17	17	To impose criminal and immigration penalties for inten-
18	18	tionally fleeing a pursuing Federal officer while operating
19	19	a motor vehicle.
20	20	Be it enacted by the Senate and House of Representa-1
21	21	tives of the United States of America in Congress assembled, 2
22	22	SECTION 1. SHORT TITLE. 3
23	23	This Act may be cited as ‘‘Agent Raul Gonzalez Offi-4
24	24	cer Safety Act’’. 5

28	28	SEC. 2. CRIMINAL PENALTIES FOR EVADING ARREST OR 1
29	29	DETENTION. 2
30	30	(a) I
31	31	NGENERAL.—Chapter 2 of title 18, United 3
32	32	States Code, is amended by adding at the end the fol-4
33	33	lowing: 5
34	34	‘‘§ 40B. Evading arrest or detention while operating a 6
35	35	motor vehicle 7
36	36	‘‘(a) O
37	37	FFENSE.—A person commits an offense under 8
38	38	this section by operating a motor vehicle within 100 miles 9
39	39	of the United States border while intentionally fleeing 10
40	40	from— 11
41	41	‘‘(1) a pursuing U.S. Border Patrol agent act-12
42	42	ing pursuant to lawful authority; or 13
43	43	‘‘(2) any pursuing Federal, State, or local law 14
44	44	enforcement officer who is actively assisting, or 15
45	45	under the command of, U.S. Border Patrol. 16
46	46	‘‘(b) P
47	47	ENALTIES.— 17
48	48	‘‘(1) I
49	49	N GENERAL.—Except as provided in para-18
50	50	graphs (2) and (3), any person who commits an of-19
51	51	fense described in subsection (a) shall be— 20
52	52	‘‘(A) imprisoned for a term of not more 21
53	53	than 2 years; 22
54	54	‘‘(B) fined under this title; or 23
55	55	‘‘(C) subject to the penalties described in 24
56	56	subparagraphs (A) and (B). 25

60	60	‘‘(2) SERIOUS BODILY INJURY.—If serious bod-1
61	61	ily injury results from the commission of an offense 2
62	62	described in subsection (a), the person committing 3
63	63	such offense shall be— 4
64	64	‘‘(A) imprisoned for a term of not less 5
65	65	than 5 years and not more than 20 years; 6
66	66	‘‘(B) fined under this title; or 7
67	67	‘‘(C) subject to the penalties described in 8
68	68	subparagraphs (A) and (B). 9
69	69	‘‘(3) D
70	70	EATH.—If the death of any person re-10
71	71	sults from the commission of an offense described in 11
72	72	subsection (a), the person committing such offense 12
73	73	shall be— 13
74	74	‘‘(A) imprisoned for a term of not less 14
75	75	than 10 years and up to life; 15
76	76	‘‘(B) fined under this title; or 16
77	77	‘‘(C) subject to the penalties described in 17
78	78	subparagraphs (A) and (B).’’. 18

80	80	LERICALAMENDMENT.—The analysis for chap-19
81	81	ter 2 of title 18, United States Code, is amended by add-20
82	82	ing at the end the following: 21
83	83	‘‘40B. Evading arrest or detention while operating a motor vehicle.’’.

92	92	NADMISSIBILITY.—Section 212(a)(2) of the Im-5
93	93	migration and Nationality Act (8 U.S.C. 1182(a)(2)) is 6
94	94	amended by adding at the end the following: 7
95	95	‘‘(J) E
96	96	VADING ARREST OR DETENTION 8
97	97	WHILE OPERATING A MOTOR VEHICLE .—Any 9
98	98	alien who has been convicted of, who admits 10
99	99	having committed, or who admits committing 11
100	100	acts which constitute the essential elements of, 12
101	101	a violation of section 40B(a) of title 18, United 13
102	102	States Code, is inadmissible.’’. 14
103	103	(b) D
104	104	EPORTABILITY.—Section 237(a)(2) of the Im-15
105	105	migration and Nationality Act (8 U.S.C. 1227(a)(2)) is 16
106	106	amended by adding at the end the following: 17
107	107	‘‘(G) E
108	108	VADING ARREST OR DETENTION 18
109	109	WHILE OPERATING A MOTOR VEHICLE .—Any 19
110	110	alien who has been convicted of, who admits 20
111	111	having committed, or who admits committing 21
112	112	acts which constitute the essential elements of, 22
113	113	a violation of section 40B(a) of title 18, United 23
114	114	States Code, is deportable.’’. 24

119	119	Immigration and Nationality Act (8 U.S.C. 1158) is 2

129	129	of section 40B(a) of title 18, United States Code, shall 9
130	130	be ineligible for relief under the immigration laws, includ-10
131	131	ing asylum under this section.’’. 11
132	132	SEC. 4. ANNUAL REPORT. 12
133	133	The Attorney General, in consultation with the Sec-13
134	134	retary of Homeland Security, shall submit an annual re-14
135	135	port to the Committee on the Judiciary of the Senate and 15
136	136	the Committee on the Judiciary of the House of Rep-16
137	137	resentatives that— 17
138	138	(1) identifies the number of people who com-18
139	139	mitted a violation of section 40B(a) of title 18, 19
140	140	United States Code, as added by section 2(a); and 20
141	141	(2) summarizes— 21
142	142	(A) the number of individuals who were 22
143	143	charged with such violation; 23

151	151	mitted such violation, but were not appre-5

154	154	documents pertaining to such violation; and 8
155	155	(E) the penalties imposed for such viola-9
