38 | 38 | | this section by operating a motor vehicle within 100 miles 9 |

39 | 39 | | of the United States border while intentionally fleeing 10 |
---|
40 | 40 | | from— 11 |
---|
41 | 41 | | ‘‘(1) a pursuing U.S. Border Patrol agent act-12 |
---|
42 | 42 | | ing pursuant to lawful authority; or 13 |
---|
43 | 43 | | ‘‘(2) any pursuing Federal, State, or local law 14 |
---|
44 | 44 | | enforcement officer who is actively assisting, or 15 |
---|
45 | 45 | | under the command of, U.S. Border Patrol. 16 |
