278278 conflict with this title, the Agreement is authorized, 19

282282 Agreement, or any attachment to the Agreement re-22
283283 quiring the signature of the Secretary, is executed in 23

293293 N GENERAL.—To the extent that the 4
294294 Agreement does not conflict with this title, the Sec-5
295295 retary shall execute the Agreement, including all at-6
296296 tachments to, or parts of, the Agreement requiring 7
297297 the signature of the Secretary. 8

299299 ODIFICATIONS.—Nothing in this title pro-9
300300 hibits the Secretary, after execution of the Agree-10
301301 ment, from approving any modification to the Agree-11
302302 ment, including an attachment to the Agreement, 12
303303 that is consistent with this title, to the extent that 13
304304 the modification does not otherwise require congres-14
305305 sional approval under section 2116 of the Revised 15
306306 Statutes (25 U.S.C. 177) or any other applicable 16
307307 provision of Federal law. 17

309309 NVIRONMENTAL COMPLIANCE.— 18

311311 N GENERAL.—In implementing the Agree-19
312312 ment and this title, the Secretary shall comply 20
313313 with— 21
314314 (A) the Endangered Species Act of 1973 22
315315 (16 U.S.C. 1531 et seq.); 23

328328 Agreement and this title, the Pueblos shall pre-8
329329 pare any necessary environmental documents, 9
330330 consistent with— 10
331331 (i) the Endangered Species Act of 11
332332 1973 (16 U.S.C. 1531 et seq.); 12
333333 (ii) the National Environmental Policy 13
334334 Act of 1969 (42 U.S.C. 4321 et seq.), in-14
335335 cluding the implementing regulations of 15
336336 that Act; and 16
337337 (iii) all other applicable Federal envi-17
338338 ronmental laws and regulations. 18
339339 (B) A
340340 UTHORIZATIONS.—The Secretary 19
341341 shall— 20
342342 (i) independently evaluate the docu-21
343343 mentation required under subparagraph 22
344344 (A); and 23
345345 (ii) be responsible for the accuracy, 24
346346 scope, and contents of that documentation. 25

350350 (3) EFFECT OF EXECUTION .—The execution of 1
351351 the Agreement by the Secretary under this section 2
352352 shall not constitute a major Federal action under 3
353353 the National Environmental Policy Act of 1969 (42 4
354354 U.S.C. 4321 et seq.). 5

356356 OSTS.—Any costs associated with the per-6
357357 formance of the compliance activities under this sub-7
358358 section shall be paid from funds deposited in the 8
359359 Pueblo Trust Funds, subject to the condition that 9
360360 any costs associated with the performance of Federal 10
361361 approval or other review of such compliance work or 11
362362 costs associated with inherently Federal functions 12
363363 shall remain the responsibility of the Secretary. 13
364364 SEC. 104. PUEBLO WATER RIGHTS. 14

366366 RUSTSTATUS OF THE PUEBLOWATER 15

368368 IGHTS.—The Pueblo Water Rights shall be held in trust 16
369369 by the United States on behalf of the Pueblos in accord-17
370370 ance with the Agreement and this title. 18

372372 ORFEITURE ANDABANDONMENT.— 19

374374 N GENERAL.—The Pueblo Water Rights 20
375375 shall not be subject to loss through non-use, for-21
376376 feiture, abandonment, or other operation of law. 22

378378 TATE-LAW BASED WATER RIGHTS .—Pur-23
379379 suant to the Agreement, State-law based water 24
380380 rights acquired by a Pueblo, or by the United States 25

387387 alienation from the time they are acquired. 4

389389 SE.—Any use of the Pueblo Water Rights shall 5
390390 be subject to the terms and conditions of the Agreement 6
391391 and this title. 7

393393 LLOTMENT RIGHTSNOTINCLUDED.—The 8
394394 Pueblo Water Rights shall not include any water uses or 9
395395 water rights claims on an Allotment. 10

397397 UTHORITY OF THEPUEBLOS.— 11

399399 N GENERAL.—The Pueblos shall have the 12
400400 authority to allocate, distribute, and lease the Pueblo 13
401401 Water Rights for use on Pueblo Land in accordance 14
402402 with the Agreement, this title, and applicable Fed-15
403403 eral law. 16

405405 SE OFF PUEBLO LAND .—The Pueblos may 17
406406 allocate, distribute, and lease the Pueblo Water 18
407407 Rights for use off Pueblo Land in accordance with 19
408408 the Agreement, this title, and applicable Federal 20
409409 law, subject to the approval of the Secretary. 21

411411 LLOTTEE WATER RIGHTS .—The Pueblos 22
412412 shall not object in any general stream adjudication, 23
413413 including the Adjudication, or any other appropriate 24
414414 forum, to the quantification of reasonable domestic, 25

419419 and shall administer any water use in accordance 2
420420 with applicable Federal law, including recognition 3

422422 (A) any water use existing on an Allotment 5
423423 as of the date of enactment of this Act; 6
424424 (B) reasonable domestic, stock, and irriga-7
425425 tion water uses on an Allotment; and 8
426426 (C) any Allotment water right decreed in a 9
427427 general stream adjudication, including the Ad-10
428428 judication, or other appropriate forum, for an 11
429429 Allotment. 12

431431 DMINISTRATION.— 13
432432 (1) N
433433 O ALIENATION.—The Pueblos shall not 14
434434 permanently alienate any portion of the Pueblo 15
435435 Water Rights. 16

437437 URCHASES OR GRANTS OF LAND FROM IN -17
438438 DIANS.—An authorization provided by this title for 18
439439 the allocation, distribution, leasing, or other ar-19
440440 rangement entered into pursuant to this title shall 20
441441 be considered to satisfy any requirement for author-21
442442 ization of the action required by Federal law. 22

444444 ROHIBITION ON FORFEITURE .—The non- 23
445445 use of all or any portion of the Pueblo Water Rights 24
446446 by any water user shall not result in the forfeiture, 25

452452 SEC. 105. SETTLEMENT TRUST FUNDS. 3

454454 STABLISHMENT.—The Secretary shall establish 4
455455 2 trust funds, to be known as the ‘‘Pueblo of Acoma Set-5
456456 tlement Trust Fund’’ and the ‘‘Pueblo of Laguna Settle-6
457457 ment Trust Fund’’, and a trust fund for the benefit of 7
458458 both Pueblos to be known as the ‘‘Acomita Reservoir 8
459459 Works Trust Fund’’, to be managed, invested, and distrib-9
460460 uted by the Secretary and to remain available until ex-10
461461 pended, withdrawn, or reverted to the general fund of the 11
462462 Treasury, consisting of the amounts deposited in the 12
