5858 ming interfaces (or successor technologies) among 3
5959 hospitals, organ procurement organizations, and 4
6060 transplant centers, including the use of automated 5
6161 electronic hospital referrals and the grant of remote, 6
6262 electronic access to hospital electronic health records 7
6363 of potential donors by organ procurement organiza-8
6464 tions, in a manner that complies with the privacy 9
6565 regulations promulgated under the Health Insurance 10
6666 Portability and Accountability Act of 1996, at part 11
6767 160 of title 45, Code of Federal Regulations, and 12
6868 subparts A, C, and E of part 164 of such title (or 13
6969 any successor regulations); and 14
7070 ‘‘(Q) consider establishing a dashboard to dis-15
7171 play the number of transplants performed, the types 16
7272 of transplants performed, the number and types of 17
7373 organs that entered the Organ Procurement and 18
7474 Transplantation Network system and failed to be 19
7575 transplanted, and other appropriate statistics, which 20
7676 should be updated more frequently than annually.’’; 21

8484 ‘‘(1) IN GENERAL.—The Secretary may collect 1
8585 registration fees from any member of the Organ 2
8686 Procurement and Transplantation Network for each 3
8787 transplant candidate such member places on the list 4
8888 described in subsection (b)(2)(A)(i). Such registra-5
8989 tion fees shall be collected and distributed only to 6
9090 support the operation of the Organ Procurement 7
9191 and Transplantation Network. Such registration fees 8
9292 are authorized to remain available until expended. 9
9393 ‘‘(2) C
9494 OLLECTION.—The Secretary may collect 10
9595 the registration fees under paragraph (1) directly or 11
9696 through awards made under subsection (b)(1)(A). 12
9797 ‘‘(3) D
9898 ISTRIBUTION.—Any amounts collected 13
9999 under this subsection shall— 14
100100 ‘‘(A) be credited to the currently applicable 15
101101 appropriation, account, or fund of the Depart-16
102102 ment of Health and Human Services as discre-17
103103 tionary offsetting collections; and 18
104104 ‘‘(B) be available, only to the extent and in 19
105105 the amounts provided in advance in appropria-20
106106 tions Acts, to distribute such fees among 21
107107 awardees described in subsection (b)(1)(A). 22

109109 RANSPARENCY.—The Secretary shall— 23

114114 Organ Procurement and Transplantation Net-2

116116 ‘‘(i) the amount of registration fees 4
117117 collected under this subsection from each 5
118118 member of the Organ Procurement and 6
119119 Transplantation Network; and 7
120120 ‘‘(ii) a list of activities such fees are 8
121121 used to support; and 9
122122 ‘‘(B) update the information posted pursu-10
123123 ant to subparagraph (A), as applicable for each 11
124124 calendar quarter for which fees are collected 12
125125 under paragraph (1). 13
126126 ‘‘(5) GAO
127127 REVIEW.—Not later than 2 years 14
128128 after the date of enactment of this subsection, the 15
129129 Comptroller General of the United States shall, to 16
130130 the extent data are available— 17
131131 ‘‘(A) conduct a review concerning the ac-18
132132 tivities under this subsection; and 19
133133 ‘‘(B) submit to the Committee on Health, 20
134134 Education, Labor, and Pensions and the Com-21
135135 mittee on Finance of the Senate and the Com-22
136136 mittee on Energy and Commerce of the House 23
137137 of Representatives, a report on such review, in-24
138138 cluding related recommendations, as applicable. 25

142142 ‘‘(6) SUNSET.—The authority to collect reg-1
143143 istration fees under paragraph (1) shall expire on 2
144144 the date that is 3 years after the date of enactment 3
145145 of the OPTN Fee Collection Authority Act.’’. 4
