15	15	To authorize the Secretary of Health and Human Services
16	16	to collect registration fees from members of the Organ
17	17	Procurement and Transplantation Network, and for
18	18	other purposes.
19	19	Be it enacted by the Senate and House of Representa-1
20	20	tives of the United States of America in Congress assembled, 2
21	21	SECTION 1. SHORT TITLE. 3
22	22	This Act may be cited as the ‘‘OPTN Fee Collection 4
23	23	Authority Act’’. 5

29	29	Section 372 of the Public Health Service Act (42 3
30	30	U.S.C. 274) is amended— 4
31	31	(1) in subsection (b)(2)— 5
32	32	(A) by moving the margins of subpara-6
33	33	graphs (M) through (O) 2 ems to the left; 7
34	34	(B) in subparagraph (A)— 8
35	35	(i) in clause (i), by striking ‘‘, and’’ 9
36	36	and inserting ‘‘; and’’; and 10
37	37	(ii) in clause (ii), by striking the 11
38	38	comma at the end and inserting a semi-12
39	39	colon; 13
40	40	(C) in subparagraph (C), by striking 14
41	41	‘‘twenty-four-hour telephone service’’ and in-15
42	42	serting ‘‘24-hour telephone or information tech-16
43	43	nology service’’; 17
44	44	(D) in each of subparagraphs (B) through 18
45	45	(M), by striking the comma at the end and in-19
46	46	serting a semicolon; 20
47	47	(E) in subparagraph (N), by striking 21
48	48	‘‘transportation, and’’ and inserting ‘‘transpor-22
49	49	tation;’’; 23
50	50	(F) in subparagraph (O), by striking the 24
51	51	period and inserting a semicolon; and 25
52	52	(G) by adding at the end the following: 26

56	56	‘‘(P) encourage the integration of electronic 1
57	57	health records systems through application program-2
58	58	ming interfaces (or successor technologies) among 3
59	59	hospitals, organ procurement organizations, and 4
60	60	transplant centers, including the use of automated 5
61	61	electronic hospital referrals and the grant of remote, 6
62	62	electronic access to hospital electronic health records 7
63	63	of potential donors by organ procurement organiza-8
64	64	tions, in a manner that complies with the privacy 9
65	65	regulations promulgated under the Health Insurance 10
66	66	Portability and Accountability Act of 1996, at part 11
67	67	160 of title 45, Code of Federal Regulations, and 12
68	68	subparts A, C, and E of part 164 of such title (or 13
69	69	any successor regulations); and 14
70	70	‘‘(Q) consider establishing a dashboard to dis-15
71	71	play the number of transplants performed, the types 16
72	72	of transplants performed, the number and types of 17
73	73	organs that entered the Organ Procurement and 18
74	74	Transplantation Network system and failed to be 19
75	75	transplanted, and other appropriate statistics, which 20
76	76	should be updated more frequently than annually.’’; 21
77	77	and 22
78	78	(2) by adding at the end the following: 23

80	80	EGISTRATIONFEES.— 24

84	84	‘‘(1) IN GENERAL.—The Secretary may collect 1
85	85	registration fees from any member of the Organ 2
86	86	Procurement and Transplantation Network for each 3
87	87	transplant candidate such member places on the list 4
88	88	described in subsection (b)(2)(A)(i). Such registra-5
89	89	tion fees shall be collected and distributed only to 6
90	90	support the operation of the Organ Procurement 7
91	91	and Transplantation Network. Such registration fees 8
92	92	are authorized to remain available until expended. 9
93	93	‘‘(2) C
94	94	OLLECTION.—The Secretary may collect 10
95	95	the registration fees under paragraph (1) directly or 11
96	96	through awards made under subsection (b)(1)(A). 12
97	97	‘‘(3) D
98	98	ISTRIBUTION.—Any amounts collected 13
99	99	under this subsection shall— 14
100	100	‘‘(A) be credited to the currently applicable 15
101	101	appropriation, account, or fund of the Depart-16
102	102	ment of Health and Human Services as discre-17
103	103	tionary offsetting collections; and 18
104	104	‘‘(B) be available, only to the extent and in 19
105	105	the amounts provided in advance in appropria-20
106	106	tions Acts, to distribute such fees among 21
107	107	awardees described in subsection (b)(1)(A). 22

109	109	RANSPARENCY.—The Secretary shall— 23

114	114	Organ Procurement and Transplantation Net-2
115	115	work— 3
116	116	‘‘(i) the amount of registration fees 4
117	117	collected under this subsection from each 5
118	118	member of the Organ Procurement and 6
119	119	Transplantation Network; and 7
120	120	‘‘(ii) a list of activities such fees are 8
121	121	used to support; and 9
122	122	‘‘(B) update the information posted pursu-10
123	123	ant to subparagraph (A), as applicable for each 11
124	124	calendar quarter for which fees are collected 12
125	125	under paragraph (1). 13
126	126	‘‘(5) GAO
127	127	REVIEW.—Not later than 2 years 14
128	128	after the date of enactment of this subsection, the 15
129	129	Comptroller General of the United States shall, to 16
130	130	the extent data are available— 17
131	131	‘‘(A) conduct a review concerning the ac-18
132	132	tivities under this subsection; and 19
133	133	‘‘(B) submit to the Committee on Health, 20
134	134	Education, Labor, and Pensions and the Com-21
135	135	mittee on Finance of the Senate and the Com-22
136	136	mittee on Energy and Commerce of the House 23
137	137	of Representatives, a report on such review, in-24
138	138	cluding related recommendations, as applicable. 25

142	142	‘‘(6) SUNSET.—The authority to collect reg-1
143	143	istration fees under paragraph (1) shall expire on 2
144	144	the date that is 3 years after the date of enactment 3
145	145	of the OPTN Fee Collection Authority Act.’’. 4
