This section shall not apply to a program, 23 |
