147147 ‘‘(B) the number of tips or other statistical 8
148148 data from the CyberTipline of the National 9
149149 Center for Missing and Exploited Children and 10
150150 other data indicating the magnitude of child 11
151151 pornography trafficking; and 12
152152 ‘‘(C) any other statistical data indicating 13
153153 the type, nature, and extent of child exploi-14
154154 tation crime in the United States and abroad.’’. 15

203203 prioritization decisions with respect to leads related 4
204204 to Internet crimes against children described in sec-5
205205 tion 104(8), may not be brought in any Federal or 6
206206 State court. 7
207207 ‘‘(2) I
208208 NTENTIONAL, RECKLESS, OR OTHER MIS-8
209209 CONDUCT.—Paragraph (1) shall not apply to a claim 9
210210 if the ICAC task force or law enforcement agency, 10
211211 or a director, officer, employee, or agent of that law 11
212212 enforcement agency— 12
213213 ‘‘(A) engaged in intentional misconduct; or 13
214214 ‘‘(B) acted, or failed to act— 14
215215 ‘‘(i) with actual malice; 15
216216 ‘‘(ii) with reckless disregard to a sub-16
217217 stantial risk of causing physical injury 17
218218 without legal justification; or 18
219219 ‘‘(iii) for a purpose unrelated to the 19
220220 performance of any responsibility or func-20
221221 tion under section 104(8).’’. 21

224224 of the PROTECT Our Children Act of 2008 (34 U.S.C. 23
