3131 NGENERAL.—Chapter 2 of title 18, United 3
3232 States Code, is amended by adding at the end the fol-4
3333 lowing: 5
3434 ‘‘§ 40B. Evading arrest or detention while operating a 6
3535 motor vehicle 7
3636 ‘‘(a) O
3737 FFENSE.—A person commits an offense under 8
3838 this section by operating a motor vehicle within 100 miles 9
3939 of the United States border while intentionally fleeing 10
4040 from— 11
4141 ‘‘(1) a pursuing U.S. Border Patrol agent act-12
4242 ing pursuant to lawful authority; or 13
4343 ‘‘(2) any pursuing Federal, State, or local law 14
4444 enforcement officer who is actively assisting, or 15
4545 under the command of, U.S. Border Patrol. 16
4646 ‘‘(b) P
4747 ENALTIES.— 17
4848 ‘‘(1) I
4949 N GENERAL.—Except as provided in para-18
5050 graphs (2) and (3), any person who commits an of-19
5151 fense described in subsection (a) shall be— 20
5252 ‘‘(A) imprisoned for a term of not more 21
5353 than 2 years; 22
5454 ‘‘(B) fined under this title; or 23
5555 ‘‘(C) subject to the penalties described in 24
5656 subparagraphs (A) and (B). 25

6161 ily injury results from the commission of an offense 2
6262 described in subsection (a), the person committing 3
6363 such offense shall be— 4
6464 ‘‘(A) imprisoned for a term of not less 5
6565 than 5 years and not more than 20 years; 6
6666 ‘‘(B) fined under this title; or 7
6767 ‘‘(C) subject to the penalties described in 8
6868 subparagraphs (A) and (B). 9

7070 EATH.—If the death of any person re-10
7171 sults from the commission of an offense described in 11
7272 subsection (a), the person committing such offense 12
7373 shall be— 13
7474 ‘‘(A) imprisoned for a term of not less 14
7575 than 10 years and up to life; 15
7676 ‘‘(B) fined under this title; or 16
7777 ‘‘(C) subject to the penalties described in 17
7878 subparagraphs (A) and (B).’’. 18

102102 States Code, is inadmissible.’’. 14

105105 migration and Nationality Act (8 U.S.C. 1227(a)(2)) is 16

132132 SEC. 4. ANNUAL REPORT. 12
133133 The Attorney General, in consultation with the Sec-13
134134 retary of Homeland Security, shall submit an annual re-14
135135 port to the Committee on the Judiciary of the Senate and 15
136136 the Committee on the Judiciary of the House of Rep-16
137137 resentatives that— 17
138138 (1) identifies the number of people who com-18
139139 mitted a violation of section 40B(a) of title 18, 19
140140 United States Code, as added by section 2(a); and 20
141141 (2) summarizes— 21
142142 (A) the number of individuals who were 22
143143 charged with such violation; 23
